This study analyzes the legal structure and functional role of the “significant change” regime under the EU Medical Device Regulation (EU MDR) and derives legislative and policy implications for the Korean medical device regulatory system through a comparative approach. As a regulation with direct applicability across Member States, the EU MDR establishes “significant change” as a pivotal criterion for determining whether existing certifications can be maintained or whether a new conformity assessment is required. In particular, within the transitional framework, the concept of significant change plays a decisive role in maintaining or altering the regulatory status of medical devices. In contrast, the Korean regulatory system operates based on procedural categories —approval, certification, and notification—where the type of regulatory procedure determines the pathway for handling changes. This structure results in a lack of substantive alignment between the nature or risk level of changes and the intensity of regulatory control. Furthermore, the absence of a clear legal definition and unified criteria for determining significant changes undermines regulatory predictability and consistency. While this procedural approach offers certain administrative efficiencies, it raises concerns regarding the effective assurance of safety and performance of medical devices. This study examines the criteria and operational mechanisms of significant change under the EU MDR and relevant MDCG guidance documents, identifying structural limitations within the Korean system. Based on this analysis, it proposes policy and legislative improvements, including the codification of the concept of significant change, the reinforcement of risk-based regulatory frameworks, the expansion of the role of conformity assessment bodies, and the integration of post-market surveillance mechanisms. These reforms are expected to enhance regulatory coherence and predictability while strengthening the protection of public health and safety, which are fundamental constitutional values.

본 연구는 유럽연합 의료기기규정(EU MDR)에서의 중대한 변경(significant change) 제도의 법적 구조와 기능을 분석하고, 이를 우리나라 의료기기 변경제도와 비교·검토하여 입법적 시사점을 도출하는 것을 목적으로 한다. EU MDR은 규정(Regulation)으로서 회 원국에 직접 적용되는 법적 효력을 가지며, 적합성 평가 및 인증 유지 여부를 판단하는 핵심 기준으로 ‘중대한 변경’ 개념을 도입하고 있다. 특히 경과조치 하에서 기존 인증의 유효성 유지 여부를 판단하는 기준으로 중대한 변경 개념이 기능함으로써, 규제지위 (regulatory status)의 유지와 새로운 적합성 평가의 필요성을 결정하는 핵심적 역할을 수행한다. 이에 비해 우리나라의 의료기기 변경제도는 허가·인증·신고라는 절차유형에 따라 변경절차가 결정되는 구조를 취하고 있어, 변경의 내용이나 위험 정도와 규제강도 간의 실질적 정합성이 충분히 확보되지 못하는 한계를 가진다. 특히 ‘중대한 변경’에 대한 명확한 법적 정의나 통일된 판단기준이 부재하여, 규제의 예측가능성과 일관성이 저하될 가능성이 존재한다. 이러한 구조는 행정편의적 측면에서는 일정한 장점을 가지나, 의료기기의 안전성과 유효성 확보라는 공익적 목적에 비추어 볼 때 한계를 내포하고 있다. 본 연구는 EU MDR과 MDCG 가이드라인을 중심으로 중대한 변경 판단기준의 체계와 운용방식을 분석하고, 이를 토대로 우리나라 제도의 문제점을 규명하였다. 나아가 중대한 변경 개념의 법정화, 위험기반 규제체계의 강화, 적합성 평가기관의 역할 확대, 사후관리와의 연계 강화 등 구체적인 입법 및 정책 개선방안을 제시하였다. 이러한 개선은 규제의 합리성과 예측가능성을 제고함과 동시에, 국민의 생명·신체 보호라는 헌법적 가치를 실질적으로 구현하는 방향으로 기능할 수 있을 것이다.
