이 논문은 우리 헌법상 ‘경제 민주화’의 규범적 함의를 고찰하며, 자본주의 체제 내에서 소외된 국민의 경제적 삶을 보호하기 위한 국가의 역할을 탐구하였다. 1948년 제헌헌법 제5조부터 현행 헌법 제119조 제2항에 이르기까지 경제적 민주주의의 역사적 변천을 분석하고, 헌법 전문의 내용을 토대로 하여 경제주체 간의 조화를 통한 민주적 경제공동체 형성의 정당성을 논증하였다. 특히 헌법상 ‘경제 민주화’는 국가의 경제 규제와 조정을 통해 실현되지만, 단순한 국가의 규제와 조정을 넘어서 궁극적으로 ‘인간적인 경제 사회’의 구축을 목적으로 해야 함을 강조하였다. 이는 우리 국민이 국민경제의 주인으로서 경제헌법을 토대로 국민경제의 방향을 스스로 결정하는 ‘민주적 경제공동체’를 지향할 때 실현 가능하다. 결론적으로 경제는 사람을 위해 존재해야 하며, 헌법이 지향하는 경제 민주화는 국민의 인간다운 삶이 실질적으로 보장되는 민주적 국민경제를 구축하라는 시대적 명령임을 제시하였다.
This paper examines the normative implications of ‘economic democratization’ under the Korean Constitution and explores the role of the state in protecting the economic lives of citizens alienated within the capitalist system. It analyzes the historical evolution of economic democracy from Article 5 of the 1948 Constitution to Article 119, Paragraph 2 of the current Constitution, and demonstrates the constitutional legitimacy of the state’s power to regulate and coordinate for the establishment of a democratic economic community through harmony among economic agents. In particular, the study emphasizes that economic democratization must aim beyond mere state regulation toward the ultimate goal of building a “humane economic society.” This is achievable only when citizens, as masters of the national economy, steer the direction of the national economy through the economic constitution to realize a “democratic economic community.” In conclusion, just as the state exists for the people, the economy must also exist for humanity. The economic democratization mandated by the Constitution signifies a directive to build a democratic national economy where citizens are the rightful owners and a life of human dignity is substantially guaranteed.

본 논문은 공정거래위원회의 인력증원 및 조직확대 논의를 배경으로, 「독점규제 및 공정거래에 관한 법률」의 핵심 입법목적인 “공정하고 자유로운 경쟁”의 헌법적 의미와 가치를 규명하고, 이를 토대로 공정거래위원회의 조직·구성 및 운영에 관한 헌법적 요청을 체 계적으로 검토하는 것을 목적으로 한다. 우선 경쟁은 단순히 경제질서에 국한되지 않고 민주적 헌법질서 전반의 기초를 이루는 원리임을 확인한다. 경쟁은 헌법에 명시적으로 규정되어 있지 않더라도 자유·평등·직업의 자유·재산권·사회적 시장경제질서 등에 내재된 헌법원리로서, 선거제도·표현의 자유·지방자치 등 민주주의의 작동 메커니즘과도 긴밀하게 연결되어 있다. 다음으로 독일 프라이부르크 학파의 질서자유주의와 칸젠바흐·호프만 논쟁을 통해 “자유롭고 공정한 경쟁”이 단순한 경제정책적 목표를 넘어 규범적 가치를 갖는 협의의 개념임을 논증한다. 아울러 우리 헌법재판소의 결정례를 유형화·분석하여, “자유롭고 공정한 경쟁”이 헌법 제119조에 근거한 독자적 위헌심사기준으로 원용될 수 있고, 비례원칙 판단의 고려요소이자 기업의 자유와 결합된 기본권적 지위를 갖는다는 점을 밝힌다. 이를 바탕으로 공정거래위원회의 조직·구성에 관한 헌법적 요청으로서 독립성·전문성·민주적 정당성·책임성을 순차적으로 검토한다. 특히 현행 공정거래위원회는 준사법적 심판기능과 행정부 소속 중앙행정기관으로서의 정책기능이 교착된 구조적 문제를 안고 있 으며, 조사기능과 심판기능의 미분리는 적법절차원칙과 긴장관계를 형성하고 있음을 지적한다. 이에 대한 개선방안으로 위원 전원 상임화를 통한 책임성·전문성 강화, 임명절차의 민주적 정당성 제고, 조사·심판 기능의 실질적 분리, 행정조사 절차의 적법절차 원칙 준 수, 사법적 권리구제 절차의 개선 등을 제안한다. 마지막으로 독일 연방대법원의 Meta Platforms(Facebook) 사건 및 EU 사법재판소 의 판결을 분석하여, 디지털 플랫폼 시대에 경쟁법과 기본권(개인정보자기결정권 등)의 접점이 확장되고 있음을 논증한다. “공정하고 자유로운 경쟁”은 사업자의 경쟁의 자유뿐만 아니라 소비자의 선택권과 결정의 자유를 함께 고려하는 포괄적 이익형량의 틀로 발전해야 하며, 이는 헌법질서의 자기조정 메커니즘으로서 자유민주적 헌정질서의 동태적 해석과 합리적 경제규제행정의 재구조화를 위한 출발점이 되어야 함을 강조한다.
This paper aims to clarify the constitutional meaning and value of "fair and free competition," which serves as the core legislative purpose of the Monopoly Regulation and Fair Trade Act, and to systematically examine the constitutional requirements concerning the organization, composition, and operation of the Korea Fair Trade Commission (KFTC), against the backdrop of ongoing discussions regarding the expansion of its personnel and organizational structure. First, this paper confirms that competition is not merely confined to the economic order but constitutes a foundational principle underlying the entire democratic constitutional order. Even though competition is not explicitly stipulated in the Constitution, it is understood as an inherent constitutional principle embedded in freedom, equality, freedom of occupation, property rights, and the social market economic order. It is also closely linked to the functioning mechanisms of democracy, including the electoral system, freedom of expression, and local autonomy. Through an analysis of the Ordoliberalism of the Freiburg School and the Kantzenbach-Hoppmann debate in Germany, this paper demonstrates that "free and fair competition" transcends a mere economic policy objective and constitutes a concept with normative value in the narrow sense. Furthermore, by categorizing and analyzing the decisions of the Korean Constitutional Court, this paper establishes that "free and fair competition" can be invoked as an independent standard of constitutional review based on Article 119 of the Constitution, serves as a consideration in proportionality assessments, and holds the status of a fundamental right. This paper sequentially examines the constitutional requirements of independence, expertise, democratic legitimacy, and accountability as they pertain to the organization and composition of the KFTC. In particular, it points out that the current structure of the KFTC is burdened with a structural problem in which its quasi-judicial adjudicative function is entangled with its policy function as a central administrative agency under the executive branch. It further argues that the failure to separate the investigative function from the adjudicative function creates tension with the principle of due process of law. As remedial measures, the paper proposes strengthening accountability and expertise by converting all commissioner positions to full-time status, enhancing the democratic legitimacy of the appointment process, achieving a substantive separation between the investigative and adjudicative functions, ensuring compliance with the due process principle in administrative investigation procedures, and improving judicial remedy procedures. Finally, through an analysis of the German Federal Court of Justice's ruling in the Meta Platforms (Facebook) case and the judgment of the Court of Justice of the European Union (CJEU), the paper demonstrates that the interface between competition law and fundamental rights — including the right to informational self-determination — is expanding in the era of digital platforms. It emphasizes that "fair and free competition" must evolve into a framework of comprehensive balancing of interests that considers not only the freedom of competition of business operators but also the freedom of choice and decision-making autonomy of consumers. This framework should serve as the starting point for a dynamic interpretation of the liberal democratic constitutional order and the restructuring of rational economic regulatory administration, functioning as a self-regulating mechanism of the constitutional order.

본 연구는 남북합의서의 규범력에 관한 문제를 검토하고 그 규범력을 제고하기 위한 다양한 방안을 모색하였다. 현재까지 남북합의서는 우리 헌법규범체계 속에서 조약도 국내법도 아닌 특수한 규범의 하나로 취급되어 왔으며 헌법재판소와 대법원은 ‘남북기본합의서’에 대한 법적 성격을 신사협정으로 보아 그 법적효력은 부인되었다. 그러나 헌재와 대법원의 판단은 남북합의서에 관한 사항이 “남북관계발전법”이 제정되어 남북합의서에 대한 사항이 규정되기 이전의 판단이었고 이후의 변화된 상황을 충분히 반영하지 못한 채 현재에 이르고 있다. 본 연구에서 논증한 결과 남북합의서의 규범력을 제고하기 위한 가장 실질적인 방법은 남북합의서를 조약으로 하는 것이었다. 그러나 현재까지 국내에서는 북한에 대한 국가로서의 법적 지위를 부인함에 따른 귀결로서 남북합의서도 조약의 지위를 갖지 못한다고 보았다. 그러나 조약인지 아닌지의 여부는 북한에 대한 법적 지위 여부의 문제가 아니라 체결 당사자가 체결의 주체성을 갖추고 있는지 법적 효력 창출의 의사가 있는지가 가장 중요한 기준으로 판단되어야 한다는 점을 알 수 있다. 흔히 조약법에 관한 비엔나협약의 제2조 정의 규정을 들어 체결 주체가 국가간이 아니라는 점에서 조약성을 부인하였으나 제3조에서 국가가 아니라도 체결 주체성이 있음을 규정하고 있고 당해 비엔나협약은 수많은 유형의 조약 가운데에서도 국가간의 조약을 규율하기 위한 취지로 제정된 것임을 간과하여서는 아니된다. 물론 모든 남북합의서가 조약적 성질을 가지는 것은 아니지만 조약과 같은 기준에 따라서 조약으로서의 성질을 갖는 것은 조약으로 취급하는 것이 타당할 것이다. 가장 확실한 규범력 제고방안은 헌법 제6조 제1항 및 제60조 제1항에서 조약과 함께 남북합의서를 추가 개정하는 것이라 하겠으나 개정이 불가피한 경우 남북합의서도 조약에 속하는 것으로 해석하여 취급하는 편도 고려될 수 있겠다. 부가적으로는 “남북관계발전법”상 남북합의서의 효력에 관한 규정을 삭제하고 조약적 성질의 남북합의서와 신사협정적 성질의 남북합의서를 구분하며 합의서 체결에 있어서 법적 효력 창출의 의사가 있는 경우에는 그 의사를 명확히 하여 조약과 같은 형식을 갖출 것이 요구된다. 아울러 체결된 남북합의서를 유엔 사무국에 등록하거나 적극적인 이행법률 제정을 통해 규범력을 확보할 수도 있을 것이다. 남북합의서에 규범력을 제고함으로써 남북간의 발전적 관계를 형성하고 한반도에 평화와 신뢰를 형성하도록 제도화하는 것은 우리 헌법상 통일에 관한 제규정에서 명하는 평화와 자유, 민주를 실천하는 유력한 방안이 될 것이다.
This study examines the issue of the normative force of inter-Korean agreements and explores various measures to enhance their effectiveness. To date, inter-Korean agreements have been treated within the Korean constitutional framework as a unique form of norm that is neither a treaty nor domestic law. The Constitutional Court and the Supreme Court have characterized the “Inter-Korean Basic Agreement” as a gentlemen’s agreement and have consequently denied its legally binding force. However, these judicial decisions were rendered prior to the enactment of the Development of Inter-Korean Relations Act, which subsequently introduced legal provisions concerning inter-Korean agreements, and thus fail to adequately reflect the changed legal and institutional circumstances. The analysis in this study demonstrates that the most practical means of strengthening the normative force of inter-Korean agreements is to treat them as treaties. Nevertheless, in domestic legal discourse, the denial of North Korea’s status as a state has led to the conclusion that inter-Korean agreements cannot be recognized as treaties. This study argues, however, that whether an agreement qualifies as a treaty should not depend on the legal status of North Korea, but rather on whether the parties possess the capacity to conclude the agreement and whether they intend to create legally binding effects. While Article 2 of the Vienna Convention on the Law of Treaties is often cited to deny treaty status on the ground that treaties are concluded between states, it should not be overlooked that Article 3 recognizes the possibility of treaty-making capacity for entities other than states, and that the Convention itself was primarily designed to regulate treaties between states among various types of international agreements. Although not all inter-Korean agreements possess treaty-like characteristics, those that meet the criteria of treaties should be treated accordingly. The most definitive way to enhance their normative force would be to amend Article 6(1) and Article 60(1) of the Constitution to explicitly include inter-Korean agreements alongside treaties. Alternatively, if constitutional amendment proves difficult, it may be considered to interpret inter-Korean agreements as falling within the scope of treaties. Additionally, it is necessary to revise the Development of Inter-Korean Relations Act by removing provisions concerning the effect of inter-Korean agreements, distinguishing between treaty-like agreements and non-binding (gentlemen’s) agreements, and ensuring that agreements intended to create legal effects are drafted in a form consistent with treaties. Furthermore, their normative force may be reinforced through registration with the United Nations Secretariat or through the active enactment of implementing legislation. Enhancing the normative force of inter-Korean agreements would contribute to the development of inter-Korean relations and to the institutionalization of peace and mutual trust on the Korean Peninsula. Such efforts would also serve as an effective means of realizing the constitutional principles of peaceful unification, freedom, and democracy.

인공지능 시대 개인에 관한 데이터는 더 이상 주체와 분리된 객관적 정보가 아니다. 인공지능의 끊임없는 수집과 가공을 통해 재처리된 데이터는 개인의 내밀한 심리, 사회적, 관계, 미래의 행태 양식을 투영하는 소위 ‘디지털 페르소나(Digital Persona)’를 구성한다. 기존의 개인정보자기결정권이 개인정보의 유출과 오용을 막는 보안과 방어에 대응했다면, 인공지능환경에서 자기결정권은 국가나 기업의 기술권력에 의해 규정되지 않는, 이른바 ‘예측된 사생활의 해악(Predictive privacy harm)’에 대응한 ‘데이터 인격권’으로 확장될 필요가 있다. 이른바 데이터 인격권은 인공지능 시스템에서 개인을 규정하는 알고리즘 환경이 그의 인격을 왜곡, 조작하지 못하도록 하는 실체적 권리로서 인공지능 결괏값에 대한 개인의 의사결정의 선택권 내지는 개입권으로 정의되어야 한다. 이는 근본적으로 헌법 제10조인 인간존엄 규정이 보장하는 자유로운 인격 발현에서 지지된다. ‘존엄’은 로마 시대부터 개인의 정치적 결단을 정당화하는 레토릭으로 사용돼왔고, 오늘날 법원은 존엄을 이유로 개인의 선택권을 보호하거나 공동체의 이익을 우선하기도 한다. 이러한 이유에서 ‘존엄’은 그 헌법적 위상과 국제사회에서의 위엄에도 불구하고, 실상 빈 껍질(empty shell)로 언제든 국가공동체의 논리에 의해서 개인을 희생시킬 수 있는 도구가 될 수 있는 것으로 비판받기도 한다. 그런데도, 존엄을 통해 인류는 인간의 절대적인 내적 가치(intrinsic value)와 자율성(autonomy), 공동체 가치(community value)를 공유해왔으니, 존엄은 공허한 개념이라고만 할 수는 없다. 그중 인간의 ‘내적가치’와 ‘자율성’은 인공지능 결정에 대응한 자기결정권의 핵심지표로 인간존엄의 보호영역에 포섭될 수 있을 것이다. 인간의 자기결정권은 기계의 결정에 대응한 최후의 보루로서 입법적 시혜가 아닌 헌법상 기본권으로 확립될 때, 비로소 실질적 권리가 될 수 있다. 이를 위해 인공지능 시대 인간존엄은 개인의 자기결정을 강화하는 동시에 국가의 상시적 후견주의에 제동을 거는 이중적 기능을 수행해야 할 것이다. 기존의 개인정보자기결정권이 정보의 흐름을 통제하는 소극적 방어에만 머물렀다면, 인공지능 결괏값에 대응한 이시대의 자기결정에는 ‘적극적 자유’의 요소가 요구된다. 아울러 인간존엄과 개별기본권간의 이익형량에 필요한 비례원칙에도 보완이 필요하다. 입법적으로는 사회적 점수화(social scoring) 등 개인을 낙인찍는 자동 분류나 인간을 객체화하는 알고리즘 처리와 실시간 수집, 처리되는 무차별적인 데이터 처리를 제한 것과 권리영향사전평가(FRIA), 독립적 사전통제, 설명권·이의권·배상권을 인공지능서비스 약관, 계약, 운영정책에 제시해 공·사 모두에 적용되는 것을 고려할 수 있겠다.
In the era of Artificial Intelligence (AI), data concerning individuals is no longer merely objective information decoupled from the subject. Data reprocessed through continuous collection and manipulation by AI constitutes a so-called “Digital Persona,” projecting an individual’s intimate psychological, social, and relational attributes, as well as future behavioral patterns. While the traditional right to informational self-determination focused on security and defense—namely, preventing the leakage and misuse of personal information—the AI environment necessitates an evolution toward “Data Personality Rights.” These rights serve as a response to “predictive privacy harm,” wherein an individual’s life is predefined by the technological power of the state or corporations. Data personality rights should be defined as substantive rights—specifically, the right to choose or intervene in AI-generated outcomes—to ensure that the algorithmic environment defining the individual does not distort or manipulate their personality. This shift is fundamentally supported by the “free manifestation of personality” guaranteed under the human dignity clause of Article 10 of the Constitution of the Republic of Korea. Since the Roman era, “dignity” has been employed as rhetoric to justify individual political decisions; today, courts invoke dignity either to protect individual autonomy or to limit it in favor of communal interests. Consequently, despite its constitutional and international stature, dignity is sometimes criticized as an “empty shell” that can be weaponized to sacrifice the individual to the logic of the state community. Nevertheless, dignity remains a vital concept through which humanity shares absolute intrinsic value, autonomy, and community values. Among these, “intrinsic value” and “autonomy” serve as core indices of self-determination in response to AI-driven decisions and fall within the protected ambit of human dignity. The right to self-determination can only become a substantive right when it is established as a constitutional fundamental right—the final bulwark against machine-led decision-making—rather than a mere legislative favor. To this end, human dignity in the AI era must perform a dual function: strengthening individual self-determination while simultaneously checking the pervasive paternalism of the state. While traditional informational self-determination remained a passive defense for controlling information flow, the contemporary right to self-determination regarding AI outcomes requires elements of “positive liberty.” Furthermore, the principle of proportionality used for balancing human dignity against specific fundamental rights requires supplementation. Legislatively, this may include: prohibiting automated classification that stigmatizes individuals(such as social scoring) or algorithmic processing that objectifies humans; restricting indiscriminate real-time data processing; and integrating Fundamental Rights Impact Assessments(FRIA), independent prior controls, and the rights to explanation, objection, and compensation into AI service terms, contracts, and operating policies for both public and private sectors.

이미 우리는 인공지능과 함께 살아가고 있다. 인공지능을 이용하여 필요한 정보를 수집하는 단계를 넘어서 인공지능은 대화의 상대로 인식되기도 한다. 인공지능에게 죽은 사람의 음성, 메시지, 비디오, 사진 등을 학습시켜 죽은 사람과 유사한 아바타를 형성한 후 마치 죽은 사람의 글이나 목소리로 말하듯이 대화할 수 있도록 하는 AI 챗봇, 일명 데드봇이 상용화되기 시작했다. 데드봇 서비스를 제공하는 회사는 유족이 고인과 대화를 나누며 심리적인 위로를 받을 수 있다는 것을 홍보하며, 일명 “디지털 추모 서비스”를 제공하고 있다. 데드봇 서비스는 유족에게 있어서 죽은 가족과 다시 한 번 만날 수 있는 희망을 실현하는 기술일지도 모른다. 그러나 이러한 데드봇 서비스가 유족의 심리적 치유 효과가 있는지와는 별개로 죽은 사람의 입장에서 발생할 수 있는 헌법적 문제를 고려해야 할 시점이다. 데드봇 서비스는 단순히 죽은 사람과 산 사람이 인공지능이라는 기술을 통하여 만난다는 감성적인 영역의 문제가 아니다. AI기술이 가지고 있는 일반적인 헌법적 문제들이 이 서비스에도 그대로 드러난다. 우리는 살아있는 동안 자신의 동의 없이 개인정보가 특정 목적을 위하여 사용되는 것은 비윤리적이며 불법적인 것으로 이해한다. 그렇다면 데드봇을 만들기 위해 고인의 동의없이 정보를 사용하는 것은 왜 문제삼지 않는가. 단지 죽었기 때문인가? 아니면 죽은 사람은 더 이상 개인정보침해를 인지할 수 없기 때문인가? 헌법상 보장하는 기본권을 ‘향유할 수 있는가’란, 국가 혹은 제3자의 방해 없이 자신의 삶에서 원하는 방향을 설정하고 그 가치에 따라 삶을 살아갈 수 있는 자유를 말하여, 이러한 자유를 기본권으로서 헌법이 보장한다. 자신이 결정한 가치에 따라 삶을 살아간 후 사망 이후에도 여전히 그 가치가 존중되길 원하는 자유는 살아있는 자연인에게만 한정되는 권리가 아니다. 당사자가 자신에게 이로운 생전의 결정은 사망한 이후에도 여전히 유효할 수 있으며, 유족을 포함한 타인으로 하여금 그 결정을 유지하게끔 하는 의무를 부여 할 수만 있어야 한다는 점에서 사자(死者)의 기본권 주체성에 관한 전통적인 헌법논의에서 벗어날 필요가 있다. 데드봇 서비스에서 문제가 되는 사자(死者)의 헌법상 기본권으로는 프라이버시권, 개인정보자기결정권, 잊힐 권리, 인간의 존엄과 인격권이 관련된다. 다만 프라이버시권의 경우 우리 헌법에서는 헌법 제17조의 사생활의 비밀과 자유로 보장하고 있지만, 사자(死者)의 정보활용의 문제를 프라이버시권으로 설정하는 것은 사적인 정보에 한정되기 때문에 보호의 범위가 축소되는 문제가 발생한다. 따라서 개인정보자기결정권에서 정보프라이버시권을 함께 논할 필요가 있다. 개인정보자기결정권에서 말하는 정보처리에 관한 적극적인 결정이라는 것은 정보처리 여부 및 그 방식에 관한 주관적인 선택이자 정보처리에 관한 통제이기도 하다. 통제의 관 점에서 사후에 자신의 개인정보를 수집하고 수집된 개인 데이터를 AI가 학습하여 자신과 같은 인공형 모델을 생성할 수 있다는 상황에 대한 방어적인 통제의 권한, 즉 AI를 통해 상업적으로 이용될 수 있는 상황을 제한할 힘은 분명히 당사자에게 주어져야 한다. 당사 자가 사망한 이후에 스스로 결정을 내리거나 이와 상응하는 어떤 의사를 표명할 수는 없 지만, 이러한 이유만으로 사후 개인정보보호를 부정할 수는 없다. 물론 국가의 사후적 개인정보보호 필요성의 근거를 사후적 인격권 보장이나 사후적 인 간의 존엄성 보장에서 찾는 견해들도 존재한다. 그러나 헌법상 보장되는 개별 기본권 중 특히 인간의 존엄성을 근거로 하지 않는 기본권은 사실상 존재하지 않는다. 개별 기본권 들은 인간의 존엄성과 인격성 보장을 기반으로 하여 특별히 요구되는 보호영역을 설정하 고 있다. 만약 인간의 존엄이나 인격권 보장을 근거로 한다는 이유로 사자(死者)에게는 개 인정보자기결정권이 아니라 사후 인격권 보장이나 인간의 존엄성의 보호대상으로 한정해야 한다면, 왜 살아있는 사람에게는 독자적인 권리로서 개인정보자기결정권을 인정해야 하는지 그 모순을 해결할 수 없을 것이다. 살아있는 동안 개인정보자기결정권의 보호영역에서 보장되었던 권리가 죽음을 통해 갑자기 인격권이나 존엄성의 문제가 되어서는 안된다.
We are already living alongside artificial intelligence. We have moved beyond simply using AI to gather necessary information; AI is now often perceived as a conversation partner. AI chatbots—known as “deadbots”—have begun to hit the market. These chatbots are trained using the deceased person’s voice, messages, videos, and photos etc. to create an avatar that resembles them. Companies offering deadbot services promote the idea that bereaved family members can receive psychological comfort by conversing with the deceased, providing what is known as a “digital memorial service.” For bereaved families, deadbot services may represent a technology that fulfills the hope of meeting a deceased family member once again. However, regardless of whether these services offer psychological healing to the bereaved, it is time to consider the constitutional issues that may arise from the perspective of the deceased. Deadbots are not merely an emotional matter involving the meeting of the living and the dead through AI technology. The general constitutional issues inherent in AI technology are fully evident in this service as well. Using personal Data for specific purposes is unethical and illegal without one’s consent while they are alive. Why is it not considered a problem to use data without the deceased’s consent to create a “deadbots”? Is it simply because they are dead? or Can the deceased no longer perceive a violation of their privacy? The question of whether one “can enjoy” the fundamental rights guaranteed by the Constitution refers to the freedom to set the desired direction of one’s life without interference from the state or other parties and to live according to one’s values; the Constitution guarantees this freedom as a fundamental right. The freedom to live one’s life according to one’s chosen values and to have those values respected even after death is not a right limited solely to living natural persons. Since decisions made during one’s lifetime that are in one’s own interest can remain valid even after death, and since it is necessary to be able to impose an obligation on others- including bereaved family members – to uphold those decisions, we must move beyond the traditional constitutional discourse regarding the subjectivity of fundamental rights in the context of the deceased. The constitutional fundamental rights of the deceased that are at issue in the Deadbots service include the right to privacy, the right to self-determination ragarding personal information, the right to be forgotten, and the right to human dignity and personality. However, while the right to privacy is guaranteed under Article 17 of the Constitution as the secrecy and freedom of private life, framing the issue of using the deceased’s information solely as a matter of the right to privacy limits the scope of protection to private information, thereby narrowing the scope of protection. Therefore, it is necessary to discuss the right to information privacy in conjunction with the right to self-determination regarding personal information. The “active decision regarding information processing” referred to in the right to self-determination regarding personal data involves making a subjective choice about how and whether data is processed, as well as exercising control over such processing. From a control perspective, the authority to exercise defensive control over situations where one’s personal data is collected posthumously and the collected personal data is used by AI to train and generate an artificial model resembling oneself—that is, the power to restrict situations where such data could be commercially exploited through AI—must clearly be granted to the individual concerned. Although an individual cannot make decisions or express corresponding intentions after death, this alone does not justify denying posthumous protection of personal information. Of course, there are viewpoints that find the basis for the necessity of the state’s protection of personal information after death in the guarantee of post- mortem personality rights or the protection of post-mortem human dignity. However, among the individual fundamental rights guaranteed by the Constitution, there are virtually no fundamental rights that are not grounded in human dignity. Individual fundamental rights establish specific areas requiring protection based on the guarantee of human dignity and personality. If, on the grounds that the protection of human dignity or personality rights serves as the basis, the right to self-determination regarding personal information for the deceased must be limited to the protection of posthumous personality rights or human dignity, it would be impossible to resolve the contradiction of why the right to self-determination regarding personal information must be recognized as an independent right for the living. A right that was guaranteed within the scope of the right to self-determination regarding personal information during one’s lifetime should not suddenly become a matter of personality rights or human dignity upon death.

본 연구는 인공지능(AI)에 의한 자동화된 의사결정(automated decision-making, ADM)의 확산에 따라 제기되는 헌법적 문제를 분석하고, 특히 인간의 존엄성과 자기결정권 보장을 위한 ‘인간의 개입권’의 의의와 한계를 규명하는 것을 목적으로 한다. 오늘날 AI 기반 의사결정 시스템은 금융, 고용, 복지 등 다양한 영역에서 효율성과 일관성을 바탕으로 광범위하게 활용되고 있으나, 이러한 시스템은 개인의 삶에 중대한 영향을 미치면서도 불투명한 알고리즘 구조와 데이터 기반 추론에 의해 작동한다는 점에서 기본권 침해의 위험을 내포한다. 인공지능의 의사결정 과정은 데이터 수집·가공, 모델 학습, 추론 및 결과 도출이라는 일련의 단계로 구성되며, 이 과정에서 인간의 개입이 구조적으로 축소되거나 형식화될 수 있다. 특히 AI 시스템은 단순한 자동화 기술을 넘어 자율성과 추론능력을 기반으로 새로운 정보를 생성하는 특징을 가지며, 이는 기존의 인간 중심 의사결정과 질적으로 다른 위험을 발생시킨다. 예컨대 허위 상관관계에 기초한 예측의 문제 및 ‘예측된 프라이버시’의 침해, 집단 속성에 기반한 확률적 평가, 그리고 블랙박스 현상에 따른 설명가능성의 결여는 인간을 수단화하고 자기조정 기회를 박탈함으로써 인간의 존엄성을 위협한다. 이러한 문제의식 하에, 본 연구는 유럽연합 개인정보보호규칙(GDPR) 제22조를 중심으로 자동화된 의사결정에 대한 규율과 인간의 개입권의 법적 근거를 검토하고, 특히 유럽사법재판소의 Schufa 판결을 통해 ‘자동화된 결정’의 범위와 ‘의미 있는 인간의 개입’의 요건을 분석한다. 해당 판결은 형식적 개입이 아닌 실질적 판단능력과 책임을 수반하는 인간의 개입을 요구함으로써, 알고리즘에 대한 비판적 검토와 수정 가능성을 확보하는 방향을 제시한다. 나아가 본 글에서는 EU 인공지능법(AI Act)의 인간 감독(human oversight) 규정과의 비교를 통해, 자동화된 의사결정에 대한 다층적 통제구조를 검토한다. 특히 고위험 AI 시스템에 대해 설계 단계부터 운영 및 사후 통제에 이르기까지 인간의 개입을 제도화한 점은, GDPR 제22조의 개별 권리 중심 접근을 보완하는 중요한 진전으로 평가된다. 결론적으로, 인공지능의 자동화된 의사결정에 대한 인간의 개입은 단순한 기술적 보완수단이 아니라, 인간의 존엄성과 자기결정권을 보장하기 위한 헌법적 요청으로 이해되어야 한다. 따라서 국내 법제에서도 인간의 개입권을 명시적으로 도입하고, 형식적 개입을 넘어 실질적 통제와 책임을 담보할 수 있는 제도적 장치를 마련할 필요가 있다.
This study examines the constitutional implications arising from the increasing use of artificial intelligence (AI)-based automated decision-making (ADM) and aims to clarify the significance and limits of the “right to human intervention” in safeguarding human dignity and the right to self-determination. While AI-driven decision-making systems are widely utilized across various sectors—such as finance, employment, and social welfare—due to their efficiency and consistency, they pose significant risks to fundamental rights, as they operate through opaque algorithmic structures and data-driven inferences that can substantially affect individuals’ lives. First, this study analyzes the decision-making process of AI systems, which consists of data collection and preprocessing, model training, inference, and output generation, and highlights the structural reduction or formalization of human involvement throughout these stages. In particular, AI systems are characterized not merely by automation but by autonomy and inference capabilities, generating new information beyond predefined rules. This feature gives rise to qualitatively different risks compared to traditional human decision-making. Such risks include reliance on spurious correlations, infringements of “predictive privacy,” probabilistic assessments based on group characteristics, and a lack of explainability due to the so-called “black box” effect. These phenomena may reduce individuals to objects of data processing and deprive them of opportunities for self-regulation, thereby threatening human dignity. Against this background, the study reviews the legal framework governing automated decision-making under Article 22 of the General Data Protection Regulation (GDPR), focusing on the legal basis of the right to human intervention. It further analyzes the Court of Justice of the European Union’s Schufa judgment, which provides important interpretative guidance on the scope of “automated decisions” and the requirements for “meaningful human intervention.” The judgment emphasizes that human involvement must be substantive, involving genuine decision-making authority and critical assessment, rather than merely formal or symbolic participation. Furthermore, this study explores the multi-layered regulatory approach to ADM by comparing the GDPR with the human oversight provisions under the EU Artificial Intelligence Act (AI Act). In particular, the AI Act’s requirement of human oversight throughout the lifecycle of high-risk AI systems—from design to operation and ex post control—represents a significant development that complements the individual rights-based approach of the GDPR. In conclusion, human intervention in AI-based automated decision-making should not be understood as a mere technical safeguard but as a constitutional requirement essential to protecting human dignity and the right to self-determination. Accordingly, it is necessary for the domestic legal system to explicitly recognize the right to human intervention and to establish institutional mechanisms that ensure substantive oversight and accountability beyond formalistic involvement.

본 연구는 인공지능(AI) 딥페이크 기술이 게임 광고에 활용되는 현황을 검토하고, 이에 따른 헌법적 쟁점을 분석하는 데 목적을 둔다. 최근 게임 산업은 몰입감과 현실감을 극대화하기 위해 딥페이크 기술을 적극적으로 도입하고 있으며, 이는 광고 효과를 높이는 동시에 허위·과장 표현, 인격권 침해, 소비자 기만 등 다양한 헌법적 문제를 야기한다. 이에 따라 본 논문은 헌법재판소의 광고 사전심의 관련 결정례를 분석하여 상업적 표현의 자유와 소비자 보호 사이의 긴장 관계를 규명하고, 사전검열금지원칙과 광고심의에서의 헌법적 원리가 딥페이크 광고 규제에 어떻게 적용되는지 문제, 초상권과 개인정보자기결정권, 아동·청소년·노인 보호의 원리와 맞물린 헌법상 소비자의 권리 등 AI 딥페이크를 활용한 게임 광고에서 헌법적 쟁점과 그러한 쟁점을 해결하기 위한 실천적 방안에 대해서 논증하였다. 그리고 딥페이크 광고에 대한 현행 규제 체계가 헌법의 원리에 부합하도록 개선 방향을 제시하였다. 알고리즘의 투명성과 설명 가능성을 확보하고, 딥페이크 식별표시 의무화 고려, 온라인 사업자의 책임 강화, 사후적 책임 중심의 규제, 업계의 자율규제와 공적 규제의 병행 등이 그것이다. 본 연구는 AI 딥페이크 기반 게임 광고 규제가 헌법적 가치와 기술 발전 사이의 균형을 모색해야 함을 강조하며, 향후 제도적 정비를 위한 중요한 시사점을 제공한다.
This study aims to examine the current status of Artificial Intelligence (AI) deepfake technology in game advertising and to analyze the resulting constitutional issues. Recently, the game industry has been actively adopting deepfake technology to maximize immersion and realism. While this enhances advertising effectiveness, it simultaneously triggers various constitutional concerns, including false or exaggerated representation, infringement of personality rights, and consumer deception. Accordingly, this paper analyzes the Constitutional Court’s precedents regarding the prior censorship of advertisements to clarify the tension between the freedom of commercial expression and consumer protection. It further demonstrates the constitutional challenges arising from AI deepfake game advertisements—such as the application of the principle of "prohibition of prior censorship" and constitutional doctrines in advertising review, as well as consumers' constitutional rights intertwined with the principles of portrait rights, the right to self-determination of personal information, and the protection of vulnerable groups including children, adolescents, and the elderly. Furthermore, this study proposes directions for improving the current regulatory framework for deepfake advertising to align with constitutional principles. These include ensuring the transparency and explainability of algorithms, mandating deepfake identification labeling, strengthening the liability of online service providers, shifting toward a system centered on ex-post accountability, and implementing a co-regulatory model that combines industry self-regulation with public oversight. This research emphasizes that the regulation of AI deepfake-based game advertising must seek a balance between constitutional values and technological advancement, providing significant implications for future institutional refinement.

본 연구는 유럽연합 의료기기규정(EU MDR)에서의 중대한 변경(significant change) 제도의 법적 구조와 기능을 분석하고, 이를 우리나라 의료기기 변경제도와 비교·검토하여 입법적 시사점을 도출하는 것을 목적으로 한다. EU MDR은 규정(Regulation)으로서 회 원국에 직접 적용되는 법적 효력을 가지며, 적합성 평가 및 인증 유지 여부를 판단하는 핵심 기준으로 ‘중대한 변경’ 개념을 도입하고 있다. 특히 경과조치 하에서 기존 인증의 유효성 유지 여부를 판단하는 기준으로 중대한 변경 개념이 기능함으로써, 규제지위 (regulatory status)의 유지와 새로운 적합성 평가의 필요성을 결정하는 핵심적 역할을 수행한다. 이에 비해 우리나라의 의료기기 변경제도는 허가·인증·신고라는 절차유형에 따라 변경절차가 결정되는 구조를 취하고 있어, 변경의 내용이나 위험 정도와 규제강도 간의 실질적 정합성이 충분히 확보되지 못하는 한계를 가진다. 특히 ‘중대한 변경’에 대한 명확한 법적 정의나 통일된 판단기준이 부재하여, 규제의 예측가능성과 일관성이 저하될 가능성이 존재한다. 이러한 구조는 행정편의적 측면에서는 일정한 장점을 가지나, 의료기기의 안전성과 유효성 확보라는 공익적 목적에 비추어 볼 때 한계를 내포하고 있다. 본 연구는 EU MDR과 MDCG 가이드라인을 중심으로 중대한 변경 판단기준의 체계와 운용방식을 분석하고, 이를 토대로 우리나라 제도의 문제점을 규명하였다. 나아가 중대한 변경 개념의 법정화, 위험기반 규제체계의 강화, 적합성 평가기관의 역할 확대, 사후관리와의 연계 강화 등 구체적인 입법 및 정책 개선방안을 제시하였다. 이러한 개선은 규제의 합리성과 예측가능성을 제고함과 동시에, 국민의 생명·신체 보호라는 헌법적 가치를 실질적으로 구현하는 방향으로 기능할 수 있을 것이다.
This study analyzes the legal structure and functional role of the “significant change” regime under the EU Medical Device Regulation (EU MDR) and derives legislative and policy implications for the Korean medical device regulatory system through a comparative approach. As a regulation with direct applicability across Member States, the EU MDR establishes “significant change” as a pivotal criterion for determining whether existing certifications can be maintained or whether a new conformity assessment is required. In particular, within the transitional framework, the concept of significant change plays a decisive role in maintaining or altering the regulatory status of medical devices. In contrast, the Korean regulatory system operates based on procedural categories —approval, certification, and notification—where the type of regulatory procedure determines the pathway for handling changes. This structure results in a lack of substantive alignment between the nature or risk level of changes and the intensity of regulatory control. Furthermore, the absence of a clear legal definition and unified criteria for determining significant changes undermines regulatory predictability and consistency. While this procedural approach offers certain administrative efficiencies, it raises concerns regarding the effective assurance of safety and performance of medical devices. This study examines the criteria and operational mechanisms of significant change under the EU MDR and relevant MDCG guidance documents, identifying structural limitations within the Korean system. Based on this analysis, it proposes policy and legislative improvements, including the codification of the concept of significant change, the reinforcement of risk-based regulatory frameworks, the expansion of the role of conformity assessment bodies, and the integration of post-market surveillance mechanisms. These reforms are expected to enhance regulatory coherence and predictability while strengthening the protection of public health and safety, which are fundamental constitutional values.

이 글은 인공지능 시대 지역대학이 교육, 연구, 재교육, 창업, 데이터 활용, 지역공공성을 연결하는 공공적 결절점으로 기능할 수 있음을 공법적 관점에서 논증한다. 이를 위해 독일, 프랑스, 핀란드, 네덜란드 사례를 검토하여 대학 중심 혁신생태계의 비교법적 조건을 분석하였다. 독일은 학문자유를 전제로 한 대학 기능 확장의 허용·촉진형 제도화를, 프랑스는 국가주도 연구거점 정책의 장점과 재집중 위험을, 핀란드는 지방정부 공간계획 권한과 대학자율의 기능적 결합을, 네덜란드는 지역의 산학관 협력 구조가 인공지능 활용의 윤리적·법적·사회적 검토 절차와 연결될 수 있음을 보여준다. 이러한 분석을 전제로, 이 글은 지역대학의 확장 임무, 선택형 대학혁신복합구역, ANCHOR 체계의 재정유도에 대한 절차적 통제, 데이터 관리·중개 기능과 독립적 데이터·AI 공공검토 구조, AI 실증에 대한 사전 기본권 영향평가를 핵심 내용으로 하는 특별법적 대응을 제안한다. 결국 인공지능 시대의 지역균형발전은 단순한 대학지원정책이나 산업입지 정책이 아니라, 학문자유, 대학자율, 지방자치, 기본권 보호를 하나의 공법질서 안에서 조정하는 헌법적 제도형성의 과제이다.
This article examines, from a public law perspective, how regional universities can function as public institutional nodes connecting education, research, reskilling, entrepreneurship, data use, and regional publicness in the age of artificial intelligence. It analyzes comparative experiences from Germany, France, Finland, and the Netherlands suggests the possibility of linking regional innovation governance with ethical, legal, and societal review procedures for AI use. Germany illustrates an enabling framework for expanding university functions on the basis of academic freedom; France shows both the advantages and the risks of state-led AI research clusters; Finland demonstrates the functional coordination of municipal spatial planning and university autonomy; and the Netherlands suggests the possibility of linking regional innovation governance with human-centered AI review mechanisms. On this basis, the article proposes a special legislative response that would include the expanded public mission of regional universities, an optional University Innovation Complex Zone, procedural control over the fiscal inducements of the ANCHOR framework, data management and intermediary functions, independent data and AI public review structures, and ex ante fundamental rights impact assessments for AI experimentation. Ultimately, balanced regional development in the AI era should be understood not merely as a matter of university support or industrial location policy, but as a constitutional task of institutional design that coordinates academic freedom, university autonomy, local self-government, and fundamental rights protection within a public law framework.
다원적 대의민주주의 실현의 한계 : 국회 구성과 정당 기속의 문제를 중심으로

본 연구는 대의제 민주주의에서 정당이 수행하는 헌법적 기능과 그 한계를 한국 정치현실을 중심으로 비판적으로 분석하는 것을 목적으로 한다. 대의제 민주주의는 국민주권 원리에 기초하여 국민의 정치적 의사를 대표기관을 통해 실현하는 제도이며, 정당은 이러한 의사형성 과정에서 핵심적인 매개체로 기능한다. 특히 현대 민주주의는 정당을 중심으로 작동하는 ‘정당국가적 민주주의’의 성격을 가지며, 정당은 국민의 다양한 이해를 조직화하고 이를 국가의 정책결정 과정에 반영하는 중요한 역할을 수행한다. 그러나 한국의 정당은 헌법이 예정한 정당의 민주적 기능을 충분히 실현하지 못하고 있다. 특히 원내교섭단체 중심의 의회 운영과 강한 당론 기속은 국회의원의 자유위임 원칙을 형해화시키고, 의원의 독립적 의사결정을 제한하는 구조적 문제를 야기한다. 헌법 제46조가 예정하는 양심에 따른 직무수행은 정당의 정치적 의사에 종속되는 형태로 변질되고 있으며, 이는 의회의 숙의 기능을 약화시키고 국민 전체의 다양한 의사가 반영되는 것을 저해한다. 또한 한국의 양당 중심 정치구조는 의회 내 다원성을 약화시키고, 정당 간 이념적 양극화를 심화시키는 요인으로 작용한다. 그 결과 의회는 사회적 갈등을 조정하는 공론장의 기능을 수행하기보다는 정당 간 대립의 재현 공간으로 전락하고 있으며, 입법 과정 또한 정당 지도부 중심의 결정 구조에 의해 좌우되는 경향을 보인다. 더 나아가 정당 내부의 민주주의 결여, 폐쇄적 공천 구조, 지도부 중심의 의사결정은 정당기속을 더욱 강화시키는 요인으로 작용하며, 이는 헌법 제8조가 요구하는 민주적 정당질서와도 긴장관계를 형성한다. 이는 궁극적으로 다원주의에 입각한 대의제 민주주의 다원성과 대표성 그리고 숙의의 과정을 저해하는 근본적인 원인으로 작동한다. 결국 한국의 대의제 민주주의는 정당을 중심으로 운영되는 현실 속에서 자유위임 원칙과 정당기속 간의 구조적 충돌을 내포하고 있으며, 이는 대표성의 약화, 의회의 심의 기능의 저하, 권력분립 원리의 훼손으로 이어진다. 이에 따라 본 연구는 정당 내부 민주주의의 강화, 의원의 자율성 보장, 교섭단체 중심의회 운영의 개선 등을 통해 대의제 민주주의의 본질적 기능을 회복할 필요성을 제시한다.
This study aims to critically examine the constitutional role of political parties and their limitations within representative democracy, focusing on the contemporary Korean political context. Representative democracy, grounded in the principle of popular sovereignty, operates through institutions that reflect the political will of the people, with political parties functioning as essential intermediaries in this process. In modern democracies, often characterized as “party-based democracies,” political parties play a central role in aggregating diverse social interests and translating them into public policies. However, Korean political parties have not fully realized the democratic function of political parties prescribed by the Constitution. In particular, the dominance of party-centered parliamentary operations and strict party binding has substantially weakened the principle of the free delegation. Although the Constitution requires members of the National Assembly to act according to their conscience, legislative behavior is increasingly constrained by party directives. This phenomenon undermines deliberative processes within the legislature and limits the effective representation of diverse public interests. Furthermore, the predominance of a two-party system has contributed to the erosion of pluralism within the National Assembly and intensified ideological polarization. As a result, the legislature has shifted from a deliberative forum for reconciling competing interests to a space for partisan confrontation. Legislative decision-making is frequently driven by party leadership rather than by individual representatives’ independent judgment. In addition, the lack of intra-party democracy, centralized nomination processes, and leadership-dominated decision-making structures reinforce party control over legislators, thereby raising constitutional concerns regarding the democratic order of political parties. Ultimately, Korean representative democracy embodies a structural tension between the principle of he free delegation and party binding. This tension leads to a decline in representativeness, a weakening of deliberative legislative functions, and potential distortions in the separation of powers. In response, this study suggests the necessity of strengthening intra-party democracy, ensuring legislative autonomy, and reforming party-dominated parliamentary practices to restore the fundamental principles of representative democracy.

이 연구는 2026년 1월 22일 시행된 「인공지능 발전과 신뢰 기반 조성 등에 관한 기본법(이하, 인공지능 기본법)」의 성공적 안착을 위해 현행 시행령이 직면한 한계점을 분석하고, 학계와 산업계의 요구를 반영한 구체적인 입법적 보완 방향을 제시하는 데 목적이 있다. 특히 인공지능 기술이 생성형 AI를 넘어 휴머노이드와 같은 ‘피지컬 AI’로 진화함에 따라 발생하는 법적 책임 소재와 안전성 검증의 공백을 메우기 위한 규범적 대응 체계를 고찰하였다. 또한, 하위 법령을 통한 과잉 규제가 도입되는 것을 방지하고 시행령 차원에서 합리적인 제도적 절차를 도모하고자 하였다. 연구 결과, 현행 시행령안에 대하여 인공지능 산업의 특수성과 EU AI Act, 미 NIST가이드라인 등 글로벌 규범과의 정합성 측면에서 개선이 필요한 다섯 가지 핵심 방안을 도출하였다. 첫째, 특정 주체에 편중된 국가인공지능전략위원회의 구성을 산업계·시민사회·노동계를 포함한 다원적 구조로 전환하는 포용적 거버넌스의 명문화이다. 둘째, 합성콘텐츠의 오남용 방지를 위한 워터마크의 기술적 ‘견고성(Robustness)’ 기준 확립이다. 셋째, 기업의 과도한 규제 부담을 완화하고 기술적 소명 기회를 부여하기 위한 고영향 AI '사전통지 및 보정 절차'의 도입이다. 넷째, 개인정보 영향평가(DPIA) 등 타 법령에 따른 인증을 인정하는 ‘상호인정 체계’ 구축을 통한 중복 규제 해소이다. 다섯째, 공인 표준 준수 시 법적 의무 이행을 간주하는 ‘적합성 추정’ 제도의 신설이다. AI 기본법은 글로벌 기술 패권 경쟁 속에서 대한민국의 AI 신뢰 기반을 조성하는 중추적 법률이다. 이 연구가 제시한 개선안들은 규제의 예측 가능성을 제고하고 행정 효율성을 극대화함으로써, 국민의 기본권 보호와 산업 혁신이 조화를 이루는 선순환 AI 생태계 구축에 기여할 것으로 기대한다. 이와 관련한 연구와 정책이 지속적으로 추진되어야 할 것이다.
This study aims to analyze the limitations of the current Enforcement Decree of the Framework Act on the Development of Artificial Intelligence and the Creation of a Foundation for Trust (AI Framework Act), which was enacted on January 22, 2026. It suggests specific legislative supplements reflecting the demands of academia and industry to ensure the successful implementation of the Act. In particular, this research examines a normative response system to fill the gaps in legal liability and safety verification as AI technology evolves into "Physical AI," such as humanoids. Furthermore, the study focuses on preventing the introduction of excessive regulations through subordinate statutes and promoting reasonable institutional procedures at the level of the Enforcement Decree. Based on an analysis of global norms such as the EU AI Act and U.S. NIST guidelines, the study proposes five core improvement measures. First, it suggests mandating inclusive governance by transitioning the National AI Strategy Committee into a pluralistic structure that incorporates industry, civil society, and labor sectors. Second, it emphasizes establishing technical robustness standards for watermarking to effectively prevent the misuse of synthetic content. Third, the study proposes introducing "Prior Notice and Correction Procedures" for high-impact AI to grant companies opportunities for technical explanation and mitigate excessive regulatory burdens. Fourth, it suggests building a mutual recognition system that accepts certifications from other statutes, such as the Data Protection Impact Assessment (DPIA), to resolve overlapping regulations. Fifth, it recommends establishing a “Presumption of Conformity” system, where compliance with official standards is legally deemed as fulfilling statutory obligations. The AI Framework Act is a pivotal law for establishing a foundation of trust in AI amid global technological competition. The improvement proposals presented in this study are expected to contribute to building a virtuous cycle AI ecosystem where the protection of citizens' fundamental rights and industrial innovation are in harmony, by enhancing regulatory predictability and maximizing administrative efficiency. Research and policies related to this should be continuously pursued.

프랑스에서 예산은 법률의 형식으로 국회의 의결을 거치도록 하고 있어 예산법률주의를 취하고 있다. 그러나 예산법률은 일반 법률과 조금은 다른 입법절차를 거치도록 되어있다. 프랑스에서 법률안 제출권은 국회의원과 수상이 가지고 있으나, 예산법률은 수상이발의할 수 있고 국회의원은 발의할 수 없도록 되어 있다. 또한 수상이 법률안을 발의할때에는 국민의회에 우선적으로 발의하도록 되어 있다. 국민의회에 예산법률안을 발의하도록 하는 것은 국민의회 의원은 국민들의 직접선거로 선출되고 과거의 전통이 그대로 이어져 내려오기 때문이다. 예산법률은 법률이기 때문에 헌법재판소의 사전적 규범통제의 대상이 되고 있다. 따라서 예산법률안에 대해서는 거의 매년 헌법재판소의 사전적 규범통제의 대상이 되고 있다. 또한 2008년 헌법개정으로 2010년 3월부터 사후적 규범통제(QPC)를 도입하였는데, 예산법률이 헌법재판소의 사후적 규범통제의 대상이 되기도 한다. 최근에는 예산법률과 내각불신임을 연결하는 경우가 많이 있다. 프랑스 헌법 제49조 제3항은 수상이 예산법률안을 발의하고 24시간 이내에 내각불신임안이 의결되지 않으면 예산법률안이 의결된 것으로 간주하도록 하고 있는데, 이 조항을 이용하는 경우가 많이 있다. 우리나라 헌법 제57조는 “국회는 정부의 동의 없이 정부가 제출한 지출예산 각항의 금액을 증가하거나 새 비목을 설치할 수 없다”라고 규정하고 있어 예산에 대한 국회의 권한을 제한하고 있다. 프랑스도 우리나라 헌법 제57조와 유사한 조항을 가지고 있다. 프랑스 헌법 제40조는 "의회 의원들이 발의한 법률안과 수정안이 공공 재원의 감소를 초래하거나, 공공 비용의 창출 또는 가중을 초래하는 경우에는 의회에서 수리될 수 없다”고 규정하고 있어 의회의 권한을 제한하고 있다. 1958년 제5공화국에서 만들어진 조항으로 합리화된 의원내각제를 가장 잘 나타내는 조항으로 인식되고 있다. 이는 프랑스에서 과거에 의회가 제 기능을 발휘하지 못한 것을 방영한 결과물이라 할 수 있다. 프랑스 헌법은 예산법률과 더불어 사회보장 재정법률에 대해서도 별도로 규정을 하고 있어 사회복지 예산에 관해서도 헌법에서 중요하게 규정하고 있다는 것도 특징 가운데 하나라고 할 수 있다.
En France, le budget adopte le principe de la loi de finances, ce qui signifie qu'il doit être voté par le Parlement sous la forme d'une loi. Cependant, la loi de finances est soumise à une procédure législative légèrement différente de celle des lois ordinaires. Alors que le droit d'initiative législative appartient à la fois aux membres du Parlement et au Premier ministre, l'initiative de la loi de finances est exclusivement réservée au Premier ministre ; les parlementaires ne peuvent pas la proposer. De plus, lorsque le Premier ministre dépose ce projet de loi, il doit le présenter prioritairement à l'Assemblée nationale. Cette priorité accordée à l'Assemblée nationale s'explique par le fait que ses membres sont élus au suffrage universel direct, tout en perpétuant une longue tradition historique et démocratique. Étant donné que le budget prend la forme d'une loi, il est soumis au contrôle de constitutionnalité a priori par le Conseil constitutionnel. Par conséquent, presque chaque année, la loi de finances fait l'objet d'un examen par le Conseil avant sa promulgation. De plus, suite à la révision constitutionnelle de 2008, la Question Prioritaire de Constitutionnalité (QPC) a été instaurée en mars 2010, permettant ainsi à la loi de finances d'être également soumise à un contrôle de constitutionnalité a posteriori. Récemment, le lien entre la loi de finances et la responsabilité du gouvernement est devenu fréquent. L'article 49, alinéa 3 de la Constitution française permet au Premier ministre d'engager la responsabilité du Gouvernement sur le vote d'un projet de loi de finances. Si aucune motion de censure n'est adoptée dans les 24 heures suivant cet engagement, le projet est considéré comme adopté sans vote formel. Cette disposition est aujourd'hui très souvent utilisée. La France possède une disposition similaire à cet article 57. L'article 40 de la Constitution française stipule que : Les propositions et amendements formulés par les membres du Parlement ne sont pas recevables lorsque leur adoption aurait pour conséquence soit une diminution des ressources publiques, soit la création ou l'aggravation d'une charge publique. Créée sous la Ve République en 1958, cette disposition est considérée comme l'une des meilleures illustrations du parlementarisme rationalisé. Elle reflète la volonté de corriger l'instabilité et l'inefficacité dont le Parlement faisait preuve par le passé. Une autre caractéristique majeure de la Constitution française est qu'elle prévoit des dispositions spécifiques non seulement pour la loi de finances, mais aussi pour les lois de financement de la sécurité sociale. Cela démontre l'importance constitutionnelle accordée au budget de la protection sociale.
대통령 권한 대행에 관한 헌법적 고찰 : 논란이 되는 헌법적 쟁점을 중심으로

대통령 권한 대행은 대통령의 유고로 말미암아 대통령 자신이 대통령 권한을 행사할 수 없을 때 다른 국가기관이 유고된 대통령의 권한을 행사할 수 있도록 하는 것이다. 대통령 권한 대행은 대통령 유고 때문에 생기는 특정한 상황 그 자체나 대통령 권한대행자에게 헌법과 법률이 예정한 기능과 과업 수행을 가리킬 뿐이지, 이로 말미암아 ‘대통령권한 대행’이라는 공직이나 지위가 새롭게 창설되는 것은 아니다. 그리고 대통령 권한대행자는 대통령직을 승계하는 것이 아니다. 따라서 대통령 권한대행자가 대통령 권한을 대행한다고 하여 대통령직을 겸하게 되는 것은 아니다. 대통령 권한을 대행한다는 것은 대통령 권한대행자가 자기 책임 아래 자기 자신의 이름으로 헌법이 대통령에게 부여한 모든 권한을 행사한다는 것을 뜻한다. 그리고 대통령 권한대행자가 한 행위는 대통령이 직접 한 것과 같은 법적 효과가 생긴다. 또한, 사법상 대리처럼 인격적 주체인 개인이나 피대행자를 대리하는 것이 아니라 구체적인 직무를 대행하는 것이라서 대통령 권한대행자의 대행행위에 따른 법적 책임 귀속 주체는 피대행자가 아니라 권한대행자 자신이다. 권한 대행 시에는 대통령 권한대행자에게 대통령이 지시하거나 명령할 수 없고 이것이 법적으로 허용되지도 않는다. 헌법 제71조는 궐위(闕位)와 사고(事故)를 대통령 권한 대행의 사유로 규정한다. 궐위와 사고를 아울러 유고(有故)라고 한다. 유고는 대통령이 권한을 행사할 수 없는 상태를 말한다. 궐위는 대통령이 재직하지 아니한 때를 가리킨다. 즉 궐위는 대통령직을 수행하는 사람이 없는 상태를 뜻한다. 사망, 헌법재판소 탄핵결정에 따른 파면, 대통령 취임 후 선거무효나 당선무효로 말미암은 자격 상실, 사임, 후임자 없는 대통령의 임기 만료 등이궐위에 속한다. 사고는 대통령이 재직하면서도 직무 수행이 불가능한 때이다. 헌법 제71조가 “사고로 인하여 직무를 수행할 수 없을 때”라고 하여 ‘사고’와 ‘직무를 수행할 수 없을 때’를 별개의 요건으로 이해하는 것이 일반적이다. 그러나 거론되는 사고 유형은 모두 직무를 수행할 수 없는 것에 국한되고, 직무를 수행할 수 있는 사고를 검토할 실익이 없다는 점에 비추어 ‘직무를 수행할 수 없는 때’는 사고를 부연하는 것으로 이해하는 것이 타당하다. 사고에 해당하는지는 형식적으로 판단할 것이 아니라 대통령이 그 직을 물리적으로 수행할 수 없거나 그 수행능력이 없어서 국정 공백이 생길 가능성이 있는지를 중심으로 실질적으로 판단하여야 한다.
This study provides a constitutional analysis of the Acting Presidency system. The Acting Presidency is a constitutional mechanism designed to ensure the continuous exercise of presidential powers by another state organ when the President is incapacitated. It is important to note that the Acting Presidency does not create a new public office or status; rather, it refers to the performance of specific functions and tasks mandated by the Constitution and relevant laws. Furthermore, the Acting President does not succeed to the presidency, and thus does not concurrently hold the office of the President. Under this system, the Acting President exercises all constitutional powers in their own name and under their own responsibility. Consequently, the legal effects of such actions are identical to those performed by the President, and the legal liability rests solely with the Acting President. During this period, the President is legally prohibited from directing or commanding the Acting President. Pursuant to Article 71 of the Constitution, the grounds for the Acting Presidency are categorized into vacancy and inability, collectively termed as incapacity. A vacancy occurs when the office is unoccupied due to death, impeachment, resignation, or expiration of term. In contrast, inability refers to situations where the President remains in office but cannot physically or functionally perform their duties. This study argues that the determination of "inability" should be based on a substantive assessment of whether a vacuum in state affairs exists, rather than a mere formalistic judgment.

대한민국의 건국 이후 계속 유지되던 검찰청이 폐지되는 것으로 결정되었고, 그와 더불어 중수청 및 공소청의 설치도 확정되었다. 그러나 검찰청 폐지를 둘러싼 논란은 아직도 계속되고 있다. 한편으로는 검찰청 폐지가 검사의 영장청구권에 관한 헌법 제12조 제3항 및 제16조의 규정과 관련하여 위헌이라는 문제 제기, 헌법 제89조 제16호에서 검찰총장의 임명이 국무회의 심의사항이라고 규정한 것에 비추어 위헌이라는 주장이 있다. 다른 한편으로는 검찰청의 후신으로 도입된 중수청 및 공소청이 제 기능을 하기 어려울 것이라는 비판도 있다. 중수청의 경우 그 수사대상 사건들이 법률전문성을 요구하는 사건들인데, 정작 중수청의 법률전문성 확보가 제대로 되지 않고 있다는 점이 문제된다. 또한 공소청의 경우에는 보완수사권을 인정하지 않음으로 인하여 수사와 기소의 유기적 연결이 어려워졌고, 이는 형사사건에 대한 무죄율의 증가로, 즉 범죄 피해자에 대한 보호의 약화로 이어질 것이라는 우려가 매우 크다. 애초에 이 모든 변화의 시작점이 되었던 ‘수사와 기소의 분리’라는 것이 보편적 원칙으로 인정된다고 보기도 어려울뿐더러 그것이 정말로 국민의 인권보장에 도움이 된다고 단언할 수도 없다. 이미 검찰의 경찰에 대한 수사지휘권을 폐지함과 동시에 검찰의 직접수사권을 6대범죄 로 축소하고, 이를 다시 2대 범죄로 축소하는 과정에서 수사지연, 수사공백, 심지어 수사실종이 문제되는 상황이 많이 발생했다. 이제 그런 일이 더욱 확대될 우려가 매우 크다. 과거 검찰의 권한 오남용이 있었던 점은 부정할 수 없다. 다만, 이를 바로잡는 방법은 해당 국가기관을 정상화하는 것이지 폐지가 답이라고 할 수는 없다. 검찰 개혁의 목표는 국민의 인권보장에 기여하는 것이어야 하는데, 검찰청 폐지 및 중수청, 공소청의 설치는 이에 역행하게 될 가능성이 매우 높은 것이다. 이 글에서는 검찰청 폐지의 배경 및 진행 경과 그 근거로서의 수사-기소의 분리 및 후속 조치로서 중수청 및 공소청의 설치에 대해 전체적으로 개관하면서 예상되는 문제점을 밝히고자 한다. 이를 통해 보다 합리적인 대안의 모색에 기여하고자 하는 것이 이 글의 목적이다.
Es wurde beschlossen, die seit der Gründung der Republik Korea bestehende Staatsanwaltschaft aufzulösen. Gleichzeitig wurde die Einrichtung der Behörde zur Untersuchung schwerer Straftaten und der Anklagebehörde bestätigt. Die Kontroverse um die Auflösung der Staatsanwaltschaft hält jedoch an. Einerseits wird die Auflösung als verfassungswidrig im Hinblick auf Artikel 12 Absatz 3 und Artikel 16 der Verfassung, die das Recht der Staatsanwaltschaft auf die Beantragung von Haftbefehlen regeln, kritisiert. Zudem wird argumentiert, dass sie auch gegen Artikel 89 Absatz 16 der Verfassung verstößt, der die Ernennung des Generalstaatsanwalts der Beratung durch das Kabinett unterstellt. Andererseits wird kritisiert, dass die als Nachfolger der Staatsanwaltschaft eingeführten Behörden zur Untersuchung schwerer Straftaten und Anklagebehörde Schwierigkeiten haben werden, ordnungsgemäß zu funktionieren. Im Fall der Behörde zur Bekämpfung schwerer Straftaten erfordern die von ihr untersuchten Fälle juristische Expertise, doch gelingt es der Behörde nicht, diese Expertise angemessen zu sichern. Darüber hinaus erschwert die Verweigerung des Rechts auf ergänzende Ermittlungen bei der Anklagebehörde die organische Verknüpfung von Ermittlung und Strafverfolgung. Es bestehen ernsthafte Bedenken, dass dies zu einer Erhöhung der Freispruchquote in Strafverfahren führen und somit den Schutz von Verbrechensopfern schwächen wird. Es ist schwierig, die „Trennung von Ermittlung und Strafverfolgung“, die als Ausgangspunkt für all diese Änderungen diente, als universelles Prinzip zu betrachten, noch kann mit Sicherheit behauptet werden, dass sie tatsächlich zum Schutz der Menschenrechte der Bürger beiträgt. Im Zuge der Abschaffung der Ermittlungsbefugnis der Staatsanwaltschaft gegenüber der Polizei, der Reduzierung ihrer direkten Ermittlungsbefugnisse auf sechs und später auf zwei schwere Straftaten kam es zu zahlreichen Fällen von Ermittlungsverzögerungen, -lücken und sogar -unterlassungen. Es besteht nun die große Sorge, dass sich solche Vorfälle weiter verschärfen werden. Es ist unbestreitbar, dass es in der Vergangenheit zu Machtmissbrauch durch die Staatsanwaltschaft gekommen ist. Die Lösung liegt jedoch in der Normalisierung der zuständigen staatlichen Behörde, nicht in der Behauptung, ihre Abschaffung sei die Antwort. Ziel der Reform der Staatsanwaltschaft muss es sein, zum Schutz der Menschenrechte der Bürger beizutragen. Die Abschaffung der Staatsanwaltschaft und die Einrichtung der Behörde für die Untersuchung schwerer Straftaten sowie der Anklagebehörde stehen diesem Ziel jedoch höchstwahrscheinlich entgegen. In diesem Artikel möchte ich einen Überblick über die Hintergründe und den Verlauf der Abschaffung der Staatsanwaltschaft, die ihr zugrunde liegende Trennung von Ermittlung und Strafverfolgung sowie die anschließende Einrichtung der Behörde zur Bekämpfung schwerer Straftaten und der Anklagebehörde geben und dabei die zu erwartenden Probleme aufzeigen. Ziel dieses Artikels ist es, zur Suche nach rationaleren Alternativen beizutragen.

헌법재판 종류의 하나인 권한쟁의심판은 헌법상 국가기관 상호간, 국가기관과 지방자치단체 간 및 지방자치단체상호간에 헌법상 또는 법률상 부여된 권한의 존재 여부 또는 그 범위에 관하여 다툼이 발생한 경우에 헌법재판소가 헌법해석을 통하여 그 분쟁을 해결함으로 국가기능의 원활한 수행을 도모하고 국가권력 간 균형을 유지하여 헌법질서를 수호·유지하고자 하는 제도이다. 헌법재판소법 제62조에 권한쟁의심판의 종류를 규정하고 있다. 권한쟁의심판은 1960년 제2공화국 헌법에서 최초로 규정하였지만, 곧바로 제2공화국 이 무너지면서 헌법재판소가 설치되지 못하여 시행되지 못하였는데, 1987년 헌법개정에서 헌법재판소를 두었고, 1989년 9월 1일에 헌법재판소의 개원으로 시행되어 오늘에 이르고 있다. 헌법재판소는 권한쟁의심판을 통하여 국가질서의 중요한 문제들과 그동안 정 치문제라는 이유로 해결되지 못하던 국가기관 상호간의 헌법적 쟁점들의 해결을 통하여 국가기능의 효율화와 헌법국가의 실현을 이루어 가고 있다. 권한쟁의심판의 종류는 첫째, 동일한 법주체 안에서의 기관간 권한쟁의에 해당하는 국가기관 상호간의 권한쟁의심판, 둘째, 상이한 법주체인 국가기관과 지방자치단체간의 권한쟁의심판, 셋째, 지방자치단체 상호간의 권한쟁의심판 3가지이다. 본 연구에서는 권한쟁의심판의 당사로서의 국가기관과 지방자치단체에 대하여 상술하였다. 권한쟁의심판은 국가기능의 수행을 원활히 하는 것을 목적으로 한다는 점에서 객관적 소송으로서의 성격을 가지는 것으로서, 기관소송과의 관계, 지방자치법상 소송과의 관계에 있어서 구별된다. 권한쟁의심판은 가처분제도와 필수적인 관계에 있는데, 헌법재판소법 제65조에는 “헌법재판소가 권한쟁의심판의 청구를 받았을 때에는 직권 또는 청구인의 신청에 의하여 종국결정의 선고 시까지 심판대상이 된 피청구인의 처분의 효력을 정지하는 결정을 할 수 있다”라고 하여 가처분제도를 규정하고 있다. 본 연구에서는 권한쟁의심판절차에서 가처분의 기능과 내용에 대하여 기술하였다. 권한쟁의심판을 통하여 권한에 대한 추상적 또는 미확정으로 인한 국가기관 간의 다툼을 해결함으로써 국가기능의 신속성과 책임성을 확보하게 하여, 헌법질서의 수호· 유지는 물론 궁극적으로 국민의 복리증진을 이루게 한다. 본 연구에서는 권한쟁의심판의 명료화를 위하여 당사자와 다른 소송과의 관계에 대하여 다루었다.
A competence dispute adjudication is one type of constitutional adjudication. It refers to a system in which the Constitutional Court resolves disputes through constitutional interpretation when conflicts arise regarding the existence or scope of powers granted by the Constitution or laws among state institutions, between state institutions and local governments, or among local governments themselves. Its purpose is to ensure the smooth functioning of state affairs, maintain a balance of powers among state authorities, and ultimately safeguard and preserve the constitutional order. Article 62 of the Constitutional Court Act stipulates the types of competence disputes. Although competence dispute adjudication was first introduced in the Constitution of the Second Republic in 1960, it was not implemented due to the collapse of that republic and the absence of a Constitutional Court. It was later revived through the 1987 constitutional amendment, which established the Constitutional Court, and came into effect with the Court’s inauguration on September 1, 1989. Since then, the Constitutional Court has resolved important issues of national order and constitutional disputes between state institutions—many of which had previously remained unresolved as “political questions”—thereby contributing to the efficiency of state functions and the realization of a constitutional state. There are three types of competence disputes: Disputes between state institutions within the same legal entity, Disputes between state institutions and local governments, and Disputes among local governments. This study examines in detail state institutions and local governments as parties to competence disputes. Competence dispute adjudication has the character of an objective litigation, as its primary purpose is to facilitate the proper functioning of the state. In this respect, it is distinguished from institutional litigation and litigation under the Local Autonomy Act. It is also closely related to the system of provisional measures. Article 65 of the Constitutional Court Act provides that when a competence dispute is filed, the Constitutional Court may, either ex officio or upon request by a party, suspend the effect of the respondent’s action that is the subject of the dispute until the final decision is rendered. This study further discusses the function and content of provisional measures in competence dispute proceedings. Through competence dispute adjudication, conflicts among state institutions arising from abstract or indeterminate authority are resolved, thereby ensuring the promptness and accountability of state functions. This contributes not only to the protection and maintenance of the constitutional order but also, ultimately, to the promotion of public welfare. For the purpose of clarifying competence disputes, this study examines the parties involved and their relationship with other forms of litigation.
좋은 입법 결정 요인에 관한 델파이 실증연구 : 입법 실무 전문가들의 암묵지와 현장 인식을 중심으로

본 연구는 입법 실무 전문가들이 인식하는 ‘좋은 입법’의 판단 준거, 실무상 제약 요인, 실제 법안 처리의 동인, 의견수렴 절차의 실효성을 종합적으로 분석하는 것을 목적으로 한다. 이를 위해 국회사무처, 국회입법조사처, 한국법제연구원, 대학 등에서 5년 이상의 전문 경력을 보유한 입법 실무 전문가 15명을 대상으로 3회에 걸친 델파이 조사를 실시하였다. 조사 결과, 전문가들은 좋은 입법의 판단 기준으로 헌법적 원칙 준수와 법체계정합성을 최우선에 두었으나, 실제 법안 가결에는 무쟁점성, 정치적 합의, 여론, 부처 간조정과 같은 현실적 요인이 강하게 작동하는 것으로 인식하였다. 정합성 검토의 주된 제약 요인으로는 만성적 시간 부족과 인력의 한계가 확인되었으며, 이로 인해 사회과학적증거 활용보다 법령 체계 내부의 정합성 검토에 의존하게 되는 경향이 드러났다. 의견수렴 절차와 관련해서는 정부부처 및 이해관계자 의견 조회·회신만이 실효성 있는 절차로 평가되었고, 입법예고·공청회·온라인 플랫폼 등 대중적 참여 기제의 실효성은 낮게 평가되었다. 개선 방안으로는 이해관계자 간 의견 조율·중재 기능 강화와 사회적 파급력이 큰 법안에 대한 의견수렴 의무화가 채택되었다. 본 연구는 규범적 입법 기준과 현실 입법 동인 사이의 비대칭성이 실무 전문가들의 인식 속에서 구체적으로 확인됨을 실증하고, 증거기반 입법의 구현을 위한 입법지원 인프라의 구조적 보완 필요성을 제시한다는 점에서 의의를 갖는다.
This study aims to comprehensively analyze legislative practitioners’ perceptions of the criteria for “better legislation,” practical constraints in the legislative process, the actual determinants of bill passage, and the effectiveness of public consultation procedures. A three-round Delphi survey was conducted with 15 legislative practitioners with more than five years of professional experience in institutions including the National Assembly Secretariat, the National Assembly Research Service, the Korea Legislation Research Institute, and academia. The findings reveal that practitioners prioritized constitutional compliance and legal coherence as the primary criteria for better legislation; however, they recognized that non-contentious character, political consensus, public opinion, and inter-ministerial coordination are the dominant factors in actual bill passage. Chronic time shortage and insufficient staffing were identified as the key structural constraints on coherence review, leading practitioners to rely on internal legal consistency checks rather than social scientific evidence. Among public consultation mechanisms, only the formal solicitation of opinions from government ministries and relevant stakeholders was assessed as effective, while public notice, public hearings, and online participation platforms were regarded as largely ineffective. Strengthening stakeholder mediation functions and mandating consultation for high-impact bills were identified as the most viable reform measures. This study makes an empirical contribution by demonstrating that the asymmetry between normative legislative ideals and the actual dynamics of the legislative process is concretely reflected in expert practitioners’ perceptions, and by highlighting the need for structural improvements to legislative support infrastructure to realize evidence-based legislation.

본 연구는 디지털 행정전환이 심화되는 현대 행정환경에서 지방정부의 기본권 보호의무가 갖는 헌법적 의미와 그 실현 방안을 분석하는 것을 목적으로 한다. 정보통신기술의 발전과 인공지능, 빅데이터의 활용 확대는 행정의 효율성과 합리성을 제고하는 한편, 개인정보 침해, 알고리즘 편향, 절차적 권리 약화 등 새로운 기본권 침해 위험을 구조적으로 내포하고 있다. 특히 지방정부는 주민 생활과 밀접하게 연결된 행정 주체로서 디지털행정서비스의 최일선에서 이러한 위험에 대응해야 할 책임을 부담한다. 헌법상 기본권 보호의무는 국가 전반에 부과되는 의무로서 지방정부에도 동일하게 적용되며, 지방정부는 단순한 행정 집행기관을 넘어 주민의 기본권을 실질적으로 보장하는 적극적 주체로 기능해야 한다. 이에 따라 디지털 행정환경에서 지방정부는 개인정보 자기결정권, 평등권, 절차적 참여권, 정보접근권 등 다양한 기본권을 보호하기 위한 제도적·정책적 대응을 마련할 필요가 있다. 본 연구는 디지털 행정에서 발생할 수 있는 기본권 침해 유형으로 개인정보 보호 문제, 알고리즘 행정의 불투명성과 차별 위험, 디지털 격차로 인한 취약계층 배제 문제를 분석하였다. 이를 바탕으로 지방정부의 기본권 보호 체계 정립을 위한 방안으로 권리영향평가 제도의 도입, 알고리즘 설명가능성 및 이의제기 절차 등 절차적 통제 장치의 확립, 지방정부 간 역량 격차 해소, 디지털 포용 행정 구축의 필요성을 제시하였다. 결론적으로 디지털 행정전환은 단순한 기술적 변화가 아니라 공권력 행사 방식의 구조적 전환이며, 이에 따라 지방정부는 헌법상 기본권 보호의무를 적극적으로 이행하는 방향으로 행정체계를 재구성해야 한다. 이를 통해 디지털 행정은 효율성 제고를 넘어 주민의 권리를 실질적으로 보장하는 헌법친화적 행정으로 발전할 수 있을 것이다.
This study aims to examine the constitutional significance of the obligation to protect fundamental rights of local governments in the era of digital administrative transformation and to propose measures for its effective implementation. The advancement of information and communication technologies, including artificial intelligence and big data, enhances administrative efficiency and rationality, while simultaneously posing structural risks to fundamental rights, such as violations of personal data protection, algorithmic bias, and the weakening of procedural rights. In particular, local governments, as frontline administrative actors closely connected to residents’ daily lives, bear primary responsibility for addressing these risks within digital administrative services. The constitutional duty to protect fundamental rights is imposed on all state authorities, including local governments. Therefore, local governments should function not merely as administrative executors but as active guarantors of residents’ fundamental rights. In the context of digital administration, they are required to establish institutional and policy frameworks to ensure the protection of various rights, including the right to informational self-determination, equality, procedural participation, and access to information. This study identifies key risks of fundamental rights violations in digital administration, including issues related to personal data protection, the opacity and potential discrimination of algorithm-based decision-making, and the exclusion of vulnerable groups caused by the digital divide. Based on this analysis, it proposes several measures for strengthening the protection framework at the local level: the introduction of a rights impact assessment system, the establishment of procedural safeguards such as algorithmic transparency and objection mechanisms, the reduction of capacity gaps among local governments, and the promotion of inclusive digital governance. In conclusion, digital administrative transformation represents not merely a technological change but a structural shift in the exercise of public authority. Accordingly, local governments must reorganize their administrative systems to actively fulfill their constitutional obligation to protect fundamental rights. Through such efforts, digital administration can evolve into a rights-oriented governance model that ensures not only efficiency but also the substantive protection of citizens’ rights.
행정조사제도의 합리화를 위한 법제도 개선 방안 : 지능형 행정조사 관리시스템 도입을 중심으로

국무조정실은 전 부처를 대상으로 한 2025년 행정조사 전수조사 결과 35개 부처에서 총 1,405건의 행정조사가 운용되고 있음을 확인하고, 13개 부처에 대하여 29개의 행정조사에 대한 개선안을 제안할 계획임을 밝혔다. 국무조정실의 조사 결과에 따르면 행정조사가 규제집행과 정책수단으로 광범위하게 활용되고 있음에도 불구하고, 2012년경부터 제기되어 온 수시·중복조사, 행정조사 목적에 비례하지 않는 조사방법 선택의 광범위한 재량 문제는 여전히 해결되지 못한 것으로 파악되며, 국무조정실은 「행정조사기본법」 및 개별 법령의 개정과 함께 새로운 지능형 행정조사 관리시스템의 도입을 추진하고 있다. 이에 본 고는 국무조정실의 행정조사제도 합리화 정책 추진 연혁을 기초로, 2026년도를 기준으로 필요한 법제도 개선안을 제시하는 것을 목적으로 하였다. 이를 위하여 2025년도 행정조사 전수조사 결과, 연혁적 조사연구 결과, 대국민·대기업 조사 결과를 분석하여 행정조사 방법의 단계적 적용, 「행정조사기본법」상 수시조사 요건 강화, 중복조사 제한 강화, 행정조사 도입 시 사전심사 제도 도입을 입법 개선안으로 제안하였다. 나아가 이러한 입법 개선안을 실효적으로 구현하기 위한 방안으로, 행정효율성과 규제부담 완화를 동시에 도모할 수 있는 지능형 범부처 통합 행정조사 관리시스템의 도입 필요성과 설계 방향을 비교법적으로 검토하였다. 구체적으로 미국의 문서업무 감축법 체계, EU와 노르웨이의 한 번만 제출 원칙 및 전자적 통합서비스, 에스토니아의 분산형 연계 서비스를 분석하여 지능형 행정조사 관리시스템의 절차적 정당성과 운영의 실효성을 확보하기 위한 설계 원리와 입법 개선 방향을 도출하였다. 지능형 행정조사 관리시스템의 도입 방향은 행정조사의 단순한 전산화 수단으로서가 아닌, 행정조사의 필요성, 중복 여부, 조사방법의 비례성 및 절차적 정당성을 사전에 점검하고 사후적으로 통제하는 법제도적 인프라로 설계되어야 하며, 과도한 정보집중 및 상시감시 체계로의 변질을 방지하기 위하여 목적 외 이용의 제한, 접근권한 관리, 정보주체의 조회이력 확인, 보유·파기 기준 마련 등 공법적 안전장치를 함께 갖추어야 한다. 이를 통해 지능형 행정조사 관리시스템은 행정조사권 행사를 보다 정당하고 예측가능한 방식으로 통제하고, 행정조사의 합리화와 국민권익 보호를 동시에 실현하는 기반으로 기능할 수 있을 것이다.
In 2025, the Office for Government Policy Coordination conducted a comprehensive review of administrative investigations across all government ministries and confirmed that a total of 1,405 administrative investigations spanning 35 ministries were in operation. It also announced plans to propose improvement measures for 29 administrative investigations across 13 ministries. According to the review, although administrative investigations are widely used as instruments of regulatory enforcement and policy implementation, long-standing problems raised since around 2012 remain unresolved, including ad hoc and duplicative investigations and the broad discretion to select investigative methods that are disproportionate to the purposes of the investigation. In response, the Office for Government Policy Coordination is pursuing amendments to the Framework Act on Administrative Investigations and individual statutes, together with the introduction of a new Intelligent Administrative Investigation Management System. This study aims to propose legal and institutional reforms necessary to support the government’s policy for rationalizing the administrative investigation system. To this end, it analyzes the results of the 2025 comprehensive review of administrative investigations, historical research on administrative investigation reform, and survey results from the public and large corporations. Based on this analysis, the study proposes legislative improvements, including the staged application of investigative methods, stricter requirements for ad hoc investigations under the Framework Act on Administrative Investigations, stronger restrictions on duplicative investigations, and the introduction of a prior review mechanism for newly established administrative investigations. Furthermore, as a means of effectively implementing these legislative reforms, this study comparatively examines the necessity and design direction of an intelligent interministerial administrative investigation management system that can promote administrative efficiency while reducing regulatory burdens. Specifically, it analyzes the U.S. Paperwork Reduction Act framework, the once-only principle and integrated digital services in the EU and Norway, and Estonia’s decentralized informationsharing architecture. Through this comparative analysis, the study derives design principles and legislative reform directions for ensuring the procedural legitimacy and operational effectiveness of an Intelligent Administrative Investigation Management System. Such a system should not be designed as a mere digitalization tool for administrative investigations. Rather, it should function as legal and institutional infrastructure that enables the necessity of an investigation, the existence of duplication, the proportionality of investigative methods, and procedural legitimacy to be reviewed in advance and controlled ex post. In addition, to prevent the use of investigation information beyond its original purpose, excessive concentration of information, and transformation into a system of constant surveillance, the system should incorporate public-law safeguards such as restrictions on use for purposes other than the original purpose, access control, retention of processing records, the right of data subjects to verify access logs, and clear standards for data retention and deletion. Through these safeguards, the Intelligent Administrative Investigation Management System can function as a foundation for controlling the exercise of administrative investigation powers in a more legitimate and predictable manner, while simultaneously achieving the rationalization of administrative investigations and the protection of citizens’ rights and interests.

「행정기본법」은 제20조에서 자동적 처분을 규정하고 있으나,「행정절차법」은 이에 대해 침묵하고 있다. 현실의 행정처분은 행정청의 재량을 수반한다고 할 수 있고, 프랑스에서는 독일과는 달리 재량행위에 대한 알고리즘의 적용 및 인공지능의 활용 가능성을 원 칙적으로 부인하지 않는다. 인공지능 기술의 발전 속도에 비추어 「행정기본법」에서만 외로이 등댓불을 비추는 상황을 더 이상 간과하기는 어렵다고 본다. 이제는「행정절차법」도 인공지능에 기반한 완전히 자동화된 처분에 관한 입법적 변화를 수용할 시점이 되었고, 우리와 같이 기속행위에 국한하는 명문 규정을 두지 않은 프랑스 사례의 검토도 유의미하다. 자동적 처분은 알고리즘에 의한 처분의 자동화로 볼 수 있으며, 이에 대한 통제는 개인정보의 보호와 행정의 투명성 확보의 과제를 안고 있다. 완전히 자동화된 알고리즘에 기반한 이른바 자동적 처분의 개념이나 이에 대한 시민들의 권리구제 법제는 프랑스에서도 진행 중이다. 시스템의 완전한 자동화의 의미는 사람의 개입이 배제된 기계장치나 프로그램에 따른 행위 결정이라는 것이고, 이러한 진행 과정이 알고리즘의 자동화를 통해 달성된다. 알고리즘에 의한 행정결정, 특히 인공지능에 의한 알고리즘 형성에 있어 설명 가능성과 해석가능성에 대한 과제를 행정절차의 관점에서 개정 법률에 고려해야 할 운영 원칙을 프랑스 입법례를 중심으로 검토하였다. 의사결정 알고리즘과 관련한 행정법원의 사법적 통제와 관련해 대입 전형에 관한 공공 플랫폼인 ‘파쿠흐슆(Parcoursup)’의 알고리즘 투명성에 과한 ‘UNEF’ 판결과 진행 중인 ‘가족수당기금(CNAF)’ 소송을 검토하였다. 이들 사안이 직접적인 인공지능을 활용한 자동적 처분의 법적 통제에 관한 국사원의 결론이라고 단정하지는 못하지만, 알고리즘의 사법심사를 인정하고 GDPR 제22조가 반영된 프랑스 개인정보보호법 제47조의 범위를 밝혔다는 점은 우리에게도 시의성을 제공한다. 프랑스에서 자동적 처분은 사람이 아니라 알고리즘에 의한 자동화된 행정 결정을 말하 고, 이러한 알고리즘 처리 시스템에 우리 행정절차법의 목적이기도 한 투명성의 보장과 이에 대한 사법적 통제가 중심 과제임을 알 수 있다. 이는 향후 예상되는 행정절차법의 개정에 의미 있는 가이드를 제공할 것으로 본다.
Article 20 of the Korean “Administrative framework Act” stipulates automated Chobun, but the “Administrative Procedures Act” is silent about this. It can be said that most of actual administrative Chobun, inolve the discretion of administrative agencies. France, unlike Germany, does not in principle deny the possibility of applying algorithms and using artificial intelligence for discretionary administrative acts. We think, it’s time for the “Administrative Procedures Act” to also accept legislative changes regarding fully automated Chobun, based on artificial intelligence, and a review of french case, which, like us, does not have express provisions limiting it to bound acts, is also meaningful. Automated Chobun, can be seen as the automation of Chobun by algorithms, and its control holds the tasks of protecting personal information and securing transparency of administration. The concept of so-called automated Chobun based on fully automated algorithms and the legal system for citizens' rights remedies are also in progress in France. The meaning of complete automation of the system is the determination of action according to mechanical devices or programs where human intervention is excluded. This process is achieved through the automation of algorithms. Operating principles to be considered in the revised law from the perspective of administrative procedures were reviewed, focusing on french legislative cases, regarding the tasks of explainability and interpretability in administrative decisions by algorithms, especially in the formation of algorithms by artificial intelligence. Regarding judicial control by administrative courts related to decision-making algorithms, we examined ‘UNEF’ caseon the algorithmic transparency of ‘Parcoursup’ -a public platform for university admissions- and the ongoing ‘National Family Allowance Fund (CNAF)’ lawsuit. Although it cannot be asserted that these cases are precedents of the Conseil d'État (Council of State) regarding the judicial control of automated Chobun, using direct artificial intelligence, the fact that they recognized judicial review of algorithms and revealed the scope of Article 47 of the french “Data Protection Act”, which reflects article 22 of the GDPR, provides timeliness to us. In France, automated administrative acts refer to decisions made by algorithms rather than humans. Ensuring transparency—a essential objective of korean Administrative Procedure Act—and maintaining judicial control over these systems are central challenges. We believe this provides a meaningful guide for the anticipated future amendments to the Administrative Procedure Act.
