다원적 대의민주주의 실현의 한계 : 국회 구성과 정당 기속의 문제를 중심으로
Limitations of the Realization of Plural Representative Democracy: Focusing on the Composition of the National Assembly and the Binding of Political Parties
This study aims to critically examine the constitutional role of political parties and their limitations within representative democracy, focusing on the contemporary Korean political context. Representative democracy, grounded in the principle of popular sovereignty, operates through institutions that reflect the political will of the people, with political parties functioning as essential intermediaries in this process. In modern democracies, often characterized as “party-based democracies,” political parties play a central role in aggregating diverse social interests and translating them into public policies. However, Korean political parties have not fully realized the democratic function of political parties prescribed by the Constitution. In particular, the dominance of party-centered parliamentary operations and strict party binding has substantially weakened the principle of the free delegation. Although the Constitution requires members of the National Assembly to act according to their conscience, legislative behavior is increasingly constrained by party directives. This phenomenon undermines deliberative processes within the legislature and limits the effective representation of diverse public interests. Furthermore, the predominance of a two-party system has contributed to the erosion of pluralism within the National Assembly and intensified ideological polarization. As a result, the legislature has shifted from a deliberative forum for reconciling competing interests to a space for partisan confrontation. Legislative decision-making is frequently driven by party leadership rather than by individual representatives’ independent judgment. In addition, the lack of intra-party democracy, centralized nomination processes, and leadership-dominated decision-making structures reinforce party control over legislators, thereby raising constitutional concerns regarding the democratic order of political parties. Ultimately, Korean representative democracy embodies a structural tension between the principle of he free delegation and party binding. This tension leads to a decline in representativeness, a weakening of deliberative legislative functions, and potential distortions in the separation of powers. In response, this study suggests the necessity of strengthening intra-party democracy, ensuring legislative autonomy, and reforming party-dominated parliamentary practices to restore the fundamental principles of representative democracy.

본 연구는 대의제 민주주의에서 정당이 수행하는 헌법적 기능과 그 한계를 한국 정치현실을 중심으로 비판적으로 분석하는 것을 목적으로 한다. 대의제 민주주의는 국민주권 원리에 기초하여 국민의 정치적 의사를 대표기관을 통해 실현하는 제도이며, 정당은 이러한 의사형성 과정에서 핵심적인 매개체로 기능한다. 특히 현대 민주주의는 정당을 중심으로 작동하는 ‘정당국가적 민주주의’의 성격을 가지며, 정당은 국민의 다양한 이해를 조직화하고 이를 국가의 정책결정 과정에 반영하는 중요한 역할을 수행한다. 그러나 한국의 정당은 헌법이 예정한 정당의 민주적 기능을 충분히 실현하지 못하고 있다. 특히 원내교섭단체 중심의 의회 운영과 강한 당론 기속은 국회의원의 자유위임 원칙을 형해화시키고, 의원의 독립적 의사결정을 제한하는 구조적 문제를 야기한다. 헌법 제46조가 예정하는 양심에 따른 직무수행은 정당의 정치적 의사에 종속되는 형태로 변질되고 있으며, 이는 의회의 숙의 기능을 약화시키고 국민 전체의 다양한 의사가 반영되는 것을 저해한다. 또한 한국의 양당 중심 정치구조는 의회 내 다원성을 약화시키고, 정당 간 이념적 양극화를 심화시키는 요인으로 작용한다. 그 결과 의회는 사회적 갈등을 조정하는 공론장의 기능을 수행하기보다는 정당 간 대립의 재현 공간으로 전락하고 있으며, 입법 과정 또한 정당 지도부 중심의 결정 구조에 의해 좌우되는 경향을 보인다. 더 나아가 정당 내부의 민주주의 결여, 폐쇄적 공천 구조, 지도부 중심의 의사결정은 정당기속을 더욱 강화시키는 요인으로 작용하며, 이는 헌법 제8조가 요구하는 민주적 정당질서와도 긴장관계를 형성한다. 이는 궁극적으로 다원주의에 입각한 대의제 민주주의 다원성과 대표성 그리고 숙의의 과정을 저해하는 근본적인 원인으로 작동한다. 결국 한국의 대의제 민주주의는 정당을 중심으로 운영되는 현실 속에서 자유위임 원칙과 정당기속 간의 구조적 충돌을 내포하고 있으며, 이는 대표성의 약화, 의회의 심의 기능의 저하, 권력분립 원리의 훼손으로 이어진다. 이에 따라 본 연구는 정당 내부 민주주의의 강화, 의원의 자율성 보장, 교섭단체 중심의회 운영의 개선 등을 통해 대의제 민주주의의 본질적 기능을 회복할 필요성을 제시한다.
