본 연구는 2017년 한국의 새정부 출범 이후 지방자치경찰제의 도입이 본격화 되고 있는 만큼, 자치경찰제도의 선두주자 라고 할수 있는 미국과 영국의 제도에 관하여 연구하였 다. 먼저 미국의 주 및 지방 자치 경찰의 현황을 고찰하고 특화 자치경찰의 운영에 대하여 고찰하였다. 영국의 경우는 전반적인 지방 자치 경찰의 제도를 살펴보고 특화 자치경찰의 현황에 대하여 고찰하였다. 또한, 본 연구를 통하여 미국과 영국의 지자체들은 일반자치경찰뿐만 아니라 특화 경찰대 (대학, 공원, 공항, 대중교통경찰등) 등도 운영하고 있음을 알 수 있었다. 향후 자치경찰제도의 국내 도입에 있어 이러한 미국과 영국의 자치경찰의 운영 사례에 대한 연구가 도움이 되리라 사료된다.

일본 경찰은 일본 경찰법 2조 1항에 정해진 대로 일본에서 개인의 생명, 신체 및 재산의 보호에 임하며, 범죄의 예방, 진압 및 수사, 피의자 체포, 교통의 단속 외 공공의 안전과 질서 유지를 책무로 하는 행정의 작용을 말한다. 일상적인 용어 로는 이러한 활동을 하는 조직, 또는 공무원을 가리킨다. 일본에서 근무하는 공무원 중에서, 그에 적합한 연수를 수료해서 실제의 경찰 활동을 집행하는 경찰 직원을 따로 "경찰관"이라고 부른다. 경찰 기관에 근무하는 직원 중에서 각종 경찰 사무를 담당하고 있으나 경찰수첩이나 권총·수갑을 보관 유지하지 않고 현장의 경찰 활동에는 종사하지 않는 경찰 직원을 "일반 직원"이라 고 총칭한다. 일본 경찰청에서는 사무직의 사무관과 통신 활동이나 과학 수사에 종사하는 기술직과 구별하여 관리하고 있다. 일본에서 범죄의 예방이나 치안 유지 등의 활동을 행정경찰활동, 발생한 범죄에 대한 수사나 범인 체포 등의 활동을 사법경찰활동이라고 부르며, 일본의 경찰 활동에서는 이 두 개가 구별되어 관리되고 있다. 소란·내란을 사전에 막아, 일본 국내의 안전을 유지하는 것을 목적으로 하는 공 안경찰활동, 문제가 발생했을 경우 이것을 진압하는 치안경찰활동은, 넓은 의미에 서 행정경찰활동에 포함되지만, 시민의 인권의 측면에서 행사되는 공권력이 강해 짐으로써, 이들은 특별하게 취급되기도 한다.

본 연구에서는 최근 우리 경찰에 가장 큰 화두로 떠오른 지방자치경찰제 도입 논의와 관련하여 자치경찰제가 가장 잘 운영된다는 평가를 받고 있는 미국의 경찰 제도의 조직과 특성을 고찰한 후 개별적인 사안에 대한 수용가능성과 도입 시 우 리치안 현실과 조화될 수 있는지에 대해서도 타당성을 모색하는데 목적이 있다. 자치경찰제도가 도입되면 해당지역 특성에 맞는 치안활동이라는 큰 장점이 있 음에도 불구하고 국가경찰과의 적정한 업무 분장, 국가경찰과 지방경찰의 일부 업 무 중복으로 인한 인력과 예산의 낭비적인 요소, 지역 경제사정에 따른 경찰예산 차이로 인한 치안상태의 불균형과 소속 경찰관들의 보수차이로 인한 사기문제, 자 치경찰제 논의와 연결된 경찰과 검찰과의 수사권 조정 방향, 새로운 이슈로 떠오 른 경찰직장협의회 허용문제 등 미국경찰 제도를 살펴보면서 자치경찰제도 도입 을 전제로 해결해야 할 크고 작은 과제가 산적해 있음을 확인할 수 있었다. 이에 더하여 자치경찰제가 도입되면 경찰력이 분산되고 지방정치권의 영향력 증대가 불가피하여 지역단체장과 지방의회 등 지역사회에 대하여 일정부분 견제 기능을 담당해오던 경찰의 역할 약화에 대한 보완책 마련도 논의해야할 과제로 보 여 진다.

독립적 주권을 가지고 있는 캐나다의 경찰 제도는 각 주(province)들이 연합하 여 연방을 이루고 있다. 연방 전체를 관할하는 캐나다 왕립 기마경찰과 RCMP 연 방경찰이 각 주에 독자적인 경찰조직으로 존재한다. 그러나, 광대한 영토와 재정 적 상황 등에 의하여 연방과 각 주의 제약으로 인하여 ‘계약경찰’이라는 독특한 제 도인 연방경찰이 각 주에 경찰력을 제공하며, 연방경찰이 광범위하게 실시되고 있 다(최태원, 2014: 4). 캐나다의 경찰은 독자적인 수사권 및 검사와 경찰의 철저한 분리, 일반인 누구나 기소권이 인정되는 정통적 common law에 기반한 법제도에 의하는 독특한 경찰제도는 요즘 크게 논의되고 있는 우리나라의 지방자치 경찰 제 도에 맞추어 연구될 필요가 있다. 캐나다 경찰제도는 우리나라와는 다르게 국가경 찰과 자치경찰로 구성되어 있다. 여기서 우리가 차용할 만한 시사점을 얻어 한국경찰제도 시스템에 도움을 주고자 한다. 캐나다의 경찰은 연방경찰, 주경찰, 기초 자치경찰로 이루어져 있고 자치단체는 재정 능력이나 문화특성에 따라 독자적인 자치경찰을 운용할 수 있으며, 주 또는 연방경찰에 위탁하여 자치경찰업무를 수행 하는 경우가 있다. 기초자치단체의 경우, 인접 기초자치단체 등과 함께 자치경찰 을 운용하기도 한다. 캐나다 경찰은 자치경찰 규모를 광역화시키고 있는 것이 그 특징이다. 우리나라도 일부 시행은 되고 있으나, 자치경찰을 전격적으로 도입할 경우, 어느 정도의 재정 자립도가 있는 자치단체는 자체적으로 운영이 가능하지만, 재정이 부족한 경우에는 여러 자치단체가 함께 공동으로 운영을 하거나, 국가경찰 에게 위탁하고 자치단체의 예산을 일부 투입하는 방안도 있을 것이다.
