It is often said that ‘Education should be a farsighted national policy’. I’m not sure if this slogan holds good in these days because educational environment is changing so fast enough that we cannot keep abreast of it well. A New Freedom that has swept over the world in this Century shows what the end or purpose of human’s desire is ultimately and demands a forceful adjustment of it. Probably, the New Freedom may be guiding righteousness or virtue of education in so harsh and ruthless way to our contemporaries in the world. Just with the word of ‘competition’ defined nowadaysas a super-ordinate concept to the true aim or object of education such as autonomy and originality, the present educational field is being pushed into competition itself. Education had been originally regarded as a private realm, but with the birth of concept of the State, it would be essential to infuse people with a public aim of the State and to educate them with spiritually unified idea, which gave rise to the concept of public education on the premise that people in the State should be enlightened. Although public education in the past originated from the abovementioned purpose, however, it is not too much to say that everything stems from public education today. The Clause 1, Article 31 of the Constitution of the Republic of Korea stipulates that ‘All people shall have a right to equally receive education corresponding to their abilities’. The word of ‘education’ stated in the Constitution refers to public education. And the public education herein includes national, public, and private schools. Therefore, it can be seen that the concept of education in these days guarantees the concept of public education institutionally, while private education may be another realm with which individuals should be charged. The concept of education formed in all these years of transition is still rapidly changing. So the parts to be dealt with in this thesis consist of: (Ⅱ) The relations between the Constitution and Education Act concerning the education right provided for by the Constitution; (Ⅲ) Analysis between education right and learning right followed by the change of subject in education; (Ⅳ) The relations with independence of education considered important in education right; (Ⅴ) The definition and establishment of concepts about ‘Legislation of teachers’ status’ and ‘Faculty reappointment system’ guaranteed in the Constitution. Accordingly, this thesis is to present the true object of education and the future vision of education for the following generations, especially by analyzing the relations between autonomy and self-government of education.

Heutzutage kann die Bedeutung der Rechtshilfe im Strafverfahren zwischen den Staaten nicht genug betont werden. In diesem Aufsatz geht es um die Auslieferung von Straftatern als einen Teilbereich der internationalen Rechtshilfe im Strafverfahren. Am 27. Juli 2006 entschied das Oberlandesgericht Seoul im Auslieferungsverfahren gegen den vietnamischen Terrorverdachtigen, Nguyen Huu Chanh, seine Auslieferung unter Heranziehung des Grundsatzes der Nichtauslieferung des politischen Straftaters nicht zuzulassen.Dieser Fall war der erste Fall, in dem ein koreanisches Gericht entgegen dem Gesuch des auslandischen Staats die Auslandsauslieferung mit der Anerkennung des politischen Straftaters abgelehnt hat. Der Beschluss war auch insofern bedeutend, als darin uber die Rechtskraft der UN-Resolution ausdrucklich entschieden wurde.Allerdings wirft der Verfasser einige Fragen gegen die Entscheidung des Gerichts uber die Nichtgewarung der Auslieferung auf. Insbesondere ist außerst bedenklich, dass der Straftater, der die im sogenannten Ubereinkommen gegen Terrorismus verbotenen Terrorhandlugen ausgeubt hat, als politischen Straftater angesehen und aus diesem Grund nicht ausgeliefert wird. Zudem bestehen Bedenken auch insofern, als Versuche unternommen werden, eine Angelegenheit mit interantionalem Bezug allein mit der rein auf nationalem Recht basierenden Vorstellung zu losen. Auch ein koreanisches Gericht hat in der Angelegenheit mit internationalem Bezug das Prinzip der Regelung des internationalen Konflikts anzuwenden.In der Tat kann das Verhalten von Korea, unter Anerkennung des Terrorverdachtigen als eines politischen Straftaters ihn weder im eigenen Land zu bestrafen noch ins Ausland auszuliefern, moglicherweise dazu fuhren, -ohne Absicht- den Ruf als Unterstutzerstaat des Terrorismus hinterzulassen.An die koreanischen Gerichte wird appelliert, im internationalen Strafverfahren, insbesondere in der Angelegenheit uber Terrorstraftat sogfaltige Entscheidung zu treffen.

통합적 환경관리의 구현을 위한 수단으로 오염물질 통합관리, 오염배출원 통합관리, 지역환경 통합관리의 3가지 방법이 거론되는데, 이러한 통합관리 방식을 그대로 도입하는 것은 현실적인 한계가 있으므로 단계적인 접근이 필요한 상황이다. 이를 위하여 여러 가지 구체적인 방법론이 고려될 수 있지만, 국내법을 중심으로 한 외국법제의 전환방식이 가장 효율적ㆍ현실적인 것으로 판단된다. 즉, 기존의 국내법의 규정들을 검토하여 ‘가능한 선에서’ 개정ㆍ신설 등의 입법작용을 통하여 통합적 환경관리 방식을 부분적으로 받아들이는 것이다.이러한 측면에서 현재 우리나라에도 어느 정도 통합적 환경관리를 구현하고 있는 것으로 판단되는 여러 제도들이 있지만, 이들 제도들은 시행초기 단계에 있거나 집행상의 문제점들로 인하여 실질적인 통합관리를 수행하는 데에는 많은 어려움이 있고, 이와 달리 배출시설에 관한 통합관리는 법제도상 어느 정도 가능한 부분이 있다.결론적으로 배출규제제도를 통합적으로 운용하기 위해서는 각 매체별 입법을 정비하여 규정의 내용을 통일하고, 의제규정을 두어 하나의 허가와 신고를 통해 다른 매체의 허가와 신고를 대체하는 방법을 취할 수도 있겠지만, 조직과 절차를 통합하고 법규정을 일의적으로 적용하기 위해서는 배출규제제도를 관장하는 통합법안을 마련하는 것이 타당하다고 생각된다.통합적 배출시설규제를 위한 법률을 제정하기 위해서는 기존의 매체별 입법에 산재해 있는 규정들을 통합하여 하나의 절차로 정리하고 이를 집행하는 조직을 일원적으로 구축하여야 할 것이다. 절차와 관련된 부분은 앞서 논의된 법제도의 구축과 관련된 주요 내용들이 포함되어야 할 것이며, 일원적 조직의 구성은 통합관리를 위한 행정조직의 형태로 구성하되 지자체와의 권한 배분과의 관계에서는 중앙정부를 중심으로 관리조직을 형성할 필요가 있다.그리고 개별규정의 구체적인 내용과 규정상호간의 관계를 설정함에 있어서는 통합환경관리의 의의와 산업시설허가시스템의 목적, 규제순응성이라는 측면을 고려하여야 한다. 기존에 존재하는 제도는 현상을 유지하되 새롭게 도입되거나 기존의 제도가 강화되는 경우에는 피규제자의 반발을 감안하여 단계적으로 도입하는 방법을 고려하여야 할 것으로 보인다. 또한 위반사항에 대한 행정처분은 질서행정상의 직접적 규제수단에만 의지할 것이 아니라 경제적 제재수단을 병용하되 규제준수를 위한 인센티브제도와의 상관성을 고려하여 탄력적인 제도운용이 가능해야 할 것이다.그러나 배출시설규제법의 성공적인 정착을 위해서는 매체별 입법의 통일뿐만 아니라 다른 환경법령과의 관계도 고려해야 한다. 총량관리제나 배출권거래제도, 환경영향평가, 일반적 시설설치제한 등과 같은 제도들은 직ㆍ간접적으로 배출시설규제제도에 영향을 미치기 때문이다. 그러므로 배출시설규제법에서도 타 법률과의 상관성을 고려하여 이에 대한 충분한 배려가 있어야 할 것으로 보인다.배출규제제도의 통합은 통합환경관리의 종착역이 아니라 이를 확대하기 위한 교두보이다. 통합적 배출규제제도의 운용을 통하여 통합환경관리의 허실을 파악하고 우리 지형에 맞는 형태로 이를 변화시켜 나감으로써 점점 강화되어 가는 환경적 수요에 전략적으로 대응해 나가야 할 것이다.

The claim rights of vicarious compensation mean the creditors’ right of recourse on the profit against the obligors when debtors make profits on vicarious compensation of the object to be fulfilled by the same causes which raised the insolvency. The Korean civil law has no provision on the claim rights of vicarious compensation. The claim rights of vicarious compensation in legal schemes and the harmonizations of the laws with the other civil law systems are different due to the differences in the ways of the transfer of a real right and the principles of risk bearing etc. of the countries.The results of breaking the fairness between both parties concerned like this appear continuously in that only the proportional decrease of a consideration obligation would be admitted. the effect come up to fruit, even a guarantor necessarily bears a responsibility when the rights are exercised.In conclusion, due to the problems in itself as well as possible conflict with existing system and fairness breaking result of the acknowledging the claim right of vicarious compensation, it is reasonable that the Korean civil law should not acknowledge the claim rights of vicarious compensation. In a word. it is necessary to provide an express provision admitting the claim rights of vicarious compensation and regulating essential contents rationally to solve the problems.

Despite its importance, it seems that research on legal experts’ legal acknowledge have not been making in-depth progress. Thus, research in this field needs to be made urgently. First of all, in selecting the legal experts, they shall turn actual cases into subject matters, which can be legally judged, by abstracting these actual cases and making them into legal issues. Based on this approach, the legal experts shall be capable of making appropriate conclusions by pondering on the most suitable legal principles. When setting the scope of the survey based on these principles, it seems most ideal to conduct the survey on the experts who have obtained qualifications regarding laws and legal systems. However, considering realistic problems in conducting the survey, it is necessary to limit the subject of the survey to the experts who have obtained qualifications about the law itself.In addition, it is necessary to understand that legal acknowledge means an umbrella concept members of one social community have about the social governance system called ‘the law’. This concept covers legal awareness, legal attitude, and making legal value-judgments and legal appraisals.In conclusion, legal experts’ legal acknowledge can be defined as the general term covering legal awareness, legal value-judgments, legal appraisal and legal attitude of the experts who have obtained qualifications about the law itself, toward the social governance system that the members of one social community consider as the law.Furthermore, reasons why it is necessary to investigate legal experts’ legal acknowledge are as follows: Firstly, to contribute to realistic and early realization of constitutionalism; Secondly, to understand the gap between reality and laws and to indicate the direction toward which adjustments are to be made; and Thirdly, to act as criteria upon which advanced and efficient operation of the legal system is evaluated; Fourthly, to act as the standard upon which effectiveness of the legal system is assessed; Fifthly, to contribute further to a sound constitutional environment or legal climate by legislating, applying and interpreting laws suitable for the social circumstances of Korea. Sixthly, to use as the basis showing problems of legal education and improvements.

Also we still allow ourselves ways of right in a concerned party that were appropriate in a the network of police search. If we are to preserve right with a criminal case and it is possible for benefits to bring a far higher level of freedom than was formerly possible we must banish certain unlaw of process. For right of process we must substitute appropriateness, for maintenance of right in the process we must substitute justice. Many times a day we realize how much my outer and inner process in criminal action is built upon the endeavor of impartiality.

The purpose of Housing Lease Protection Act is to secure stability of the residental life for the people. The acquisition of opposing power is demanded the delivery of house and the resident registration. The scoppe of opposing power is asserted that the lessee may assert all rights against assignee. The third person cannot recognize existence of lessee through the resident registration system. It has many problems so the law must be revised and complemented in order to protect lessee’s right.It is advisable that leaseholders should be able to apply for the registration of established lease for themselves with lease contract as evidence, which requires the reasonable revision of Realty Registration Act in advance. Despite the end of lease period in returning the lease security money, a lessor can put off repayment of deposit money. It is urgent for the introduction of Security Insurance System in Returning the Deposit Money for Lessee.This article intends to make an improvement of Housing Lease Protection Act.
