본 연구는 제22대 국회의원선거 과정에서 이루어진 선거방송심의위원회의 심의·의결에 대한 행정소송 판결을 분석하여, 당시 선거방송심의의 정당성의 한계와 이에 대한 사법적 판단 기준을 실증적으로 규명하고자 하였다. 이를 위해 선거방송심의의 정당성을 절차적 정당성과 실질적 정당성의 차원으로 구분하고, 공개된 제22대 총선 관련 행정소송 14건의 판결문을 질적으로 분석하였다. 분석 결과, 절차적 정당성 측면에서 법원은 방송통신위원회의 2인 체제 자체를 위법하다고 보지 않았으나, 재심 절차의 실질성 부족 문제를 반복적으로 거론하였다. 실질적 정당성 측면에서는 법원이 ‘선거방송’의 범위를 엄격하게 해석하고, 정치적 논평 일반까지 심의대상을 확장하는 것에 제한적인 태도를 보였다. 또한 공정성·객관성·균형성 등의 심의기준은 방송 전체의 맥락과 프로그램 특성을 고려하여 신중하게 적용되어야 하며, 단순한 표현만으로 기계적으로 판단되어서는 안 된다고 보았다. 나아가 관계자 징계 등 중한 법정 제재에 대해서는 비례성 원칙에 따라 엄격한 심사가 이루어졌고, 다수 사건에서 재량권 일탈·남용이 인정되었다. 본 연구는 이를 바탕으로 재심 절차의 실질화, 심의대상 범주의 명확화, 심의기준의 구체화 및 제재수준의 비례성 강화가 선거방송심의의 정당성 확보를 위한 핵심 과제임을 제시하였다.

This study examines how the legitimacy of election broadcasting deliberation is secured by analyzing administrative court decisions related to the deliberations and sanctions imposed by the Election Broadcasting Deliberation Commission during the 22nd National Assembly Election in South Korea. To this end, the study reconstructs the legitimacy of election broadcasting deliberation into two dimensions: procedural legitimacy and substantive legitimacy. Based on this framework, fourteen administrative litigation cases concerning election broadcasting deliberation were qualitatively analyzed. The findings show that, in terms of procedural legitimacy, the courts did not regard the two-member structure of the Korea Communications Commission itself as unlawful. However, concerns regarding the lack of substantive functionality in the rehearing process were repeatedly identified. In terms of substantive legitimacy, the courts interpreted the concept of “election broadcasting” narrowly and adopted a restrictive approach toward expanding the scope of deliberation to encompass general political commentary. In addition, the courts emphasized that deliberation standards such as fairness, objectivity, and balance should be applied carefully by considering the overall context of the broadcast and the characteristics of the program, rather than through mechanical judgments based solely on isolated expressions. Furthermore, the courts conducted strict proportionality reviews regarding severe statutory sanctions, including disciplinary measures against program personnel, and recognized abuse or deviation of discretionary authority in many cases. Based on these findings, this study suggests that strengthening the substantive operation of rehearing procedures, clarifying the scope of deliberation, specifying deliberation standards, and reinforcing proportionality in sanctions are essential tasks for securing the legitimacy of election broadcasting deliberation.
