Der Rechtsstaat verbietet grunsätzlich die Anwendung privater Gewalt zur Durchsetzung zivilrechtlicher Ansprüche und verweist den Gläubiger auf die Anrufung der Justiz. Wenn jedoch obrigkeitliche Hilfe nicht rechtzeitig zu erlangen ist oder zu Unrecht verweigert wird und ohne sofortiges Eingreifen die Gefahr besteht, daß die Verwirklichung des Anspruchs vereitelt oder wesentlich erschwert werden würde, ist in engen Grenzen Selbsthilfe erlaubt(§229 BGB). Als Mittel der Selbsthilfe sind zugelassen die Wegnahme, Beschädigung oder Zerstörung von Sache des Schuldners, die Festnahme des Widerstands des Schuldners gegen eine Handlung, die er zu dulden hat. Subjektiv ist Habdeln zum Zwecke der Selbsthulfe erforderlich. Die Selbsthilfe darf nicht weiter gehen, als zur Abwendung der Gefahr erforderlich ist(§230ⅠBGB). Allerdings geht das Selbsthilfe nicht auf die Befreiedigun, sondern nur auf eine Sicherstellung des Gläubigers. Der Gläubiger darf dem Schuldner das geschuldete Geld ggf. also zwar wegnahmen. Er darf sich aber nicht ohne weiteres aueignen, sondern muss eine Zwangsvollstreckung erwirken oder dinglichen Arrest beantragen. Nach §230Ⅱ, Ⅲ BGB im Falle der Wegnahme von Sachen ist, sofern nicht Zwangsvollstreckung erwirkt wird, der dingliche Arrest zu beantragen. Und im Falle der Festnahme des Verpflichteten ist, sofern er nicht wieder in Freiheit gesetzt wird, der persönliche Sicherheitsarrest bei dem Amtsgericht zu beantragen, in dessen Bezirk die Festnahme erfolgt ist; der Verpflichtete ist unverzüglich dem Gericht vorzuführen. Die Notwehr ist kein Fall des Handeln pro magistratu, weil sie primär dem Selbstschutz dient und auch nicht nur subsidiär zur Verfügung steht. Im Unterscheid zur Notwehr setzt die Selbsthilfe keine gegenwärtigen Angriff voraus. Spezielle Selbsthilferegelungen, die der allgemeinen Notwehrberechtigun vorgehen, enthalten die §§562bⅠ, 581Ⅱ, 704 S.2, 859, 1029 BGB. Sie verlangen keine Unmöglichkeit obrigkeitlicher Hilfe, sind also nicht im strengen Sinne des Wortes Fälle des Handeln pro magistratu. Die Besitzkehr(§859Ⅱ BGB) nach verbotener Eigenmacht(§858 BGB) ist ein Spezialfall des zivilrechtlichen Selbsthilferechts für den Besitzer beweglicher Sachen. §859Ⅱ BGB verlangt im Unterscheid zu §229 BGB nicht, daß obrigkeitliche Hilfe rechtzeitig zu erlangen ist dafür stellt er aber zeitliche Grenzen auf: es geht um den „auf frischer Tat betroffen oder verfolgten Täter.‟ Auch die Besitzwehr (§859Ⅰ BGB) ist ein Rechtfertigungsgrund, nach dem der Besitzberechtigte die Besitzstörung mit dafür angemessenen Gewalt beseitigen darf.

According to Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act Article 32, A broker is entitled to receive the fixed commission concerning the brokerage business from the clients: Provided, That the same shall not apply to the cases where the transaction between the clients is invalidated, with drawn or cancelled by his/her intention or negligence. Matters necessary for the limit, etc. of the commission of brokerage of a house(including its attached land; hereafter in this paragraph the same shall apply) and the actual expense as prescribed in paragraph (2) shall be determined by the Municipal Ordinance of the Special Metropolitan City, Metropolitan City or Do within the range determined by the Ordinanceofthe Ministry of Construction and Transportation; and the commission of brokerage of an object other than a house, by the Ordinance of the Ministry of Construction and Transportation In Korea, the limit of a rate and the amount of money is decided as a local government's regulation and "Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act". Although it can grope for the various method of solution to the problem and cause of a real estate brokerage system, in this paper, on several controversial issues which appeared in the present real estate brokerage system is analyzed. It is to furnish the research material about the real estate brokerage system and the system's rational improvement plan which the profits of a consumer and a broker can develope into harmony.

In case of registration of existing reconstruction&redevelopment, the main concern among union and its members was the general problems related to real-estate registration that is the subject of right&obligation of the union. In fact, even judicial scriveners, who handles a registration task, and union members don't have that much interests or critical mind on corporate(union) registration; a registration related to subject of right&obligation. In practical field, however, overall legal questions related to corporate registration are generated and this issue can be an important matter that will deicide effectiveness such as establishment and extinction of the union. Thus, under this critical mind, this paper is to identify problematic matters in real situations and its solutions among overall legal problems which are generated in relation to corporate registration during the process of establishment and extinction of the union. First, the authenticity of procedures and contents of minute book of organization meeting, which is the most important attached papers in establishment registration of corporation(union), should be guaranteed by verification of attendance. Second, although the registration of acting union leader, who's appointed due to the vacancy of union leader, is not allowed by current law, considering the importance of prevention for possible confusion which occurs in real work place and of realistic tasks that is handled by the acting union leader, it's preferable to have it as registration matter by the amendment of law. Third, in union meeting, objective and specific contents, that allow union members reasonable judgement and clear understanding about dismissal and settlement, must be filled in written agreement for dismissal

This study considered that the transitional condition has played role in the sound development and promotion of the real estate business, carried out the research on the job satisfaction of real estate brokers that serve as a good reference on the advancement, the commencement and the management of the real estate business. A showed the political, systematic plans oriented towards the contents related with job satisfaction of real estate brokers through the Focus Group Interview(FGI). The results of the investigation process and contents can be summarized as follows. This study intended to cotton on to the main factor related with the job satisfaction of real estate brokers, to seek advanced real estate broker's role in the industrial attributes of real estate business and these changes, as external economical condition is not good and internal rising of the diffusion rate of house is showed. Nevertheless, extensive investigation samples were not utilized, so this study has the limit to the regions in Busan, Ulsan, etc. in Gyoungnam province. Therefore, this study suggests that an additional study is necessary to make up for these problems.

For many housing policy in 2011 has been announced. But each of the directionality of the policy is ambiguous. And given the results of the analysis, the goal of housing policy worthy of the commonalty friendly in order to include some information that was analyzed. The study results are presented along with future research directions.
