좋은 입법 결정 요인에 관한 델파이 실증연구 : 입법 실무 전문가들의 암묵지와 현장 인식을 중심으로
A Delphi Study on the Determinants of Better Legislation : Focusing on the Tacit Knowledge and Field Perceptions of Legislative Practitioners
This study aims to comprehensively analyze legislative practitioners’ perceptions of the criteria for “better legislation,” practical constraints in the legislative process, the actual determinants of bill passage, and the effectiveness of public consultation procedures. A three-round Delphi survey was conducted with 15 legislative practitioners with more than five years of professional experience in institutions including the National Assembly Secretariat, the National Assembly Research Service, the Korea Legislation Research Institute, and academia. The findings reveal that practitioners prioritized constitutional compliance and legal coherence as the primary criteria for better legislation; however, they recognized that non-contentious character, political consensus, public opinion, and inter-ministerial coordination are the dominant factors in actual bill passage. Chronic time shortage and insufficient staffing were identified as the key structural constraints on coherence review, leading practitioners to rely on internal legal consistency checks rather than social scientific evidence. Among public consultation mechanisms, only the formal solicitation of opinions from government ministries and relevant stakeholders was assessed as effective, while public notice, public hearings, and online participation platforms were regarded as largely ineffective. Strengthening stakeholder mediation functions and mandating consultation for high-impact bills were identified as the most viable reform measures. This study makes an empirical contribution by demonstrating that the asymmetry between normative legislative ideals and the actual dynamics of the legislative process is concretely reflected in expert practitioners’ perceptions, and by highlighting the need for structural improvements to legislative support infrastructure to realize evidence-based legislation.

본 연구는 입법 실무 전문가들이 인식하는 ‘좋은 입법’의 판단 준거, 실무상 제약 요인, 실제 법안 처리의 동인, 의견수렴 절차의 실효성을 종합적으로 분석하는 것을 목적으로 한다. 이를 위해 국회사무처, 국회입법조사처, 한국법제연구원, 대학 등에서 5년 이상의 전문 경력을 보유한 입법 실무 전문가 15명을 대상으로 3회에 걸친 델파이 조사를 실시하였다. 조사 결과, 전문가들은 좋은 입법의 판단 기준으로 헌법적 원칙 준수와 법체계정합성을 최우선에 두었으나, 실제 법안 가결에는 무쟁점성, 정치적 합의, 여론, 부처 간조정과 같은 현실적 요인이 강하게 작동하는 것으로 인식하였다. 정합성 검토의 주된 제약 요인으로는 만성적 시간 부족과 인력의 한계가 확인되었으며, 이로 인해 사회과학적증거 활용보다 법령 체계 내부의 정합성 검토에 의존하게 되는 경향이 드러났다. 의견수렴 절차와 관련해서는 정부부처 및 이해관계자 의견 조회·회신만이 실효성 있는 절차로 평가되었고, 입법예고·공청회·온라인 플랫폼 등 대중적 참여 기제의 실효성은 낮게 평가되었다. 개선 방안으로는 이해관계자 간 의견 조율·중재 기능 강화와 사회적 파급력이 큰 법안에 대한 의견수렴 의무화가 채택되었다. 본 연구는 규범적 입법 기준과 현실 입법 동인 사이의 비대칭성이 실무 전문가들의 인식 속에서 구체적으로 확인됨을 실증하고, 증거기반 입법의 구현을 위한 입법지원 인프라의 구조적 보완 필요성을 제시한다는 점에서 의의를 갖는다.
