This paper examines the normative implications of ‘economic democratization’ under the Korean Constitution and explores the role of the state in protecting the economic lives of citizens alienated within the capitalist system. It analyzes the historical evolution of economic democracy from Article 5 of the 1948 Constitution to Article 119, Paragraph 2 of the current Constitution, and demonstrates the constitutional legitimacy of the state’s power to regulate and coordinate for the establishment of a democratic economic community through harmony among economic agents. In particular, the study emphasizes that economic democratization must aim beyond mere state regulation toward the ultimate goal of building a “humane economic society.” This is achievable only when citizens, as masters of the national economy, steer the direction of the national economy through the economic constitution to realize a “democratic economic community.” In conclusion, just as the state exists for the people, the economy must also exist for humanity. The economic democratization mandated by the Constitution signifies a directive to build a democratic national economy where citizens are the rightful owners and a life of human dignity is substantially guaranteed.

이 논문은 우리 헌법상 ‘경제 민주화’의 규범적 함의를 고찰하며, 자본주의 체제 내에서 소외된 국민의 경제적 삶을 보호하기 위한 국가의 역할을 탐구하였다. 1948년 제헌헌법 제5조부터 현행 헌법 제119조 제2항에 이르기까지 경제적 민주주의의 역사적 변천을 분석하고, 헌법 전문의 내용을 토대로 하여 경제주체 간의 조화를 통한 민주적 경제공동체 형성의 정당성을 논증하였다. 특히 헌법상 ‘경제 민주화’는 국가의 경제 규제와 조정을 통해 실현되지만, 단순한 국가의 규제와 조정을 넘어서 궁극적으로 ‘인간적인 경제 사회’의 구축을 목적으로 해야 함을 강조하였다. 이는 우리 국민이 국민경제의 주인으로서 경제헌법을 토대로 국민경제의 방향을 스스로 결정하는 ‘민주적 경제공동체’를 지향할 때 실현 가능하다. 결론적으로 경제는 사람을 위해 존재해야 하며, 헌법이 지향하는 경제 민주화는 국민의 인간다운 삶이 실질적으로 보장되는 민주적 국민경제를 구축하라는 시대적 명령임을 제시하였다.
