A Korea–U.S. Comparative Study on Inventorship Standards for AI-Assisted Inventions : The USPTO’s 2025 Revised Guidance Withdrawing the Pannu-Factor Approach and the Reconstruction of Inventorship Analysis under Korean Patent Law
In inventions developed using artificial intelligence (AI) as a tool, determining when a natural person has performed the creative acts necessary to qualify as an inventor under patent law presents a question distinct from whether AI itself may be named as an inventor. The principle that only natural persons may be inventors does not, by itself, identify which human activities—including defining the problem, designing prompts, selecting or modifying outputs, and conducting experiments or verification—made a substantial contribution to the claimed invention. This Article examines changes in USPTO guidance and the U.S. case law on conception and joint inventorship underlying those changes, compares them with Korean inventorship doctrine, and proposes a framework for assessing and proving human contributions to AI-assisted inventions. In 2024, the USPTO extended the Pannu factors to AI-assisted inventions. In 2025, however, it rescinded the 2024 guidance and clarified that the traditional conception standard applies when only one natural person is involved in the inventive process. This change did not relax the human-inventor requirement; rather, it refocused the inquiry on directly establishing the nexus between the natural person’s creative contribution and the claimed invention. It does not, however, necessarily imply that Korean patent law contains a distinct gap requiring legislative action. Korean courts already place substantial contribution to the creation of a technical idea at the center of the inventorship inquiry. In particular, they distinguish contributions such as originating, supplementing, or refining a specific inventive idea, or bringing it to concrete realization through experimentation, from merely identifying a research problem or providing funding or facilities. Accordingly, instead of transplanting the U.S. doctrine of conception into Korean law, Korea’s existing doctrines governing the formulation and concretization of inventive ideas should be applied to the specific acts performed in the course of using AI and to the technical content of the claims. For this purpose, this Article proposes a three-step, claim-by-claim framework: (1) identify the technical solution embodied in each claim, together with its elements and limitations; (2) map the acts performed by each natural person, and the timing of those acts, onto the process by which the invention was developed and completed; and (3) assess whether those acts substantially contributed to the completion of the invention by originating, supplementing, or refining a specific inventive idea or by bringing it to concrete realization through experimentation. Under this framework, labels such as “prompt drafting,” “output selection or modification,” and “conducting experiments” neither establish nor negate inventorship in themselves. Likewise, whether a user, developer, or data provider qualifies as an inventor depends not on contractual relationships or role labels, but on whether that person actually contributed to developing the technical solution recited in a claim. To support this substantive inquiry during filing, examination, administrative patent proceedings, and litigation, this Article proposes “claim-by-claim contribution mapping,” which links prompts, AI-generated outputs, revision histories, research notes, and experimental records to the elements of each claim. The inventorship inquiry should also be distinguished from related patent requirements, such as written description, enablement, and inventive step, as well as from issues arising after inventorship has been determined, including ownership, employee-invention compensation, and the contractual allocation of benefits. Inventorship in AI-assisted inventions should ultimately turn on how the claimed technical solution was developed and which natural person or persons formulated the relevant inventive ideas or brought them to concrete realization.

인공지능(AI)을 도구로 활용한 발명에서 자연인이 언제 특허법상 발명자의 창작행위를 수행하였다고 볼 것인가는 AI 자체의 발명자 적격과 구별되는 문제이다. 발명자는 자연인에 한정된다는 원칙만으로는과제 설정, 프롬프트 구성, 산출물의 선택ㆍ수정, 실험ㆍ검증 등으로분산된 인간의 행위 중 무엇이 청구발명의 형성에 실질적으로 기여하였는지를 판단하기 어렵다. 본고는 미국의 지침 변화와 그 기초가 된구상(conception)ㆍ공동발명 판례법리를 검토하고, 이를 우리 특허법상발명자 법리와 비교하여 AI 활용 발명에서 인간 기여를 판단하고 입증하기 위한 기준을 제시한다. USPTO는 2024년 AI 활용 발명에 Pannu Factors를 확장 적용하였으나, 2025년 이를 철회하고 단독 자연인에게는 전통적 구상 기준을 적용하도록 정리하였다. 이는 인간 발명자 요건을 완화한 것이 아니라 자연인의 창작행위와 청구발명 사이의 연결을 직접 확인하는 구조로 초점을돌린 것이다. 다만 이러한 전환이 우리 특허법에 곧바로 별도의 입법적공백을 발생시키는 것은 아니다. 우리 판례는 이미 단순한 과제의 제시 나 자금ㆍ설비의 제공과 구별하여, 구체적인 착상의 제시ㆍ부가ㆍ보완또는 실험을 통한 구체화 등 기술적 사상의 창작에 대한 실질적 기여를발명자 판단의 중심에 두고 있다. 그러므로 미국법상 구상(conception) 을 한국법에 이식하기보다, 기존의 착상ㆍ구체화 법리를 AI 활용 과정의 구체적 행위와 청구항의 기술적 내용에 연결할 필요가 있다. 본고는 이를 위하여 ① 청구항에 구현된 기술적 해결수단과 그 구성ㆍ한정사항을 특정하고, ② 자연인이 수행한 행위와 그 시점을 발명의형성과정 및 완성시점에 대응시키고, ③ 그 행위가 착상의 제시ㆍ부가ㆍ보완 또는 실험을 통한 구체화로서 발명의 완성에 실질적으로 기여하였는지를 평가하는 청구항별 3단계 판단모형을 제안한다. 이 모형에서 프롬프트 작성, 산출물의 선택ㆍ수정, 실험의 수행이라는 행위명칭은 그 자체로 발명자성을 긍정하거나 부정하지 않는다. 사용자ㆍ개발자ㆍ데이터 제공자의 지위 역시 계약관계나 역할명칭이 아니라 각 자연인이 청구항의 기술적 해결수단 형성에 실제로 기여하였는지에 따라 판단할 필요가 있다. 본고는 이러한 실체적 판단을 출원ㆍ심사ㆍ심판ㆍ소송 단계에서 뒷받침하기 위하여 프롬프트, AI 산출물, 수정이력, 연구노트 및 실험기록을 청구항의 구성별로 연결하는 “청구항별 기여매핑”을 제안한다. 또한 발명자성 판단을 서면기재ㆍ실시가능ㆍ진보성 등 인접 특허요건과 구별하고, 발명자 확정 이후의 권리귀속ㆍ직무발명 보상ㆍ계약상 이익배분과도 구별할 필요가 있다. AI 활용 발명의 발명자성은 청구된 기술적 해결수단이 어떠한 과정에서형성되었고 어느 자연인이 이를 착상하거나 구체화하였는지를 확인하여 판단되는 것이 바람직하다.
