용법ㆍ용량 발명의 명세서 기재요건에 관한 고찰 - 의약용도발명의 기술적 기여와 제약산업 발전 관점에서
A Study on the Disclosure Requirements for Dosage Regimen Inventions - From the Perspectives of Technical Contribution of Pharmaceutical Use Inventions and the Development of the Pharmaceutical Industry -
This article reexamines the disclosure requirements for pharmaceutical use inventions characterized by dosage regimens from the perspectives of the technical contribution of pharmaceutical use inventions and the development of the pharmaceutical industry. The Supreme Court of Korea, in its en banc decision (2014Hu768), recognized dosage regimens and methods of administration as constituent elements of pharmaceutical use inventions, thereby confirming the patent eligibility of dosage regimen inventions. Nevertheless, subsequent judicial decisions and examination practice have continued to require essentially the same level of pharmacological disclosure as that required for conventional pharmaceutical use inventions involving the discovery of a new therapeutic effect. As a result, many applications for dosage regimen inventions have been rejected or invalidated for failure to satisfy the disclosure requirement before a substantive examination of inventive step is even undertaken. This article first argues that although conventional pharmaceutical use inventions and dosage regimen inventions are both formally drafted as product claims embodying methods of medical treatment, their technical contributions are fundamentally different. Conventional pharmaceutical use inventions derive their inventive contribution from the discovery of a previously unknown therapeutic effect of a known substance. By contrast, dosage regimen inventions are based on pharmacological mechanisms and therapeutic effects that are already known, and their technical contribution lies in optimizing dosage amount, dosing interval, route of administration, or patient subgroup to improve therapeutic efficacy, reduce adverse effects, or enhance patient compliance. Accordingly, applying the same disclosure standard to these two categories of inventions fails to reflect the different nature of their respective technical contributions. The article further demonstrates that the primary purpose of the disclosure requirement is to ensure that a person skilled in the art can practice the invention through adequate disclosure, rather than to evaluate its technical merit or patentability. In particular, the Supreme Court's doctrine recognizing "special circumstances such as where the pharmacological mechanism has been clearly elucidated" should be interpreted to include situations in which sufficient technical information is already available to enable a skilled person to practice the invention without undue experimentation. Therefore, where both the pharmacological mechanism and therapeutic effect of the claimed pharmaceutical are already well established, this doctrine should be applied more broadly to dosage regimen inventions. In addition, considering recent international developments, including Decision G 2/21 of the Enlarged Board of Appeal of the European Patent Office, this article argues that preclinical evidence, pharmacokinetic/ pharmacodynamic (PK/PD) data, and other scientifically reliable evidence available at the filing date may be sufficient to support enablement where they allow a skilled person to reasonably recognize the asserted therapeutic effect. This article concludes that the disclosure requirement for dosage regimen inventions should be interpreted in proportion to the actual technical contribution of the invention. Where the pharmacological mechanism and therapeutic effect are already known, enablement should focus on whether the specification enables a person skilled in the art to practice the invention, while the assessment of the invention's technical value and the justification for granting patent protection should, in principle, be reserved for the inventive-step analysis. Such an approach is consistent with both the fundamental structure of patent law and the rationale of the Supreme Court's en banc decision, while maintaining an appropriate balance between public disclosure and patent protection. It is also expected to promote incremental pharmaceutical innovation and contribute to the sustainable development of the pharmaceutical industry.

본 논문은 용법ㆍ용량을 특징으로 하는 의약용도발명의 명세서 기재요건을 의약용도발명의 기술적 기여와 제약산업의 혁신이라는 관점에서 재검토하였다. 대법원 2014후768 전원합의체 판결은 투여용법과 투여용량을 의약용도발명의 구성요소로 인정하여 용법ㆍ용량 발명의 특허적격성을 명확히 하였다. 그러나 이후의 판례와 심사실무는 용법ㆍ 용량 발명에 대해서도 새로운 치료효과를 발견한 전통적인 의약용도발명과 동일한 수준의 약리효과 기재를 요구하는 경향을 보이고 있으며, 그 결과 상당수의 출원이 진보성에 대한 실질적인 판단에 이르기도 전에 명세서 기재요건 위반을 이유로 거절되거나 무효로 판단되고 있다. 본 논문은 먼저 협의의 의약용도발명과 용법ㆍ용량 발명은 모두 치료방법발명의 실질을 가지는 형식적 물건발명이라는 점에서는 동일하지만, 기술적 기여의 내용은 본질적으로 다르다는 점을 밝힌다. 협의의의약용도발명은 새로운 치료효과 자체의 발견에 기술적 기여가 있는반면, 용법ㆍ용량 발명은 이미 알려진 약리기전과 치료효과를 전제로투여용량, 투여간격, 투여경로 또는 환자군을 최적화하여 치료효과를향상시키거나 부작용을 감소시키고 환자의 복약순응도를 개선하는 후속혁신에 기술적 가치가 있다. 따라서 양자를 동일한 명세서 기재기준으로 평가하는 것은 기술적 기여의 차이를 간과하는 결과를 초래한다. 또한 명세서 기재요건의 본래 목적은 통상의 기술자가 발명을 실시할 수 있도록 충분히 공개하는 데 있으며, 발명의 기술적 가치나 특허성을 선별하는 데 있는 것이 아니라는 점을 논증하였다. 특히 대법원이 인정한 "약리기전이 명확히 밝혀진 경우와 같은 특별한 사정"은 이미 통상의 기술자가 발명을 실시할 수 있는 정보가 확보된 경우를 의미하며, 이미 약리기전과 치료효과가 공지된 용법ㆍ용량 발명에서는보다 적극적으로 적용될 필요가 있다. 또한 최근 유럽특허청 확대심판부의 G 2/21 결정 등 국제적 논의를 검토하여, 출원 당시 통상의 기술자가 발명의 효과를 합리적으로 신뢰할 수 있다면 전임상자료, 약동학ㆍ약력학(PK/PD) 자료, AI 기반 예측자료 등도 실시가능성을 뒷받침하는 자료로 고려될 수 있음을 제시하였다. 결론적으로 용법ㆍ용량 발명의 명세서 기재요건은 해당 발명의 기술적 기여에 비례하여 해석되어야 한다. 이미 알려진 약리기전과 치료효과를 전제로 하는 발명에서는 통상의 기술자가 발명을 실시할 수 있는정도의 공개가 이루어졌는지를 중심으로 실시가능요건을 판단하고, 기술적 가치와 특허부여의 정당성은 원칙적으로 진보성 단계에서 평가하는 것이 특허법의 체계와 대법원 전원합의체 판결의 취지에 부합한다. 이러한 해석은 발명의 공개와 적정한 권리범위라는 특허법의 기본원리를 유지하면서도 개량신약과 후속혁신을 촉진하여 우리나라 제약산업의 지속적인 발전에 기여할 것으로 기대된다.
