This study aims to examine the constitutional significance of the obligation to protect fundamental rights of local governments in the era of digital administrative transformation and to propose measures for its effective implementation. The advancement of information and communication technologies, including artificial intelligence and big data, enhances administrative efficiency and rationality, while simultaneously posing structural risks to fundamental rights, such as violations of personal data protection, algorithmic bias, and the weakening of procedural rights. In particular, local governments, as frontline administrative actors closely connected to residents’ daily lives, bear primary responsibility for addressing these risks within digital administrative services. The constitutional duty to protect fundamental rights is imposed on all state authorities, including local governments. Therefore, local governments should function not merely as administrative executors but as active guarantors of residents’ fundamental rights. In the context of digital administration, they are required to establish institutional and policy frameworks to ensure the protection of various rights, including the right to informational self-determination, equality, procedural participation, and access to information. This study identifies key risks of fundamental rights violations in digital administration, including issues related to personal data protection, the opacity and potential discrimination of algorithm-based decision-making, and the exclusion of vulnerable groups caused by the digital divide. Based on this analysis, it proposes several measures for strengthening the protection framework at the local level: the introduction of a rights impact assessment system, the establishment of procedural safeguards such as algorithmic transparency and objection mechanisms, the reduction of capacity gaps among local governments, and the promotion of inclusive digital governance. In conclusion, digital administrative transformation represents not merely a technological change but a structural shift in the exercise of public authority. Accordingly, local governments must reorganize their administrative systems to actively fulfill their constitutional obligation to protect fundamental rights. Through such efforts, digital administration can evolve into a rights-oriented governance model that ensures not only efficiency but also the substantive protection of citizens’ rights.

본 연구는 디지털 행정전환이 심화되는 현대 행정환경에서 지방정부의 기본권 보호의무가 갖는 헌법적 의미와 그 실현 방안을 분석하는 것을 목적으로 한다. 정보통신기술의 발전과 인공지능, 빅데이터의 활용 확대는 행정의 효율성과 합리성을 제고하는 한편, 개인정보 침해, 알고리즘 편향, 절차적 권리 약화 등 새로운 기본권 침해 위험을 구조적으로 내포하고 있다. 특히 지방정부는 주민 생활과 밀접하게 연결된 행정 주체로서 디지털행정서비스의 최일선에서 이러한 위험에 대응해야 할 책임을 부담한다. 헌법상 기본권 보호의무는 국가 전반에 부과되는 의무로서 지방정부에도 동일하게 적용되며, 지방정부는 단순한 행정 집행기관을 넘어 주민의 기본권을 실질적으로 보장하는 적극적 주체로 기능해야 한다. 이에 따라 디지털 행정환경에서 지방정부는 개인정보 자기결정권, 평등권, 절차적 참여권, 정보접근권 등 다양한 기본권을 보호하기 위한 제도적·정책적 대응을 마련할 필요가 있다. 본 연구는 디지털 행정에서 발생할 수 있는 기본권 침해 유형으로 개인정보 보호 문제, 알고리즘 행정의 불투명성과 차별 위험, 디지털 격차로 인한 취약계층 배제 문제를 분석하였다. 이를 바탕으로 지방정부의 기본권 보호 체계 정립을 위한 방안으로 권리영향평가 제도의 도입, 알고리즘 설명가능성 및 이의제기 절차 등 절차적 통제 장치의 확립, 지방정부 간 역량 격차 해소, 디지털 포용 행정 구축의 필요성을 제시하였다. 결론적으로 디지털 행정전환은 단순한 기술적 변화가 아니라 공권력 행사 방식의 구조적 전환이며, 이에 따라 지방정부는 헌법상 기본권 보호의무를 적극적으로 이행하는 방향으로 행정체계를 재구성해야 한다. 이를 통해 디지털 행정은 효율성 제고를 넘어 주민의 권리를 실질적으로 보장하는 헌법친화적 행정으로 발전할 수 있을 것이다.
