조국 광복 이후부터 끊임없이 논의되던 우리나라의 자치경찰제도가 드디어 2021년 7월 1일부터 본격적으로 시행된다. 그러나 현재의 자치경찰제는 시행에 성급함이 있었 고 자치경찰의 사무 또한 너무 협소하다는 비판이 있다. 아직 시행 초기이지만 지금부터 라도 자치경찰의 사무가 나아가야 할 방향에 대한 구체적인 분석과 실천이 필요한 시점 이다. 본 논문에서는 이와 같은 흐름을 인식하고 자치경찰이 앞으로 나아가야 할 방향을 제시하였고, 특히 자치경찰과 민간경비원과의 사무를 분석하여 양자가 상호 협력을 할 수 있는 분야를 구체적으로 살펴보았다. 먼저 학교폭력 예방․홍보 및 상담 등을 담당하는 학교폭력 전담경비원을 육성하고 지원한다. 이를 통해 부족한 경찰력의 보완과 민간경 비원에서 업무의 자긍심을 확보할 수 있다. 둘째, 교통법규 및 경범죄 위반자에 대한 제한된 형태의 지도․단속 권한을 위임한다. 자치경찰과 민간경비원이 합동으로 업무를 수행한다면 권한의 일탈 및 남용을 충분히 제어 가능하다. 셋째, 드론 및 빅데이터 등 신기술을 활용한 수색 및 영상 감시 분야이다. 민간경비 업체와 협력하여 지역 특성에 맞는 과학기술의 활용은 보다 높은 치안서비스 제공이 가능하다. 마지막으로 일부 범죄 수사에 대한 자문․사실파악 및 증거수집 등 수사지원 업무를 하도록 한다. 일정 자격을 갖춘 자에게 경찰 관리 범위 내에서 지원을 하도록 하는 것은 치안서비스 사각지대 해소에 큰 도움이 된다.

Korea's autonomous police system, which has been constantly discussed since the liberation of the country, will finally be implemented in earnest from July 1, 2021. However, there are criticisms that the current autonomous police system was hastily implemented and that the tasks of the autonomous police were too narrow. Although it is still in the early stages of implementation, it is a time for detailed analysis and practice of the direction in which the affairs of the autonomous police should proceed. Recognizing this trend, this paper suggests the direction for the autonomous police to move forward. In particular, by analyzing the affairs between the autonomous police and private security services, the fields in which the two sides can cooperate were looked into in detail. First, foster and support school violence security services who are in charge of prevention, publicity, and counseling of school violence. Through this, it is possible to supplement the insufficient police force and to secure the pride of working as a private security services. Second, it delegates a limited form of guidance and enforcement authority to violators of traffic laws and misdemeanors. If autonomous police and private security personnel perform their duties jointly, deviation and abuse of authority can be sufficiently controlled. Third, it is the field of search and video surveillance using new technologies such as drones and big data. The use of science and technology suitable for regional characteristics in cooperation with private security companies can provide higher security services. Lastly, some criminal investigations should be supported, such as consulting, finding facts, and collecting evidence. Allowing people with certain qualifications to provide support within the scope of police management is a great help in resolving the blind spots in the security service.

본 연구는 자치경찰제가 의미하는 개념과 자치경찰제 운영체계를 위하여 개선방안과 운영체계를 제안하고자 한다. 자치경찰은 지방자치 정부가 자치행정권을 갖고 담당 지 역주민을 위한 자치 경찰 서비스를 자율적으로 제공하는 자치정부 집단의 집행조직이며 바로 이것이 지방자치 정부의 책임하에 자치경찰의 활동을 하는 것을 자치경찰제라 한 다. 체계적으로는 자치 경찰의 기구 인력ㆍ재정 등이 직접 기초단위 지방 예산을 중심으로 운영되는 것이므로 집행 및 결산에서 지방의회의 통제와 감사를 받게 된다(강용기, 1999 : 415). 자치 경찰의 정의에 따르면 선진외국의 기초자치정부가 조직하여 운영하 는 등이 직접 기초정부의 수장인 시장에게 귀속되어 있고, 사회질서와 안전ㆍ시민 보호 공중위생 등을 확실히 유지할 목적으로 총괄적인 행정경찰권을 갖고 도로교통ㆍ관광 보호 등에 관련되는 지방정부가 정한 자치 경찰 관련법에 근거하여 기초자치단체나 광역 자치단체가 자율적인 자체재원으로 행사하는 것처럼 바른 조직구성이 되어 자치 경찰의 기본운영체계가 이루어져야 한다. 성공한 선진외국 모두가 민주주의적 바탕 하에 국가 를 운영하고 있고, 모든 국가가 정도의 차이를 두고 있을 뿐 자치경찰제를 도입하여 운영하고 있다. 따라서, 자치경찰제는 민주주의를 실현하는 민주적 방식으로 절차에 맞 게 재편되어야 한다. 그러므로 시장의 경찰행정권 아래에서 지역사회의 이익을 실현하 는 수단으로 자리매김하여야 하며, 장기적으로는 정치ㆍ사회적 민주화에 발맞추어 주민 의 직접적인 의사가 자치 경찰조직이나 활동에 스며들 수 있는 장치인 선거ㆍ주민소환제도ㆍ공청회ㆍ언론을 통한 토론ㆍ주민의 경찰 활동 직접 참여 등이 세밀하게 이루어져 나가야 할 것이다. 이렇게 하여 자치 경찰의 자질향상과 위상확립을 향상하여 선진외국의 대열 에 손색없도록 일보전진에 이바지하도록 노력해야 할 것이다.

This study intends to propose the concept of the autonomous police system and the practical method of operation. Self-governing police refers to the enforcement organization of autonomous government groups in which local governments have autonomous administrative authority and autonomously provide self-governing police services for local residents. Systematically, the organization, manpower, and finances of the autonomous police are operated directly on the basis of the local budget of the basic unit, so they are subject to the control and audit of the local council in execution and settlement. The operation of self-governing police belongs to the head of the local government, and aims to maintain social order, safety, and public sanitation. In addition, the basic administrative system of autonomous police should be established by having autonomous self-financing by basic and regional autonomous entities based on the laws related to autonomous police established by local governments, such as road traffic and tourism. In the case of advanced foreign countries, the autonomous police system is operated on a democratic basis, and all countries have a degree of difference, but the autonomous police system has been introduced and operated. Therefore, the autonomous police system must be operated in accordance with procedures in a democratic way to realize democracy. Therefore, the group's police administration must establish itself as a means to realize the interests of the community, and in the long run, a device that allows direct intentions of residents to permeate self-governing police organizations or activities in line with political and social democratization (elections, residents). The summons system, discussions through the media at public hearings, and direct participation of residents in police activities, etc) should be carried out in detail. In this way, it is necessary to make efforts to improve the quality of self-government polices and establish the status of the autonomous police to be comparable to that of advanced foreign countries.

이탈리아는 헌법 제117조에서 지역정부의 자치입법권 인정과 함께 관할행정구역 내 에서의 도자치정부와 기초정부들의 자치경찰활동에 관한 협력과 조정 역할을 수행하도 록 권한을 부여하고 있다. 이에 20개의 지역정부에서는 지역 내 자치경찰활동 및 운영체 계의 통일성을 유지하기 위한 지역정부(region)의 자치경찰기준법을 제정하여 이를 근 간으로 자치경찰의 조직 및 교육정책, 복장, 자치경찰 차량색깔 등 지역 단위 중심의 자치경찰제를 운영하고 있다. 이탈리아의 지역정부들은 그 하위 단위의 도와 기초정부가 통일적으로 준수할 수 있도록 자치경찰활동에 관한 기본규정을 제정하고 동시에 자치경찰과 국가경찰, 그리고 자치경찰 상호 간의 협력관계, 공조활동 등을 촉진하는데 노력하고 있다. 그리하여 자차경찰은 지역정부(Region) 수준에서는 관할지역 내 자치경찰간 협력․조정, 지역경찰활동 계획수립 등의 업무를 위한 경찰부서와 협력위원회를 설치하여 운영하고 있는 정도이며, 실질적으로 교통업무, 치안업무, 사법경찰업무를 중심으로 수행하는 자치경 찰들은 도(Province)와 시․군(Comuni)에 설치, 운영되고 있다1). 자치경찰은 과거에는 공안요원(vigili urbani)이었으나 1986년 법 65호인 <자치경찰법> 제정에 의해 현재의 자치경찰제도로 발전하였다.

One of the provisions of the Italian National Constitution, art.117, provides 20 Regional Governments with the secondary legislation powers on making Police regulations over Departmental and Municipal Police System. Under the article of the Constitution, Regional Government enacted several basic regulations related to the municipal police activities and operational organization such as fixing the uniform of municipal police and circumscrived activities which are imposed as mandatory rules to the municipal police officers of municipalities and departments within regional government’s administrative scope. Anyhow, in Italian municipal police system, unlike that of Korean municipal police system based on the Provincial Municipal Police Committee, Mayor of the basic unit of local governments has the legal powers of police activities delegated among many national duties and functions. In regards of these facts we observed, Korean municipalities proclaim and prepare, in near future, the real autonomous municipal police system coordinated with the functional duties of Provincial and Metropolitan upper-level of local governments in Korea.
