에이전틱 AI는 인간의 명령 없이도 스스로 목표를 설정하고 계획을 수립하여 다단계 업무를 완수하는 자율형 AI이다. 생성형 AI가인간의 지시에 수동적으로 답하는 ‘보조자’로서 역할을 하였다면, 에이전틱 AI는 스스로 판단하고 외부 도구(API 등)를 주도적으로 활용하는 ‘대리인’으로서의 역할을 수행한다. 최근 에이전틱 AI 발명이 글로벌 빅테크 기업들을 중심으로 멀티에이전트 조율 구조, 자율적 비즈니스 모델(BM) 등의 특허발명으로 출원되면서 특허경쟁이진행되고 있다. 에이전틱 AI 발명이 특허를 받으려면 추상적 아이디어는 특허받을 수 없고, 구체적인 데이터 흐름, 기술적 해결수단, 파이프라인 구조 등 구체적으로 명세서를 기재해야 하며, 진보성을충족시켜야 한다. 한편, AI를 발명자로 기재하여 특허출원한 DABUS 사건에서 전세계 국가에서 지식재산 부처와 법원은 자연인(인간)만이 발명자가될 수 있다고 설시하고 있고, 이때 인간의 실질적 기여도를 중요한심사기준으로 판단하고 있다. 본 연구에서는 에이전틱 AI와 관련하여 특허실무에 대하여 비교법적으로 고찰하였는바, 미국에서는 인간이 발명의 착상(Conception) 단계에서 질적인 기여를 하였음을 입증해야 하고, 발명자의 관점에서 실질적 기여도를 판단한다. 유럽연합(EU)의 경우에는 발명자 관점보다 AI 결과물이 현실적인 기술적과제를 어떻게 해결하였는지에 대한 발명의 기술적 성격에 초점을맞추고 있고, 통상의 당업자가 균일한 효과를 도출할 수 있는 재현가능성에 방점을 둔다. 일본의 경우에는 AI 관련 발명에서 AI 특허풀(patent pool)을 활성화하고, 온라인분쟁해결(ODR)의 도입 필요성을 검토하고 있는데, 이때 반드시 인간 전문가가 최종 판단해야 한다는 원칙을 고수하고 있다. 우리나라의 경우 지식재산처가 2026년발간한 ‘AI시대 올바른 특허출원 안내서’에 따라 생성형 AI가 도출한 가상의 실시예를 검증 없이 출원하면 재현가능성을 이유로 거절된다고 한다. 향후 인공지능의 발전으로 범용 인공지능(AGI) 시대가 도래하면, AI의 도움으로 손쉽게 발명을 할 수 있게 되어 더욱 엄격하고 고도화된 진보성 기준이 필요할 것이고, AI 기술의 폭발적인 발전 속도를 고려할 때, 특허권의 존속기간도 현행 20년을 조정할 필요성이있을 것이다. 한편, 에이전틱 AI의 자율적 구동 과정에서 발생한 특허침해 행위에 대해 법인격이 없는 AI 대신 개발사, 운영사, 최종사용자 중에서 누구에게 책임을 물을지 모호하며, AI 내부 프로세스의 ‘블랙박스’ 특성으로 인해 침해 입증이 어려우므로 입증책임의전환과 같은 제도적 보완에 대하여 추가 검토가 필요하다.
Agentic AI is an autonomous AI that completes multi-level tasks by setting goals and planning by itself without human commands. While Generative AI played a role as an assistant who passively answered human instructions, agentic AI plays a role as an agent who judges for itself and takes the lead in using external tools (API, etc.). Recently, as the invention relating to agentic AI such as multi-agent coordination structures, autonomous business models etc., has been applied by global big tech companies, patent competition is underway. In order for agentic AI inventions to be patented, abstract ideas cannot be patented, and specific description such as data flows, technical solutions, pipeline structures etc. should be described in patent specification, and patent requirements such as non-obviousness should be satisfied as well. On the other hand, in the DABUS case, which applied for a patent by listing AI as an inventor, intellectual property ministries and courts of each country around the world stipulate that only natural persons (humans) can be inventors, and at this time, the substantial contribution of human is judged as an important criterion for being patented. In this study, patent practice in relation to agentic AI is considered comparatively. In the United States, human must prove that he has made a qualitative contribution in the conception stage of the invention, and the substantial contribution is judged from the inventor's point of view. In the European Union (EU), rather than the inventor's point of view, the focus is on the technical nature of the invention as to how AI results have solved realistic technical problems, as well as on the reproducibility of a person skilled in the art to produce uniform effects. In Japan, AI patent pools should be activated in AI-related inventions and the necessity of introducing online dispute resolution (ODR) is being reviewed, and the principle that human experts must make the final decision is adhered to. In Korea, it is said that if a virtual embodiment derived by the Generative AI is applied without verification, it will be rejected for reproducibility reasons according to the ‘Patent Application Guide for the AI Era’ published by the Ministry of Intellectual Property in 2026. When the era of Artificial General Intelligence(AGI) arrives with the rapid development of artificial intelligence in the future, it will be possible to easily invent with the help of AI, which will require stricter and more advanced examination criteria for non-obviousness. Considering the explosive development speed of AI technology, the duration of patent rights will also need to be adjusted from the current 20 years. On the other hand, it is unclear who will be held responsible among developers, operators, and end users for patent infringement that occurred in the autonomous driving process of AI, and it is difficult to prove infringement due to the "black box" nature of the AI internal process.
용법ㆍ용량 발명의 명세서 기재요건에 관한 고찰 - 의약용도발명의 기술적 기여와 제약산업 발전 관점에서

본 논문은 용법ㆍ용량을 특징으로 하는 의약용도발명의 명세서 기재요건을 의약용도발명의 기술적 기여와 제약산업의 혁신이라는 관점에서 재검토하였다. 대법원 2014후768 전원합의체 판결은 투여용법과 투여용량을 의약용도발명의 구성요소로 인정하여 용법ㆍ용량 발명의 특허적격성을 명확히 하였다. 그러나 이후의 판례와 심사실무는 용법ㆍ 용량 발명에 대해서도 새로운 치료효과를 발견한 전통적인 의약용도발명과 동일한 수준의 약리효과 기재를 요구하는 경향을 보이고 있으며, 그 결과 상당수의 출원이 진보성에 대한 실질적인 판단에 이르기도 전에 명세서 기재요건 위반을 이유로 거절되거나 무효로 판단되고 있다. 본 논문은 먼저 협의의 의약용도발명과 용법ㆍ용량 발명은 모두 치료방법발명의 실질을 가지는 형식적 물건발명이라는 점에서는 동일하지만, 기술적 기여의 내용은 본질적으로 다르다는 점을 밝힌다. 협의의의약용도발명은 새로운 치료효과 자체의 발견에 기술적 기여가 있는반면, 용법ㆍ용량 발명은 이미 알려진 약리기전과 치료효과를 전제로투여용량, 투여간격, 투여경로 또는 환자군을 최적화하여 치료효과를향상시키거나 부작용을 감소시키고 환자의 복약순응도를 개선하는 후속혁신에 기술적 가치가 있다. 따라서 양자를 동일한 명세서 기재기준으로 평가하는 것은 기술적 기여의 차이를 간과하는 결과를 초래한다. 또한 명세서 기재요건의 본래 목적은 통상의 기술자가 발명을 실시할 수 있도록 충분히 공개하는 데 있으며, 발명의 기술적 가치나 특허성을 선별하는 데 있는 것이 아니라는 점을 논증하였다. 특히 대법원이 인정한 "약리기전이 명확히 밝혀진 경우와 같은 특별한 사정"은 이미 통상의 기술자가 발명을 실시할 수 있는 정보가 확보된 경우를 의미하며, 이미 약리기전과 치료효과가 공지된 용법ㆍ용량 발명에서는보다 적극적으로 적용될 필요가 있다. 또한 최근 유럽특허청 확대심판부의 G 2/21 결정 등 국제적 논의를 검토하여, 출원 당시 통상의 기술자가 발명의 효과를 합리적으로 신뢰할 수 있다면 전임상자료, 약동학ㆍ약력학(PK/PD) 자료, AI 기반 예측자료 등도 실시가능성을 뒷받침하는 자료로 고려될 수 있음을 제시하였다. 결론적으로 용법ㆍ용량 발명의 명세서 기재요건은 해당 발명의 기술적 기여에 비례하여 해석되어야 한다. 이미 알려진 약리기전과 치료효과를 전제로 하는 발명에서는 통상의 기술자가 발명을 실시할 수 있는정도의 공개가 이루어졌는지를 중심으로 실시가능요건을 판단하고, 기술적 가치와 특허부여의 정당성은 원칙적으로 진보성 단계에서 평가하는 것이 특허법의 체계와 대법원 전원합의체 판결의 취지에 부합한다. 이러한 해석은 발명의 공개와 적정한 권리범위라는 특허법의 기본원리를 유지하면서도 개량신약과 후속혁신을 촉진하여 우리나라 제약산업의 지속적인 발전에 기여할 것으로 기대된다.
This article reexamines the disclosure requirements for pharmaceutical use inventions characterized by dosage regimens from the perspectives of the technical contribution of pharmaceutical use inventions and the development of the pharmaceutical industry. The Supreme Court of Korea, in its en banc decision (2014Hu768), recognized dosage regimens and methods of administration as constituent elements of pharmaceutical use inventions, thereby confirming the patent eligibility of dosage regimen inventions. Nevertheless, subsequent judicial decisions and examination practice have continued to require essentially the same level of pharmacological disclosure as that required for conventional pharmaceutical use inventions involving the discovery of a new therapeutic effect. As a result, many applications for dosage regimen inventions have been rejected or invalidated for failure to satisfy the disclosure requirement before a substantive examination of inventive step is even undertaken. This article first argues that although conventional pharmaceutical use inventions and dosage regimen inventions are both formally drafted as product claims embodying methods of medical treatment, their technical contributions are fundamentally different. Conventional pharmaceutical use inventions derive their inventive contribution from the discovery of a previously unknown therapeutic effect of a known substance. By contrast, dosage regimen inventions are based on pharmacological mechanisms and therapeutic effects that are already known, and their technical contribution lies in optimizing dosage amount, dosing interval, route of administration, or patient subgroup to improve therapeutic efficacy, reduce adverse effects, or enhance patient compliance. Accordingly, applying the same disclosure standard to these two categories of inventions fails to reflect the different nature of their respective technical contributions. The article further demonstrates that the primary purpose of the disclosure requirement is to ensure that a person skilled in the art can practice the invention through adequate disclosure, rather than to evaluate its technical merit or patentability. In particular, the Supreme Court's doctrine recognizing "special circumstances such as where the pharmacological mechanism has been clearly elucidated" should be interpreted to include situations in which sufficient technical information is already available to enable a skilled person to practice the invention without undue experimentation. Therefore, where both the pharmacological mechanism and therapeutic effect of the claimed pharmaceutical are already well established, this doctrine should be applied more broadly to dosage regimen inventions. In addition, considering recent international developments, including Decision G 2/21 of the Enlarged Board of Appeal of the European Patent Office, this article argues that preclinical evidence, pharmacokinetic/ pharmacodynamic (PK/PD) data, and other scientifically reliable evidence available at the filing date may be sufficient to support enablement where they allow a skilled person to reasonably recognize the asserted therapeutic effect. This article concludes that the disclosure requirement for dosage regimen inventions should be interpreted in proportion to the actual technical contribution of the invention. Where the pharmacological mechanism and therapeutic effect are already known, enablement should focus on whether the specification enables a person skilled in the art to practice the invention, while the assessment of the invention's technical value and the justification for granting patent protection should, in principle, be reserved for the inventive-step analysis. Such an approach is consistent with both the fundamental structure of patent law and the rationale of the Supreme Court's en banc decision, while maintaining an appropriate balance between public disclosure and patent protection. It is also expected to promote incremental pharmaceutical innovation and contribute to the sustainable development of the pharmaceutical industry.

표준특허소송은 금액이 엄청나게 크고, 여러 나라에서 동시 다발적으로 실시권이 허여되어야 하는 표준특허의 속성상 표준특허의FRAND 소송에서는 극심한 forum shopping이 일어나고 있으며, 종전의미국, 유럽연합, 영국, 중국, 인도에 이어, 근래에는 브라질과 콜롬비아등 남미국가에 까지 번지고 있어, 국제관할에 관하여 해결책을 찾는일이 시급하다. 만일 유럽 연합이 (또는 회원국간 의사가 일치되지 못하는 경우 독일 단독으로) 영국의 임시적 실시허락을 WTO TRIPS 위반으로 문제 삼는 경우, 한정된 기간에 한정하며, 대가지불을 전제로 하여 실시권을인정하는 것 자체의 국제규범 위배를 주장하기는 쉽지 않아 보인다. 문제는 그러한 실시허락의 범위가 표준제정 기구에 의해 채택된 표준을 실시하는 제품이 판매되는 모든 국가에 미친다는 점과, 그러한 국가들 중에 UPC 회원국이 포함된다는 점이 논란의 이유가 될 것이다. 그러나 임시적 실시허락은 TRIPS wp31조의 요건을 모두 만족시키는것이다. 임시적 실시허락의 효력범위는 당초 FRAND 확약이 행하여진범위에 의해 정해지는 것이지 임시적 실시허락 결정에 의해 가감되는것이 아니다. 표준특허에 관한 재판은 FRAND 확약이 적용되는 특허가등록국가 모두가 global FRAND 조건을 결정하는 소송의 재판관할을 가지는 것이라고 판단한 2020년 영국 대법원의 Unwired Planet 판결의법리가 먼저 부인 받아야 하는데, 아직까지 이러한 이 법리가 잘못된것이라고 한 판결은 없어 보인다. Unwired Planet 판결에서 누누이 강조되었듯이, 권리자에게 수 십개 국가 법원을 찾아다니면서 실시료 결정 재판을 받으라고 요구하는것은 표준제정기구가 추구하는 권리자와 사용자의 권리보호에 있어 균형점을 취하고자 목적하는 표준제정 기구의 지재권 정책에 위배된다. 결국 여러 관할국가 중 누군가 먼저 국제재판관할권을 선점할 수 있다. 외국 재판의 결과를 자국에서 집행하기 위해서는 외국판결의 승인여부를 국내법원이 심사하여야 하므로, UPC나 독일 법원이 영국특허법원 같은 외국법원의 판결에 따라야 하는 의무나 위험도 없다. 이러한점을 종합해 보면, 표준특허의 FRAND 조건을 결정하기 위한 재판에서종국판결 선고까지 한시적 효력을 가지는 임시적 실시권을 허락하는것이 특허권자와 실시자가 신의성실한 자발적 협상자의 지위를 가지고협상을 계속하는 것이 가능하도록 소송외적인 위협요소를 차단하여 침해금지의 위협 없이 대등한 지위에서 신의성실한 협상이 가능하게 하는 임시적 실시권 허어가, 중국의 무분별한 ASI 정책과 달리, 법원의소송지휘의 한계를 벗어났다고 보기 어렵다.
Since standard essential patents (SEPs) are to be licensed to implementers in many jurisdictions at the same time, severe forum shopping is observed in many cases. Nowadays SEP related disputes have been litigated in the US, the Unified Patent Court in Europe, the United Kingdom, China, India; now in even South American countries including Brazil and Columbia. Even if the European Union finds that the UK violated the WTO TRIPS by declaring an interim license for the SEP implementers, and begins a dispute settlement process at WTO, as it did in WTO dispute settlement process against China on ASI policy, it would be difficult to get a decision of UK's violation of TRIPS. This is because an interim license is issued with a limited duration, i.e. only during the pendency of the SEP FRAND litigation, and got only with payment of interim license fee; and It would satisfy the requirements itemized in Art. 31 of TRIPS and be difficult to argue the interim license itself violate international agreement. The real issue is the scope of the interim license would stretch to all other jurisdictions where the FRAND commitment has been given, i.e. all the jurisdiction where the SEP has been registered including UPC member states, especially Germany which is vert hostile to ASI and interim license. The geographic scope of the interim license is determined, not by the interim license declaration, but by the geographic scope of the FRAND commitment as interpreted by the UK Supreme Court in the decision of Unwired Planet in 2020. If anyone wish to challenge the geographic scope of an interim license, she has to challenge the legal principle declared in Unwired Planet. Up to now, no adjudication has been reported denying the interpretation established by Unwired Planet. As emphasized in Unwired Planet decision, if we ask a patentee to litigate in every jurisdiction where infringement of an SEP is committed to get a declaration of FRAND license fee, it would fail to satisfy the purpose of IPR Policy of a standard development organizations, whcih aims to balance the interests of the SEP patentee and the implementers. Any one country must first claim jurisdiction for SEP FRAND litigation. Since decisions of a foreign court needs to be recognized before executed in another country, claiming a jurisdiction and adjudication an SEP FRAND disputes is not an infringement of judicial sovereignty. Taking these into consideration, it would be difficult to accuse that declaring an interim license by a court sized in a FRAND litigation implies jurisdictional imperialism and violates soverinty.

인공지능(AI)을 도구로 활용한 발명에서 자연인이 언제 특허법상 발명자의 창작행위를 수행하였다고 볼 것인가는 AI 자체의 발명자 적격과 구별되는 문제이다. 발명자는 자연인에 한정된다는 원칙만으로는과제 설정, 프롬프트 구성, 산출물의 선택ㆍ수정, 실험ㆍ검증 등으로분산된 인간의 행위 중 무엇이 청구발명의 형성에 실질적으로 기여하였는지를 판단하기 어렵다. 본고는 미국의 지침 변화와 그 기초가 된구상(conception)ㆍ공동발명 판례법리를 검토하고, 이를 우리 특허법상발명자 법리와 비교하여 AI 활용 발명에서 인간 기여를 판단하고 입증하기 위한 기준을 제시한다. USPTO는 2024년 AI 활용 발명에 Pannu Factors를 확장 적용하였으나, 2025년 이를 철회하고 단독 자연인에게는 전통적 구상 기준을 적용하도록 정리하였다. 이는 인간 발명자 요건을 완화한 것이 아니라 자연인의 창작행위와 청구발명 사이의 연결을 직접 확인하는 구조로 초점을돌린 것이다. 다만 이러한 전환이 우리 특허법에 곧바로 별도의 입법적공백을 발생시키는 것은 아니다. 우리 판례는 이미 단순한 과제의 제시 나 자금ㆍ설비의 제공과 구별하여, 구체적인 착상의 제시ㆍ부가ㆍ보완또는 실험을 통한 구체화 등 기술적 사상의 창작에 대한 실질적 기여를발명자 판단의 중심에 두고 있다. 그러므로 미국법상 구상(conception) 을 한국법에 이식하기보다, 기존의 착상ㆍ구체화 법리를 AI 활용 과정의 구체적 행위와 청구항의 기술적 내용에 연결할 필요가 있다. 본고는 이를 위하여 ① 청구항에 구현된 기술적 해결수단과 그 구성ㆍ한정사항을 특정하고, ② 자연인이 수행한 행위와 그 시점을 발명의형성과정 및 완성시점에 대응시키고, ③ 그 행위가 착상의 제시ㆍ부가ㆍ보완 또는 실험을 통한 구체화로서 발명의 완성에 실질적으로 기여하였는지를 평가하는 청구항별 3단계 판단모형을 제안한다. 이 모형에서 프롬프트 작성, 산출물의 선택ㆍ수정, 실험의 수행이라는 행위명칭은 그 자체로 발명자성을 긍정하거나 부정하지 않는다. 사용자ㆍ개발자ㆍ데이터 제공자의 지위 역시 계약관계나 역할명칭이 아니라 각 자연인이 청구항의 기술적 해결수단 형성에 실제로 기여하였는지에 따라 판단할 필요가 있다. 본고는 이러한 실체적 판단을 출원ㆍ심사ㆍ심판ㆍ소송 단계에서 뒷받침하기 위하여 프롬프트, AI 산출물, 수정이력, 연구노트 및 실험기록을 청구항의 구성별로 연결하는 “청구항별 기여매핑”을 제안한다. 또한 발명자성 판단을 서면기재ㆍ실시가능ㆍ진보성 등 인접 특허요건과 구별하고, 발명자 확정 이후의 권리귀속ㆍ직무발명 보상ㆍ계약상 이익배분과도 구별할 필요가 있다. AI 활용 발명의 발명자성은 청구된 기술적 해결수단이 어떠한 과정에서형성되었고 어느 자연인이 이를 착상하거나 구체화하였는지를 확인하여 판단되는 것이 바람직하다.
In inventions developed using artificial intelligence (AI) as a tool, determining when a natural person has performed the creative acts necessary to qualify as an inventor under patent law presents a question distinct from whether AI itself may be named as an inventor. The principle that only natural persons may be inventors does not, by itself, identify which human activities—including defining the problem, designing prompts, selecting or modifying outputs, and conducting experiments or verification—made a substantial contribution to the claimed invention. This Article examines changes in USPTO guidance and the U.S. case law on conception and joint inventorship underlying those changes, compares them with Korean inventorship doctrine, and proposes a framework for assessing and proving human contributions to AI-assisted inventions. In 2024, the USPTO extended the Pannu factors to AI-assisted inventions. In 2025, however, it rescinded the 2024 guidance and clarified that the traditional conception standard applies when only one natural person is involved in the inventive process. This change did not relax the human-inventor requirement; rather, it refocused the inquiry on directly establishing the nexus between the natural person’s creative contribution and the claimed invention. It does not, however, necessarily imply that Korean patent law contains a distinct gap requiring legislative action. Korean courts already place substantial contribution to the creation of a technical idea at the center of the inventorship inquiry. In particular, they distinguish contributions such as originating, supplementing, or refining a specific inventive idea, or bringing it to concrete realization through experimentation, from merely identifying a research problem or providing funding or facilities. Accordingly, instead of transplanting the U.S. doctrine of conception into Korean law, Korea’s existing doctrines governing the formulation and concretization of inventive ideas should be applied to the specific acts performed in the course of using AI and to the technical content of the claims. For this purpose, this Article proposes a three-step, claim-by-claim framework: (1) identify the technical solution embodied in each claim, together with its elements and limitations; (2) map the acts performed by each natural person, and the timing of those acts, onto the process by which the invention was developed and completed; and (3) assess whether those acts substantially contributed to the completion of the invention by originating, supplementing, or refining a specific inventive idea or by bringing it to concrete realization through experimentation. Under this framework, labels such as “prompt drafting,” “output selection or modification,” and “conducting experiments” neither establish nor negate inventorship in themselves. Likewise, whether a user, developer, or data provider qualifies as an inventor depends not on contractual relationships or role labels, but on whether that person actually contributed to developing the technical solution recited in a claim. To support this substantive inquiry during filing, examination, administrative patent proceedings, and litigation, this Article proposes “claim-by-claim contribution mapping,” which links prompts, AI-generated outputs, revision histories, research notes, and experimental records to the elements of each claim. The inventorship inquiry should also be distinguished from related patent requirements, such as written description, enablement, and inventive step, as well as from issues arising after inventorship has been determined, including ownership, employee-invention compensation, and the contractual allocation of benefits. Inventorship in AI-assisted inventions should ultimately turn on how the claimed technical solution was developed and which natural person or persons formulated the relevant inventive ideas or brought them to concrete realization.

대법원은 2026. 2. 26. 선고한 2024다311181 판결에서, 리폼업자가 소유자의 개인적 사용을 목적으로 한 요청에 따라 제품을 리폼한 뒤 소유자에게 반환했다면 원칙적으로 이를 ‘상표의 사용’으로 볼 수 없으므로 상표권 침해가 성립하지 않는다는 법리를 최초로 확립하였다. 이판결은 ‘상표의 사용’을 거래시장의 유통과 연계하고, 개인적 사용을위한 리폼 행위를 상표권의 효력이 미치지 않는 영역으로 보았다는 점에서 이론적 의의를 갖는다. 그러나 다음과 같은 과제도 남긴다. 첫째, 리폼업자가 반복적·계속적으로 영업하는 행위를 소유자의 개인적 사용 영역에 포함하는 논리는 ‘업으로서의 사용’ 요건 및 국제적 기준과긴장 관계에 놓인다. 둘째, 법원이 ‘특별한 사정’의 범위를 지나치게 좁게 설정하면 조직적인 리폼 서비스가 상표권 보호의 사각지대에 놓일수 있다. 셋째, 저명상표의 표시로 발생하는 구매 후 혼동과 상표의 명성 손상 문제가 규율 대상에서 제외될 우려가 있다. 넷째, ‘환경적 지속 가능성’을 근거로 리폼을 정당화하려면 진정한 환경적 목적, 이를뒷받침하는 증거, 규제의 비례성을 갖추어야 한다. 그러나 중고 가치가유지되는 명품 리폼이 이러한 요건을 충족하기는 쉽지 않다. 본고는미국·EU·일본의 비교법적 검토, 상표기능론에 따른 분석 및 환경법상 비례성 심사를 통해 대상판결의 한계를 비판적으로 고찰한다. 나아가 리폼의 자유와 상표권자의 이익 사이에서 균형을 이루기 위한 해석론적·입법론적 대안을 제시한다.
On February 26, 2026, the Supreme Court of Korea, in Case No. 2024Da311181, established for the first time that, where a repair or alteration business modifies a product at the owner’s request for the owner’s personal use and returns it to the owner, the activity does not, in principle, constitute trademark “use” and therefore does not constitute trademark infringement. The decision is theoretically significant in that it links the concept of trademark “use” to the distribution of goods in the marketplace and places alterations performed for personal use outside the ordinary scope of trademark protection. The decision, however, leaves several important issues unresolved. First, treating a repair or alteration business’s repeated and continuous provision of services as falling within the owner’s sphere of personal use may create tension with the requirement of “use in the course of trade” and with international standards. Second, if the scope of the “special circumstances” exception is construed too narrowly, organized and platform-based alteration services may fall into a gap in trademark protection. Third, the decision may risk excluding from consideration post-sale confusion and harm to the reputation of well-known marks arising from the use of such marks. Fourth, reliance on “environmental sustainability” as a justification for permitting alterations requires a genuine environmental purpose, supporting evidence, and proportionate regulation. Alterations of luxury goods that retain substantial second-hand value, however, may not readily satisfy these requirements. Through a comparative analysis of the United States, the European Union, and Japan, as well as an examination based on trademark-function theory and proportionality review under environmental law, this article critically evaluates the limitations of the decision. It further proposes interpretive and legislative alternatives for achieving an appropriate balance between the freedom to alter or customize goods and the interests of trademark owners.

상업적 우주활동이 확대되면서 우주물체상 표장 사용을 상표법상 어느 범위에서 국내행위로 볼 것인지가 문제 된다. 상표권은 속지주의를전제로 하나 외기권은 어느 국가의 영토도 아니어서, 사용의 장소와신용이 형성되는 시장, 침해행위지를 확정하는 일이 지상에서만큼 자명하지 않다. 본고는 대한민국 상표법이 보호국법으로 적용되는 경우그 공간적 적용범위를 검토한다. 사용의 모습은 거래가 형성되는 시장과 주된 급부의 장소에 따라 세 유형으로 나뉜다. 최종 공급과 이용이지상에서 이루어지거나 거래가 지상시장에서 형성되는 유형은 현행법과 원격표시의 국내성 해석으로 상당 부분 처리되고, 등록국 연결의필요는 거래와 급부가 모두 우주에서 완결되는 유형에 한정된다. 등록국 연결을 권리유지와 침해에 함께 적용하면 국내 시장에서 쓰이지 않는 상표의 등록이 존속하게 되어 불사용취소제도의 취지에 어긋난다. 시장 관련성만으로 처리하기 어려운 영역에 한하여 등록국을 민사침해의 보충적 연결점으로 삼되, 그 효과는 형사책임에 미치지 아니하여야한다. 결국 등록국 의제만으로 우주에서의 상표 사용을 일반적으로 규율할 수는 없다. 또한, 국내법만으로는 국가별 권리의 병존과 구제의중첩을 해결할 수 없으므로 국가 간 공동기준이 함께 요구된다.
As commercial space activity expands, a question arises as to the extent to which the use of a mark on a space object should be treated as a domestic act under trademark law. Trademark rights presuppose territoriality, yet outer space is not the territory of any State, so identifying the place of use, the market in which goodwill is formed, and the place of infringement is less self-evident than it is on Earth. This article examines the spatial scope of application of Korean trademark law where that law applies as the law of the protecting country. Uses may be divided into three types according to the market in which the transaction is formed and the place of the principal performance. Types in which the final supply and consumption occur on Earth, or in which the transaction is formed in a terrestrial market, are largely addressed by existing law together with the interpretation of remote display as domestic use; the need for a connection based on the State of registry is confined to the type in which both the transaction and the performance are completed in space. Applying that connection to the maintenance of rights and to infringement alike would allow a registration to survive even though the mark is not used in the Korean market, contrary to the purpose of cancellation for non-use. Only in the area that cannot be resolved through market relevance alone should the State of registry serve as a supplementary connecting factor for civil infringement, and its effect should not extend to criminal liability. A deeming provision based on the State of registry therefore cannot govern the use of marks in outer space in general. Moreover, domestic law alone cannot resolve the coexistence of national rights and the overlapping of remedies, so a common inter-State standard is also required.

디자인을 구성하는 개별 요소들이 이미 공지된 것이라고 하더라도, 이들 공지 요소들의 새로운 결합 형태는 디자인의 요부를 구성할 수 있다. 공지 요소의 새로운 결합 형태가 디자인의 요부로 인정될 수 있음은 대법원 판례에서도 인정하고 있다. 그러나 실제 사건에서 이러한 법리가 제대로 적용된 사례를 찾기가 어렵다. 오히려 대법원 판결이 채택하고 있는 소위 공지사항 제외설에 따라, 공지 요소의 결합된 형태를비교의 대상에서 제외하는 경우가 매우 많다. 그러나 공지사항 제외설은 전체적인 인상의 비교를 중대하게 훼손하는 것이기 때문에 더 이상이용되어서는 안 된다. 심판이나 재판과정에서는, 공지 요소의 결합된형태가 새로운 심미감을 형성하는 것인지, 그리하여 디자인의 요부나지배적 특징이 될 수 있는지 여부를 반드시 심리할 필요가 있다. 공지 요소의 결합된 형태가 디자인의 요부를 구성하는 경우, 그 유사의 폭은 결합의 참신성이나 독창성의 정도에 의하여 결정하여야 한다. 공지 요소의 결합된 형태가 그 결합에 있어서 참신성이나 독창성의 정도가 높고, 많은 면적비를 차지하면서, 잘 보이는 위치에 존재하고 있다면, 그 결합된 형태는 디자인의 지배적 특징을 구성할 수 있다고 보아야 한다. 대부분 공지 요소의 결합된 형태는 많은 면적비를 차지하면서, 잘 보이는 경우가 많기 때문에, 두 디자인 사이에 보여지는 차이점은 사소한 차이점이 될 가능성이 높다. 공지 요소의 결합으로 이루어진 특징 부분은 다양한 요소들 사이의상호 작용 및 상관 관계로 인하여 새로운 심미감을 형성할 수 있는데, 이러한 구성 요소들 간의 상호 작용 및 상관 관계를 구체적인 언어로표현하는 데에는 한계가 있다. 공지 요소들의 결합된 특징에서 오는새로운 심미감의 비교는 3자 시각적 비교법에 의하여 적절하게 수행할수 있다. 디자인의 유사판단에서 가장 중요한 순간인 시각에 의한 전체 관찰은 3자 시각적 비교법에 의하여 비로소 완성될 수 있다.
Even if individual elements of a design are already known, new combinations of these known elements can be an important part of the design. Nevertheless, the Supreme Court ruling does not significantly consider the combination of already known elements in determining design similarity. However, this attitude could seriously undermine the essence of design, which is a combination of various elements. In design-related cases, it is essential to consider whether a new combination of already known elements creates a new aesthetic or impression, and thus whether such a new combination can become an important part or dominant feature of the design. When a new combination of already known elements is an important part of a design, the breadth of the similarity that the design has should be determined by the degree of novelty or originality in the combination. If a combination of already known elements has a high degree of novelty or originality in that combination, occupies a large area, and is highly visible, then that combination can be considered to constitute the dominant feature of the design. In most cases, combinations of already known elements are likely to be the dominant features of a design, as they often occupy a large area ratio and are often highly visible. The features of design, which is a combination of already known elements, can create a new aesthetic through the interactions and correlations between various elements, but there are limitations in expressing these interactions and correlations in detail in language. Comparing new aesthetics derived from the combined features of already known elements can be effectively achieved through the three-way visual comparison method. The visual overall observation, which is considered most important in evaluating the similarity of designs, can only be completed through the three-way visual comparison method.

Gen AI 서비스 제공자를 상대로 한 저작권 침해소송이 여러 나라에서 제기되고 있는 반면, 생성형 AI(Gen AI)의 원천 기술인 ‘트랜스포머(Transformer)’ 아키텍처에 특허권이 존재함에도 아직까지 관련 분쟁이 없는 것에 대해 여러 이유가 제시된다. 구글이 Gen AI 서비스 관련SW에 대해 오픈소스 라이선스 정책을 취함과 동시에 Apache 2.0 라이선스를 통해 해당 SW에 구현된 특허발명에 대해 실시권을 부여하는점, 구글이나 OpenAI 등이 방어적 특허전략을 취하고 있는 점도 그 이유 중 하나로 설명되지만, 아직 소송을 제기할 만큼 시장이 성숙하지않았다는 판단 아래 전략적으로 시장 성숙을 기다리고 있다는 분석도있다. 분명한 것은 대부분의 빅테크 기업들이 지난 10년간 다양한AI(Gen AI 포함) 관련 특허를 출원해 왔다는 점이다. 방어적 특허 활용을 선언하고 있는 OpenAI도 과거보다 특허 출원 활동을 활발히 하고있다. 또한, 구글이 Apache 2.0을 통해 SW에 구현된 특허발명에 대한라이선스를 부여하고 있으나 해당 라이선스가 적용되지 않는 경우도있을 것이다. 이런 점들을 고려하면, 향후 특허 분쟁이 증가할 가능성은 적지 않다고 생각되며, 최근 미국과 유럽의 소송이 전조 현상일 수도 있다. 우리나라에서도 머지않아 Gen AI 서비스 제공자를 상대로 특허권 침해소송이 제기될 수 있다. AI(Gen AI 포함) 관련 특허권 행사의 실효성을 높이기 위해서는 우선 발명의 실시 주체에 대한 해석론 정립이 필요하다. 청구항의 카테고리(시스템, 장치, 저장 매체, 방법 등)별로 생산ㆍ사용 등의 주체에대한 명확한 판단 기준을 마련할 필요가 있다. 만일 해석론에 의한 대응으로 충분하지 않다면 실시 행위에 대한 법 개정도 검토해 볼 필요가 있다. 특히 AI 관련 발명의 경우 ‘사용’의 의미와 그 주체 판단이중요할 것으로 보인다. 이와 더불어 간접침해 제도 개선도 필요하다. 현행 특허법의 경우 전용물적 기여 행위만을 간접침해로 규율하므로비침해 용도가 없는 시스템(혹은 장치 또는 서버) 또는 저장매체에 저장된 비침해 용도 없는 컴퓨터 프로그램을 사용자에게 양도하지 않는한 Gen AI 서비스 제공자에게 간접침해 책임을 묻기는 쉽지 않아 보인다. 특히 전용성 인정이 곤란하고 물건인지 여부의 다툼이 있는 컴퓨터 프로그램의 제공을 간접침해 행위로 포섭할 수 있는 법 개정이필요할 것이다. 한편, AI 기술의 블랙박스적 특성은 침해 증명을 어렵게 한다. AI 특허의 권리행사 국면에서 침해 증명 수단이 적극 활용되지 못하면 권리 보호의 선순환을 도모하지 못하고 악순환에 빠지게 될것이다. 특허법상 자료제출명령 제도의 활성화와 한국형 증거개시제도의 도입에 대해 적극 검토할 필요가 있다고 생각한다. 나아가 ‘AI 기술을 특정 분야에 응용한 발명’에 대한 특허출원과 분쟁이 증가할 것으로 예상되므로, 기술적 특징과 비기술적 특징이 혼재하는 컴퓨터 관련발명과 관련하여 특허적격성과 진보성 판단 기준은 개선이 필요하다고생각한다.
Copyright infringement lawsuits against Generative AI (Gen AI) service providers are being filed in various countries. However, despite the existence of patent rights for the ‘Transformer’ architecture, the core technology of Gen AI, there have been no related disputes to date. The following reasons are cited for this: First, Google adopts an open-source licensing policy for its Gen AI service software while simultaneously granting licenses for patented inventions implemented in that software through the Apache 2.0 license. Second, companies like Google and OpenAI are employing defensive patent strategies. However, there is also an analysis suggesting they are strategically waiting for market maturity, judging that the market is not yet mature enough to warrant litigation. What is clear is that most Big Tech companies have filed various AI-related patent applications (including Gen AI) over the past decade. Even OpenAI, which has declared defensive patent strategies, is more active in its patent filing activities than in the past. Furthermore, while Google grants licenses for patented inventions implemented in its software through the Apache 2.0 license, there are likely instances where this license does not apply. Considering these circumstances, the likelihood of an increase in future patent disputes appears significant, and recent litigation in the U.S. and Europe could be a harbinger of this. In Korea as well, patent infringement lawsuits against Gen AI service providers could be filed before long. To enhance the effectiveness of exercising patent rights related to AI (including Gen AI), it is first necessary to establish judicial precedents regarding the interpretation of users of inventions. Clear criteria for determining who makes, uses, etc. inventions must be established for each claim category (system, device, storage medium, method, etc.). If establishing judicial precedents alone is insufficient, it is then necessary to consider amending the Patent Act regarding acts of infringement. In particular, for AI-related inventions, the meaning of use and the determination of the user appear to be critical. Along with this, the provisions regarding indirect infringement also need to be improved. According to the current Patent Act, only products with no non-infringing use are subject to indirect infringement, so it appears difficult to hold Gen AI service providers liable for indirect infringement unless they provide users with a system (or device or server) with no non-infringing use or a computer program with no non-infringing use stored on a storage medium. Since it is difficult to recognize no non-infringing use in case of computer programs and there is a dispute over whether they qualify as products, it is necessary to establish a provision that regulates the supply of computer programs as an act of indirect infringement. 본 연구는 18-19세기 영국의 공리주의를 완성한 천재 법률가 제레미벤담과 공리주의 철학이 지적재산권법이론 형성에 기여한 영향을 연구한 것이다. 공리주의는 주류적이었던 개인의 자유와 권리가 최대의 가치로 보는자유주의적 개인주의 철학에 대응하여 단체주의를 표방한 것으로, 가치의 총량에 있어 개인이 아닌 최대다수자의 이익의 증진을 최대의 가치로 보았다. 이러한 공리주의 철학은 새로운 법학의 원리를 제시하였을 뿐만 아니라 지적재산권 법리의 형성에도 많은 영향을 미쳤다. 영국의 공리주의는 마그나 카르타의 정신에도 반영되어 있지만, 제레미벤담은 공리주의 철학에 의하여 지적재산권법학을 포함하여 법학에도구현했다. 그는 철저한 최대다수의 최대행복이라는 공리성의 원리(the Principle of Utility)에 의하여 법학적 시각을 구현했다. 그리고 그의 철저한 입법주의적 법사상은 법형식주의(Legal Formalism)에도 영향을 미쳤을 뿐만 아니라 법실증주의(Legal Positivism)의 토대를 놓았다. 나아가 독일의 법실증주의 형성에도 기여를 하였고, 법실증주의자인 한스켈젠(Hans Kelsen)에게도 영향을 미쳤다. 제레미 벤담은 공리성에 어긋나는 독점을 매우 혐오했지만 특허와같은 제도는 공리성을 달성하기 위한 불가피한 사회적 보상으로 인정했다. 공리주의는 지적재산권제도를 경제적 효율성과 공익의 증진을위한 법 제도로 인식했고, 구체적인 법리 형성에 많은 영향을 미쳤다. 본 연구는 공리주의 철학이 지적재산권법의 형성에 미친 영향을 탐구하는 기초연구로서 제레미 벤담의 공리주의와 법실증주의가 법학에미친 영향을 고찰하였다. 그 영향 중에서 공리성, 법실증주의와 ‘조부의 오류’(Posterity-chainer’s device/fallacy; Fallacy of Authority, 권위의오류), 자유권과 평등권, 재산권 법리를 고찰했다.
This study examines Jeremy Bentham, the brilliant jurist who perfected British utilitarianism in the 18th and 19th centuries, and the influence that utilitarian philosophy had on the development of intellectual property law theory. Utilitarianism advocated collectivism in contrast to the mainstream liberal individualist philosophy, which regarded individual freedom and rights as the highest values; it viewed the promotion of the interests of the greatest number—rather than those of the individual—as the highest value in terms of the total sum of values. This utilitarian philosophy not only presented new principles of jurisprudence but also significantly influenced the development of intellectual property law. While British utilitarianism is reflected in the spirit of the Magna Carta, Jeremy Bentham applied utilitarian philosophy to jurisprudence, including intellectual property law. He shaped his legal perspective based on the Principle of Utility—the pursuit of the greatest happiness for the greatest number. Furthermore, his rigorous legislative philosophy not only influenced legal formalism but also laid the foundation for legal positivism. Moreover, it contributed to the development of German legal positivism and influenced the legal positivist Hans Kelsen. Although Jeremy Bentham strongly disapproved of monopolies that ran counter to the principle of utility, he recognized institutions such as patents as an inevitable social trade-off necessary to achieve utility. Utilitarianism viewed the intellectual property rights system as a legal framework designed to promote economic efficiency and the public interest, and it had a significant influence on the development of specific legal doctrines. As a foundational study exploring the influence of utilitarian philosophy on the development of intellectual property law, this research examined the impact of Jeremy Bentham’s utilitarianism and legal positivism on jurisprudence. Among these influences, this study examined utilitarianism, legal positivism, the “fallacy of authority” (also known as the “posterity-chainer’s device”), and the legal principles governing civil liberties, equality, and property rights.

Generative artificial intelligence is evolving from a content-production tool into an agentic system capable of decomposing goals, developing technical solutions, working through complex formulas, writing and testing software, designing product prototypes, coordinating external services, and maintaining projects over time. In software development, digital product design, content organization, and parts of online operations, agentic AI can enable one person to perform functions previously distributed across a small firm. Yet physical manufacturing, market transactions, payment, registration, professional licensing, and legal responsibility still depend on human or organizational actors. This change is especially consequential for minors. Agentic workflows expand what they can innovate and organize in practice, but do not automatically enlarge their legal capacity to contract, dispose of long-term rights, or absorb product, data, financial, and tort risks. Technology can therefore increase practical capacity without supplying transactional authority or relocating legal responsibility. This article argues that conventional approaches are incomplete because they treat minors either as passive recipients of online protection or as ordinary adult users whose age merely limits contracting. It develops a dual-status account of the minor as both a protected person and a rights-bearing innovator. The analysis is organized around three questions: initial ownership, authority to dispose of rights, and insulation from liabilities arising during commercialization. Age should not defeat initial ownership; human contribution should be established through process evidence rather than inferred from the use or non-use of AI; and authority to license or transfer rights should depend on the transaction’s reversibility, duration, value, and external risk. Commercial responsibility should be allocated under the applicable cause of action, with particular attention to actors who control the relevant activity, benefit from it, and can prevent the harm. The best-interests principle should therefore operate not as a generalized prohibition, but as a basis for reliable ownership, supported decision-making, protection of ongoing revenue, and insulation from disproportionate liability.

생성형 AI 서비스제공자의 저작권 침해 책임은 학습단계의 복제와산출단계의 침해를 분리하여 파악하기 어렵다. 학습과정에서 형성된모델의 내부 상태가 산출물로 외부화되는 방식이 학습의 적법성, 산출물의 침해성 및 책임주체 판단을 연결하기 때문이다. 본 연구는 생성형 AI의 작동을 ‘확률적 모방성’, ‘초과 모방성’, ‘암기’, ‘재현’ 등의 개념으로 구분하고, 모델 내부의 암기가 저작권법상 복제에 해당하는 상황과 맥락을 검토한다. 암기는 모델의 학습방식, 데이터셋의 유형 및특성, 데이터 중복도, 프롬프트 및 디코딩 방식에 따라 편차를 보이는경험적 현상이자 정도의 문제이므로, 특정 저작물의 안정적ㆍ반복적재현 가능성을 중심으로 판단하여야 한다. 독일의 GEMA v. OpenAI 판결은 단순한 프롬프트에 의한 가사의 반복 재현을 근거로 모델 내부의 암기를 복제로 인정한 반면, 영국의Getty Images v. Stability AI 판결은 모델 가중치가 저작물의 사본이 아니라 학습된 패턴과 특징을 반영한다고 보아 침해복제물성을 부정하였다. 한국 저작권법상 복제와 고정의 개념도 모델 내부 복제라는 이론구성을 배제하지 않지만, 복제 개념의 과잉 확장을 방지하려면 안정적 ㆍ반복적 재현에 관한 엄격한 증명이 필요하다. 미국의 Bartz v. Anthropic 및 Kadrey v. Meta 판결 역시 학습단계의 공정이용을 판단하면서 산출단계에서 침해적 산출물의 부재와 시장대체 효과를 중시하였다. 책임주체는 프롬프트의 침해유발성, 암기와 재현의 정도 및 서비스제공자의 통제가능성에 따라 해당 여부를 판단하여야 한다. 이용자가원문 재현을 의도한 경우에는 이용자의 직접침해가 문제되고, 일반적인 프롬프트만으로 특정 저작물이 반복 재현되고 그 원인이 학습구조나 서비스 설계에 있는 경우에는 개발자 또는 서비스제공자의 책임이문제될 수 있다. RAG 결합 서비스는 외부 저작물을 직접 검색ㆍ투입한다는 점에서 모델 내부 암기와 구별하여 평가할 필요가 있다. 본 연구는 생성형 AI의 동적 산출구조에 맞추어 ‘통지 후 합리적 조치’를 내용으로 하는 책임제한 특례를 제안한다. 권리자가 저작물, 침해 산출물, 재현 프롬프트 및 침해 근거를 구체적으로 통지하면 서비스제공자는 프롬프트 필터ㆍ출력 필터와 검색대상 제외 등 합리적인조치를 취하는 것을 요건으로 한다. 다만 특정 저작물의 모방을 의도한 모델, 통지 후 반복 침해를 방치한 서비스 및 특정 저작물을 고의적으로 검색ㆍ재현하는 RAG형 서비스에는 동일한 면책을 인정하기 어렵다. 결국 생성형 AI의 저작권 침해 책임은 학습방식, 의도성, 재현가능성, 통제가능성 및 위험창출의 정도에 비례하여 배분되어야 한다.
The copyright infringement liability of generative AI service providers cannot be adequately understood by treating reproduction at the training stage and infringement at the output stage as entirely separate issues. This is because the manner in which a model’s internal state, formed during training, is externalized through its outputs connects the lawfulness of training, the infringing nature of outputs, and the determination of the responsible party. This study distinguishes among the concepts of “probabilistic imitativeness,” “memorization,” “regurgitation,” and “excessive imitativeness,” and examines the circumstances and contexts in which memorization within a model may constitute reproduction under copyright law. Because memorization is a matter of degree that varies depending on the characteristics of the model, dataset, and copyrighted work, the degree of data duplication, and the prompt and decoding methods employed, it should be assessed primarily by reference to whether a particular work can be reproduced in a stable and repeatable manner. In GEMA v. OpenAI, the German court regarded memorization within the model as reproduction, relying on the repeated reproduction of song lyrics in response to simple prompts. By contrast, in Getty Images v. Stability AI, the UK court rejected the characterization of the model as an infringing copy on the ground that model weights reflect learned patterns and features rather than store copies of copyrighted works. Although the concepts of reproduction and fixation under Korean copyright law do not necessarily preclude a legal theory of reproduction within the model, strict proof of stable and repeatable reproduction is required to prevent an excessive expansion of the concept of reproduction. The US decisions in Bartz v. Anthropic and Kadrey v. Meta likewise emphasized the absence of infringing outputs and the effects of market substitution in assessing fair use at the training stage. The responsible party should be determined by considering the infringement-inducing nature of the prompt, the degree of memorization and regurgitation, and the service provider’s ability to control the risk. Where a user intends to reproduce the original work, the user’s direct infringement may be at issue. Where a particular work is repeatedly reproduced in response to ordinary prompts and the reproduction is attributable to the model’s training structure or service design, the developer or service provider may bear liability. Services incorporating retrieval-augmented generation (“RAG”) should be assessed separately from model memorization because they directly retrieve and input external copyrighted works into the generation process. This study proposes a special liability-limitation provision based on a duty to take “reasonable measures upon notice,” adapted to the dynamic output structure of generative AI. Where a right holder specifically identifies the copyrighted work, the allegedly infringing output, the prompt used to reproduce it, and the grounds for the infringement claim, the service provider would be required to take reasonable measures, such as implementing prompt filters, output filters, or excluding the work from retrieval. The same safe harbor, however, should not readily apply to models designed to imitate particular works, services that permit repeated infringement after receiving notice, or RAG-based services that intentionally retrieve and reproduce particular copyrighted works. Ultimately, copyright infringement liability for generative AI should be allocated proportionately according to the method of training, intentionality, reproducibility, controllability, and the degree of risk created.
