자치경찰제는 주민의 안전과 질서유지 등 경찰 본래의 기능을 지방자치단체차 원에서 해결하게 함으로써, 치안행정의 지방분권화를 통해 지방자치를 실현할 수 있다는 점에서 그 의의가 크다. 이러한 관점에서 국민의 정부와 참여정부에서는 지방분권과 민주성에 충실하면서 실현가능한 자치경찰제 실시를 위해 자치경찰제 방안을 마련하는 등 자치경찰제 도입을 위하여 지속적으로 노력하여왔다. 이러한 노력의 결실로 지난 2006년 제주특별자치도에 자치경찰제가 도입되었으나 현재까 지 전면적인 자치경찰의 실시는 답보상태에 머물러 있다. 이러한 배경에는 무엇보 다 자치경찰의 사무, 조직, 인사, 재정 등 다양한 쟁점사항에 대한 합의에 이르지 못하고 있기 때문이다. 이중에서 특히 자치경찰의 사무는 국가경찰과의 합리적인 배분을 전제로 하고 있어 자치경찰제의 도입을 위해 해결해야할 우선적인 과제라 고 할 수 있다. 이에 본 연구에서는 문헌고찰을 통해 자치경찰제도의 의의를 살펴보고 제주자치경찰제의 현황과 한계를 고찰한 다음 지방자치발전을 위한 자치경 찰제의 과제를 살펴보았으며, 그 결과 첫째, 시·도 경찰위원회를 합의제 행정기관 으로 신설하여 시·도 경찰청장을 지휘·감독하며, 자치경찰에 대한 인사권, 재정권, 지역치안종합계획 수립, 주요 자치경찰 정책결정 등을 할 수 있도록 하여야 한다. 둘째, 시·도 경찰위원회 위원장을 지역주민이 직접 선거를 통해 선출하여 자치경 찰에 대한 민주적 정당성을 확고히 하고, 주민참여가 실질적으로 보장되어 자치경 찰의 민주성과 정치적 중립성, 책임성이 확보되도록 하여야 한다. 셋째, 주민복리 사무로서 치안복지 개념을 명확히 하고, 자치경찰사무와 국가경찰사무를 명확히 규정하여 자치경찰의 책임성을 보장하여야 하고, 자치경찰에게 지역민생치안에 대 한 범죄수사권은 국가경찰의 간섭 없이 스스로 할 수 있도록 하여야 하며, 자치경 찰제 도입에 따른 재원을 자치경찰 교부세 신설, 국세와 지방세 세수의 합리적 배 분이 되도록 세법 개정, 국가보조금등을 통하여 확보되도록 자치경찰과 지방자치 가 상생 하여야 한다는 결론을 얻었다.

The autonomous police system is meaningful in that it can achieve local autonomy through decentralization of security administration by allowing local governments to solve their original functions, such as the safety of residents and maintaining order. From this point of view, the people's government and participatory governments have continuously made efforts to introduce the local police system, including preparing measures to implement the autonomous police system, which is feasible while adhering to decentralization and democracy.As a result of these efforts, the local police system was introduced in the Jeju Special Self-governing Province in 2006, but the overall practice of the local police has remained stalled so far. Against this backdrop, the government has failed to reach an agreement on various issues, including the office, organization, personnel and finance of the local police. Among them, the duty of local police in particular is based on a reasonable allocation with the national police, which is a priority to be solved in order to introduce the local police system.In this study, we looked at the significance of the local police system and the current situation and limitations of the Jeju autonomous police system, and as a result, the city and provincial police committee should be established as a consensual administrative institution to direct and supervise the head of the municipal police agency, establish a comprehensive plan for personnel management, financial rights, and local police decisions.Second, the heads of the municipal and provincial police committees should be elected by the local residents through direct elections to ensure democratic legitimacy and ensure the residents' participation in the police force to ensure democracy, political neutrality and accountability. Third, as a community welfare office, the concept of security welfare should be clarified, the local police office and the national police service should be clearly defined to ensure the responsibility of the local police, and the police should be able to investigate the local residents' livelihood without interference from the national police, the establishment of a local police department tax, and rational distribution of national and local tax revenue through the revision of the National Tax Service.

그 어느 때보다 자치경찰에 대한 논의가 뜨겁다. 당장 2019년에는 우리나라에 자치경찰제의 시범적 실시를 시행해야 한다. 여전히 자치경찰의 시행에 관한 세부 적 논의가 꾸준히 진행 중이지만 이제는 자치경찰의 실천방식에 대한 고민이 시작 되어야 한다. 일본의 경찰제도는 중앙집권적 요소와 지방분권적 요소를 적절히 배 합하고 있어, 우리가 추구하는 국가경찰과 지방경찰의 공존형태에 매우 부합된다. 위와 같은 이유로 본 연구는 일본의 자치경찰제를 구체적으로 분석하였으며 우리 나라 경찰에 주는 시사점은 다음과 같다. 첫째, 도도부현 경찰의 독자적 경찰권 행 사를 위해 관리기구인 도도부현 공안위원회의 관리를 간접적으로만 가능하도록 권한을 제한하였다. 둘째, 도도부현 경찰의 국가 경찰로의 편입 기회를 열어 놓아 능력 있는 인재 등용과 일본 경찰이라는 귀속감을 높였다. 셋째, 정치적 중립과 공 정한 경찰권 행사를 위해 도도부현 경찰에 경찰의 집행 사무를 원칙적으로 처리하 도록 하였다. 일본의 경우도 수많은 시행착오 끝에 현재의 경찰제도로 정착되었다. 우리의 경우 일본의 경찰제도와 많은 부분이 유사하므로 일본 자치경찰제를 깊이 있게 살펴 볼 필요성이 있다. 보다 깊이 있고 대안 있는 후속 연구를 기대하며 본 연구가 우리나라 자치경찰제 시행에 도움이 되길 기대한다.

The debate over autonomous police is hotter than ever. the autonomous police system should be implemented in Korea. Although there is still a detailed discussion on the implementation of autonomous police, it is now time to start thinking about the way autonomous police practice. The Japanese police system properly combines centralized and decentralized elements, which is in line with the coexistence of the national and local police that we seek. For this reason, this study analyzed the autonomous police system in Japan in detail and the implications for the police in Korea are as follows. First, we restricted the authority of the Prefectural Public Safety Commission, which is a manager of the Japanese prefectural police, only to indirectly manage the police forces. Second, the Japanese prefecture police opened an opportunity to transfer to the national police, raising the talent of talented people and the Japanese police. Third, in order to exercise political neutrality and fair police rights, police officers in Japan were principally handled by the police. After many trial and error, the case of Japan was settled as the current police system. In our case, it is necessary to look deeply into the Japanese autonomous police system, because many of them are similar to the Japanese police system. We hope that this study will help to implement the autonomous police system in Korea.

‘수사권 조정’이라는 단어는 지난 수 십년간 만병통치약인 양 검찰의 적폐로 언 급되는 문제들에 대한 해결 방안으로 등장해왔다. 그런데 현 2018년 정권에서도 ‘검찰과 경찰의 문제 해결 방안‘으로 형사사법영역에서 검찰에 부여된 핵심 권한들 을 경찰에게 많은 부분을 이전하는 내용으로 하는 수사권 조정을 내 놓았다. 문제 가 있는 검찰과 경찰의 양 기관 사이의 권한만 조정하면 그에 따른 모든 문제가 해결된다는 말의 논리적 모순은 뒤로 하고라도, ‘정권․정치에 종속된 검찰’ 그리고 ‘공정과 중립을 잃어버린 편파적 검찰조직’이 생성하는 문제의 순환을 막기 위해서는 정권과 정치로부터 검찰이 독립되는 일이 가장 우선되어야 할 것임에도 불구하 고, 현 정부에서 공개된 자치경찰제 도입 초안에도 그런 고민을 발견하기는 어렵 다(김성룡, 2018 : 7). 다만, 청와대 조정안에서 ‘국민의 인권과 안전을 보호하고 검찰과 경찰이 법치 국가적인 헌법질서를 수호하는 기관으로써 거듭나게’하고, ‘검찰과 경찰이 지휘와 감독의 수직적인 관계에서 벗어나, 국민의 인권 수호와 안전을 위해 협력하면서 각자의 위치를 높이는 것’이라는 표현에서 현 정부의 의지가 담겨있는 듯하다(김 성룡, 2018 : 8). 이렇듯이 경찰개혁위원회는 안정성과 효율성이 입증된 현재 치안시스템의 장점 을 살려 주민생활에 밀접한 치안서비스가 제공될 수 있도록 다양한 의견을 수렴하 여 최적의 안을 만들어 내고 있는 것이다(여개명, 2018: 119). 추후에는, 경찰개 혁위 권고안을 토대로 국민들의 안전을 위해서 보다 발전된 경찰제도에 대한 논의 가 필요하며, 더불어서 권고안에 담기지 못한 세밀한 부분들을 보완하여 국민들의 안전을 위한 자치경찰제를 만들어 나가야 하겠다. 경찰이 조직관리, 인사관리, 재무관리 등 여러 방면에 있어서 혁신이 함께 따라 야 작은 성과라도 거둘 수가 있기에 지역사회경찰제도가 빠른 시일 내에 확립되어 야 하는 것이다. 따라서 치안은 ‘지방분권’, ‘권력의 분산’보다 앞서서 더 중요한 ‘국민들의 안전’ 과 직결되어 있는 제도로써, 결국은 ‘국민의 안전’이 최우선인 것이다.

The Police Reform Committee is taking advantage of the current security system that has proven its stability and efficiency, so that it can create an optimal plan by collecting various opinions so that the police service closely related to the residents' life can be provided. In the future, based on the recommendations of the Police Reform Commission, it will be necessary to discuss the police system, which is more advanced in safety, and to make up the autonomous police system for the safety of the public by supplementing the details that are not include in the recommendation. The police should establish the local police system as soon as possible because the police can achieve even a small success by following innovation together in various aspects such as organization management, personnel management, and financial management. Therefore, security is a system in tandem with the 'safety of the people', which is more important than 'decentralization' and 'decentralization of power'. Finally, 'national security' is the first priority.
