본 연구는 유관순 열사의 사상과 이타주의와의 상관관계를 연구하고자한다, Titmuss는 먼저 인간의 가치관을 배제시키고는 사회정책에 대하여 논의 할 수 없다는 점을 강조한다. 헌혈제도는 국가에 의하여 운영되지만 전적으로 자발적 봉사자와 이타주의적 증여에 의존하고 있다고 본다. 유관순의 민족 독립정신도 이러한 자발적인 봉사자와 이타주의적인 사상이 밑거름이 되었다고 볼 수 있다. 우리나라의 민족독립정신도 이러한 이타주의적인 입장에서의 연구의 시도가 필요하다고 본다. Titmuss는 사회정책의 기능을 사회통합과 도덕적 이타주의를 개발하는 것으로 인식했으며 이것이 사회문제를 해결할 수 있다고 판단하게 된 것 같다. 유관순열사의 민족독립정신도 사회복지적인 입장에서의 이타주의적 접근을 통하여 민족독립의식의 확산이 필요하다고 본다. Titmuss가 주장하는 이타주의는 제도화된 형태로서의 사회정책이 인간으로 하여금 노력적 선택을 할 수 있도록 해 주어야 한다. Titmuss의 훌륭한 사회에 대한 비전은 확실히 복지국가를 넘어서는 것 같다. 불평등의 영속화 및 악화, 무수한 경제 권력의 집중 그리고 민간의 복지제도에 대한 비판을 보면, 현재의 복지국가 발전에 대하여 커다란 혐오를 내포하고 있음을 발견할 수 있다. The Gift Relationship에 나타난 사회철학은 우애, 이타주의, 협력 그리고 보상에 대하여 강조하였으며, 자본주의에 대한 근본적 비판이었다. 아울러 복지국가를 확대 개선하느니 보다는 새로운 사회질서의 확립에 의해서 만이 훌륭한 사회가 이룩될 수 있음을 시사하고 있다. 이타주의 개발을 위해서 Titmuss는 사회성원들간의 권리 의무 관계보다는 절대적인 관계를 중시함으로써 산업사회의 익명성에도 불구하고 요구자와 증여자 사이의 상호의존관계 및 책임의식을 개발할 수 있다는 가능성을 제시하였다. 그러나 Titmuss는 문제를 분석하는데 그쳤을 뿐 자본주의 체제의 근본적인 개혁을 시도하지 못했지만 사회변동과 사회구조적인 분석을 토대로 한 사회정책이념에 규범적인 이타주의를 강조함으로써 사회정책의 방향 설정에 큰 기여를 하였다. Titmuss의 견해와 같이 이타주의에 의한 사회적 증여가 의무라기 보다는 이타적 동기에서 비롯되는 것이란 주장을 내세우는 입장에서 유관순 열사의 민족 사랑과 독립정신도 이기적인 마음이 아니라 이타주의적인 입장에서 보는것도 가능하다고 본다.

This study on a Patriot Yugwansun ideas and correlations of altruism. Titmuss first emphasizes that can not be discussed to the exclusion of human values and social policy. Vision of the good society for Titmuss's certainly seems to be beyond the welfare state. The Gift Relationship, social philosophy, friendship, altruism, cooperation, and compensation for stressed, was a fundamental critique of capitalism. By altruism and social obligations, rather than altruistic motivation that comes from bestowal would argue that prides itself on its position as Titmuss's views and not ethnic love Yugwansun A Patriot independent spirit, selfish mind, I think it' s possible to see in the altruistic standpoint.

본 논문은 학계에서 그동안 커다란 관심을 받아오지 못했던 역사상 위대한 여성지도자를 연구대상으로 삼아 유관순 열사의 리더십을 분석하여 미래 통일한국의 위대한 지도자가 본받아야 할 지도자상을 제시하고 있다. 특히 유관순 열사의 고난의 내용을 중심으로 성경적인 관점에서 그가 하나님이 세우신 위대한 지도자로서 자신의 위상을 구축하는 과정을 추적하여 유관순리더십을 새롭게 조명하고자 하였다. 강한 카리스마를 행사하며 대한독립을 이끌고 우리에게 희망의 메시지를 전해 준 유관순 열사의 리더십을 미래 통일한국의 위대한 지도자상으로 선택한 이유는 한국의 모든 지도자들 중에서 남성들이 존경받는 인물의 대다수를 점하고 있음에도 불구하고 유관순 열사가 대표적인 여성으로 주목받고 있기 때문이다. 또한 미래 통일한국에서 본격적으로 여성지도자의 역할과 권위를 행사하는 데는 많은 저항이 존재하고 현재 여성의 정치적 역할이 원천적으로 봉쇄되거나 진입장벽이 있는 상황에서 강한 권위를 행사하는 여성 지도자들의 역할을 기대하기 때문이다. 무엇보다 미래 통일한국에서는 여성의 사회적 역할 뿐만 아니라 정치적 역할이 중요해질 것이기 때문에 여성 지도자에 대한 보다 객관적이고 체계적인 학문적 논의가 필요하다고 할 수 있다. 특히 여성 지도자들에 대한 부정적 대중담론이 한국사회에서 지속적으로 재생산되는 것을 사전에 차단하고, 이는 결국 여성의 정치적 능력 전반에 대하여 흔히 내려지는 부정적인 평가(미신적, 비이성적, 감성적, 리더십 부재, 카리스마 부재 등)와도 직간접적으로 관련되기에 이에 대한 보다 균형 잡힌 시각이 절실히 요구되기 때문이다. 더 나아가 본 논문에서는 위에서 언급한 유관순 열사의 리더십을 역사상 위대한 여성지도자들과의 비교대상으로 삼아 벤치마킹함으로써 위대한 지도자상을 구현하기 위해 노력하였다. 이러한 분석과 노력은 여전히 가부장적인 한국의 정치문화 속에서 여성들이 의식적이던 무의식적이던 어떠한 다양한 방법을 동원하여 기존의 남성 중심의 위계질서적 구조를 넘어 자신의 독자적인 정치적 영역을 구축해야 할 것인가도 암시하고 고찰하기 위함이었다.

Great Female leaders are not hold in high esteem in Korean society in general. Especially, those women who established independent community organizations exerting strong charismatic authority are often judged by mainstream societies "deviated" or "heretical", while it not seldom happens that their "criminal" activities are "revealed" via mass media. Even within academic circle these women didn't draw much attention and accordingly, they were not evaluated properly in terms of their socio-cultural role as well as religious creativity. Furthermore, it is not analysed yet in depth, how these Korean women who form a very small minority comparing to male leaders, build up their charismatic leadership. YuGwanSun leadership was one of the main fundamentals for development of woman leadership in Korea in the past. However, growth of woman leadership is slowed down noticeably and that becomes a serious issue in every sector today. This study is to find the challenges that the woman leaderships in Korea are currently facing and suggest ways to overcome them as part of effort to pursue more effective and overarching leadership. This study is about promoting growth of woman leaderships in future unified Korea by encouraging more active engagement of great female leaders in Korea activities which have been mainly dominated by male leaders. Today's society, however, greatly demands female leadership and organizations across the society are positively viewing woman leadership as women are easily adjusting themselves to the organization and the organization culture without difficulty.

손승휘의 한련화는 역사적 인물 ‘유관순’의 일대기를 다룬 역사소설이다. 이 소설은 독립운동가로서의 유관순이라는, 일반화된 표상을 바꿔보려 했다는 점에서 주목을 요한다. 영웅인물의 이데올로기를 강조하기보다는 흔들리는 주체성을 가진 주인공을 형상화한다. 이렇게 형상화된 인물은 역사적 인물로서 ‘유관순’이라는 표상을 지우고 ‘어려운 현실’을 극복하며 살아내는 ‘한 여성 인물’로 전이되어 폭넓은 공감대를 형성한다. 하지만 현대화된 독자들에게 ‘유관순’이라는 역사적 인물과 역사를 새로운 방식으로 전달하기 위해서는 섬세한 인물형상화 차원에서만 머무를 것이 아니라, 역사에 대한 총체적인 인식과 주제의식이 뒷받침되어야 할 것이다.

Son Seung-hwi's Hanryeonhwa(Nasturtium) is historical novel about Yu Gwan-sun's life story. This novel is noted about her generalized persona than independence activist. And this novel illustrated that a main character has jiggly identity than ideology of a heroic character. This symbolized character shows that overcame the 'harsh realities' than embodied independence activist Yu Gwan-sun. Accordingly, this novel forms broad sympathies. Therefore I think that this novel is especially worthy of notice. But, this novel does not convey description of delicate character for historical person and history, because does not show about overall recognition on the history and thematic consciousness.

The important stride toward a more democratized criminal justice system is citizens’ participation in criminal trials. As a accomplishment of the stride, the system adopted a modified jury system in criminal trial through enacting the Act on Citizen Participation in Criminal Trial in 2007. However, the practice of pilot project revealed that the system does not fully fulfill the promise to enhance transparency and fairness in criminal trial through participation of citizen in the procedures. The initial problem is that the jury trial has not been opened to the extent of what people expects. In order to vitalize the jury trial, it would be better practice that cases in certain criminal categories should be subject to jury trial in priority, in which the defendant may request bench trial to court. The current jury trial has another hinderance in terms of quality which warrants meaningful participation of citizen. Unanimous verdicts should not be overruled by professional judges, though a verdict made by simple majority can be overruled by professional reasoning. In addition, the procedure for decisions of guilt and imposition of sentence should be bifurcated, at least in capital trial. Without jury participation, if the appellate court reviews the case, it would be a totally new trial which does not consider the jury’s deliberation and opinion made in the former trial. Therefore, there should be reasonal limit to the court review in appellate stage composed of only judge.
