We apply Hardin (1968) ideas of “commons” to the study of nuclear energy use in China, Korea, and Japan in Northeast Asia. In particular, we pay an attention to the transboundary risk externality that a country’s nuclear power plants bring to neighboring countries. We argue that under incomplete property rights (liability rules) for nuclear accidents, countries in the region tend to over-develop nuclear power or over-operate power plants. We investigate how European countries have cooperated in developing institutions as a solution to the nuclear tragedy of the commons and why Northeast Asian countries have failed to do so. Based on the findings, we suggest some cooperative institutions that China, Korea, and Japan can build up for nuclear energy safety in the region.

Purpose : The research objective of this paper is to conduct a comparative analysis of the Rotterdam Rules and the Chinese Maritime Law regarding the liability of the carrier for delivery delays in maritime transportation of goods and the question of who bears the burden of proof. Additionally, the study aims to identify the differences between the Rotterdam Rules and the Chinese Maritime Law based on this comparative research and provide legal implications accordingly. Research design, data, methodology : In order to achieve the purposes of the study, it executes a comparative study of the rules as to the carrier’s liability for delay in delivery of cargo and the burden of proof under the Rotterdam Rules and the Chinese Maritime Law. The basic question for this comparative study is placed on whether a solution from one jurisdiction is more logical than the others and to what extent each jurisdiction has responded to protect the reasonable expectations of the parties in the rules as to the liability of the carrier for delivery delays. Results : After making a mutual comparative study of the Rotterdam Rules and the regulations on delayed delivery in China's maritime law, the paper tries to draw some implications regarding the direction of revision or correct interpretation of China's maritime law in case of differences. Conclusions : The Chinese Maritime Law makes us puzzle over the meaning of "cases within a clearly stipulated time" for the carrier’s liability for delayed delivery and its burden of proof. It is suggested that the relevant regulations will need to be revised in order to reduce the controversy over the liability of the carrier for delayed delivery.

Rushing back home for a funeral is an integral part of Chinese funeral etiquette. There is no conclusive consensus on whether the expenses incurred by funeral--arrangers should be recognized as a statutory item in death damage compensation. In 2023, China's Compilation of Judicial Interpretations on Infringement (Draft for Commments) groundbreakingly supported the compensation for funeral-rushing expenses. However, the current compensation system for funeral-rushing expenses has defects such as logical inconsistency and normative conflicts, leading to chaos in judicial practice. The root cause of these problems lies in the lack of theoretical research and model exploration of funeral-rushing expenses. They belong to pure economic loss in death damage compensation. Handling funeral affairs is a traditional and good social custom in China, and compensating for funeral-rushing expenses will not trigger the problem of infinite expansion of pure economic losses, so compensation should be allowed. Compared with the narrow-sense funeral expenses that emphasize on focusing on the deceased's remains, funeral-rushing expenses are the prerequisite for taking care of the remains, emphasizing the cost of relatives' participation, and should fall within the category of broad-sense funeral expenses. Referring to the development process of personal death compensation items such as the living expenses for dependents and narrow-sense funeral expenses, funeral-rushing expenses should be incorporated into judicial interpretations and laws on the basis of case-by-case recognition. Extraterritorially, although South Korea and Japan generally recognize reasonable compensation for direct funeral expenses, they have not yet developed an independent regulatory system for economic losses caused by relatives' funeral attendance. In contrast, the construction of the compensation rules for relatives' participation costs by Chinese law has stronger local rationality and institutional foresight. Regarding the basis of the right to claim for funeral-rushing expenses, compared with the subrogation right emphasized in Paragraph 2, Article 1181 of the the Civil Code of the People's Republic of China, funeral-rushing expenses should be included in the “funeral expenses and other expenses” stipulated in Article 1179 of the Civil Code. Due to the strong identity attribute of funeral activities, the subject with the right to claim for funeral-rushing expenses should be limited to the close relatives as defined in Paragraph 2, Article 1045 of the Civil Code. When refining the compensation rules for funeral-rushing expenses, the compensation scope should be limited to transportation costs, accommodation fees, and loss of work income. The catch-all provisions in the second sentence of Article 1181 of the Civil Code should be interpreted as “other reasonable expenses”. For the calculation standard of funeral-rushing expenses compensation, the differential compensation method within a reasonable range should be adopted to improve and unify the judicial application of it.

We examine the optimal liability rule in accidents involving fully autonomous vehicles. In cases where enforcing due activity is not feasible, it is socially optimal to apply the strict liability rule to the human operator determining the activity level and to apply the negligence rule to the manufacturer and the victim who select care levels under contributory or comparative negligence in the unilateral activity case. Under the joint and several liability rule, both the manufacturer and the victim exercise due care, contingent on regulating the manufacturer’s liability share sufficiently high, and the human operator assuming the remaining risks chooses the socially optimal activity level maximizing the social net benefit. Conversely, if due activity enforcement is possible, an alternative liability rule proves optimal. Under this rule, the human operator engages in efficient activity to comply with the activity standard, the manufacturer exercises efficient care to meet the care standard, and the victim assumes residual liability so as to be induced to take efficient care. Notably, this liability rule achieves the social optimum, even in bilateral activity cases where both the human operator and the victim engage in activity. Our results diverge from previous findings suggesting that achieving the social optimum involves using public sanctions, such as paying a fine to the state.

Prospectus liability stipulated in Article 125 of Korea’s Financial Investment Services and Capital Markets Act (“KCMA”) is one of the regulatory provisions for securing the effectiveness of disclosure regulation regarding securities offerings. However, it is uncertain which law should govern cases in which the issuer is a foreign company and/or the securities are offered to the public in a foreign capital market and whether Article 125 of the KCMA should be applied to these cases. Article 2 of the KCMA is an extraterritorial application clause based on the effects principle, but the clause cannot be applied uniformly to administrative regulation, criminal punishment, and civil liability. Administrative regulation provisions take the territoriality principle as a starting point and expand the scope of extraterritorial application through the effects principle, and criminal punishment provisions take both the territoriality principle and the nationality principle and delimit the scope of extraterritorial application through the effects principle. With respect to Article 125 of the KCMA, the effects principle does not function significantly, since the law applicable to prospectus liability should be determined in accordance with the rules of private international law. If the place of occurrence of the tortious event incurring pure economic loss is determined unitarily as the place where the market is located, and the term “an effect on Korea” in Article 2 of the KCMA is interpreted reasonably, the effects principle only has the meaning of confirming the results of designating the applicable law according to the rules of private international law. As such, the supplementary function of Article 2 of the KCMA as a special choice-of-law rule is rather restrictive.

Remington Arms Co. 사건, Decker v.

From the perspective of law & economics, the two principles of remedies for violation of legal rights are ‘Property rule’ and ‘Liability rule’. The remedies of property rule are injunctions and the remedies of liability rule are compensatory money damages. Patent rights - one of intellectual property rights as exclusive rights - are protected by property rule. According to traditional property rules, the appropriate relief for patent infringements has been considered an injunction, barring the use of the invention at issue. But, the cases that injunctions for patent uses hamper subsequent innovations and technology development have occurred. Under these circumstances, it is necessary to discuss the unappreciated but significant aspect of the debate over property rules and liability rules in patent law context. In particular, technology informations of a patent, in essence, have the same characteristics as public goods (non-rivalry & non-excludability) and legally have been given excludability, eventually become to have the characteristics of natural monopoly goods. Therefore, allowing those who have paid or have intention to pay royalty for patents to use the patents would promote the efficient use of them. In other words, liability rules as the remedies for patent infringement should be considered. Also, the transaction costs of patent market are high due to the uncertainty of valuation, complexity of the commercialization processes, unclearness of rights range and the fact that it involves multiple parties. If there are obstacles of negotiation the same as high transaction costs, the more efficient remedies are compensatory money damages. In contrast, if transaction costs are low and there are few obstacles to negotiation, the more efficient remedies are injunctions against the defendant’s interference with plaintiff’s property. Therefore, the more efficient remedies for patent infringements are compensatory money damages according to the liability rule. Recently, US Supreme Court has also given limitations on the routine award of injunctive relief. If liability rule is provided for patent infringements, subsequent development of technology will be possible without complex negotiation processes and without having concerns of infringement.

The European Union(EU)’s liability system which could be applied against environmental damage caused by contained use, intentional introduction to environment and marketing of genetically modified organisms(GMO) adopted administrative approach, civil liability and fault-based liability as fundamental principles for the prevention and remedy of environmental damage. The EU’s liability system recognized government authority’s discretion to take precautionary preventive measures. Thus, it established an effective policy instrument for human health and environment protection by allowing the authority to take speedy preventive and remedial measures against damage and the threat of damage caused by transboundary movement of GMO. The EU’s liability system on the base of the ‘Directive 2004/35’ reflected properly EU’s position at the Meetings of Working Group and the Conference of Parties of Biosafety Protocol to adopt international rules on liability and redress for damage resulting from transboundary movement of living modified organisms(LMO). At the international conference on LMO liability, EU contended consistently that LMO liability rules should be applied only against environmental damage; civil liability of operators should be adopted without recognizing state liability; guidelines respecting government’s discretion should be adopted rather than legally binding agreement. The EU’s position has been supported by developed countries including food-exporting parties and Japan. However, food-importing developing countries contended strongly that LMO liability rules should be applied against injury to human health, environmental damage, and traditional damage as well; residual state liability along with civil liability should be recognized; legally binding agreement should be adopted rather than guidelines not legally binding; strict liability should be adopted irrespective of fault or negligence by operator. Thus, it seems very difficult for the parties of the Protocol to adopt international rules on LMO liability, because of the conflicting positions between developing and developed countries. As a party of the Protocol and a net food-importing country, the Republic of Korea should do her best diplomatic efforts in making an agreement between developing and developed countries, with a view to adopting international rules on LMO liability which can maintain an appropriate balance between human health and environment protection interests, and bioindustry development interests, through preventing and remedying effectively human and environmental damage caused by transboundary movement of LMO products, and adopting reasonable policy objectives which can preserve biodiversity and develop sound bioindustry taking a good account of biosafety.

III.
Traditionally there have been two civil liabilities. One is contract liability based on contracting parties’ promises. The other is tort liability based on non-contractual liability. The artificial intelligence has played a major role in the 4th Industrial Revolution. Every technology has value-neutrality. However, there would be good or not good effects depending on how the technology would be used. Who would be liable for damages caused by artificial intelligence? To answer this question, we need to study who could be liable and what would be liable for. In other words, the question would be this: “Who should be liable for tort liability?” If we ask more concretely, there would be two questions. One is “natural persons would be liable for damages caused by artificial intelligence?” Or, the other is “artificial intelligence should be liable for these damages?” This author attempts to find answers for these questions in this article. In II, this author studies tort liability of natural persons. In III, this author explains tort liability of artificial intelligence. In V. this author examines tort liability rules based on Artificial Intelligence. In VI, this author summaries what he has studies and proposes that only natural persons should be liable for damages caused by artificial intelligence in present technology.

The United Nations General Assembly adopted the United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea(hereinafter referred to as "The Rotterdam Rules") on 11 December 2008. Rotterdam Rules aims to create a contemporary and uniform law providing for modern door-to-door container transport including an international sea leg. but not limited to port-to port carriage of goods. The structure of the liability regime in Rotterdam Rules are globally close to that of the Hague-Visby Rule even though it differs from that of the Hague-Visby Rules in some significant aspects. The Rotterdam Rules are very long. Therefore the Rotterdam Rules will be difficult to understand for even the skilled ship operator or owner or charterer or shipper or consignee or receiver because they are so complicated. This paper only seeks to highlight the salient features of the liability and limitation of liability regime under the Rotterdam Rules. It is expected that the harmonization and modernization of the international legal regime. coupled with the bold attempt to balance the carrier and cargo interests should lead to an overall reduction in transaction costs. increased predictability and greater commercial confidence for international business transactions.

The Hague-Visby Rules impose only two obligation and liability upon the shipper in relation to information for the contract particulars and dangerous cargo. As the container transportation has increased sharply, the cargo accident also increased. It was because the carrier could not find out the content of the cargo stowed in the container. The explosion case of M/V Hyundai Fortune was one of good example. Without giving proper notice of the cargo loaded in the container, the safe carriage is not secured by the carrier. The new Rotterdam Rules impose several new obligation upon the shipper. The shipper should provide cargo ready for carriage to the carrier. In addition, the shipper should provide information for proper handling of the cargo to the carrier. The shipper is liable for the cargo damages caused by the breach of the obligation of the shipper. If the shipper breach the obligation to provide information for compilation of contract particulars, and of informing the carrier of the dangerous nature or character of the goods, the shipper is strictly liable for the damages. The derogation from these obligation and liability is not allowed under the Rotterdam Rules, which is different from that of the Hague-Visby Rules and Korean Commercial Code. The obligation of the shipper under the Rotterdam Rules are more balanced than in the Hague-Visby Rules.

This comparative study examines major issues of the right and liability of carrier in international transport conventions such as Hague Rules, Hague-Visby Rules, Hamburg Rules and Rotterdam Rules. And this study reviews Korean Maritime Law concerning the liability of carrier to suggest some ideas for the materials for the revision of Korean Maritime Law in near future. The Rotterdam Rules, by way of providing for in details and in a practical way the allocation of burden of proof respectively to the cargo claimant and the carrier, have constructed a new structure of the basis of liability for the carrier. The Rotterdam Rules are much longer than either the Hague-Visby or Hamburg Rules, and address a wide variety of interests and objectives. The Rotterdam Rules also contain extensive provisions in respect of electronic transport documents. The high amount of limits of carrier's liability may be the major issue for every nations to endorse this Rotterdam Rules. Rotterdam Rules modernize existing conventions on the issue of liability and establish a balance between the interests of the shipping industry and shippers. Ever present was the fact existing conventions fail to meet current transport requirements, or at least have not managed to garner acceptance by the international community.

Rotterdam rules established to unify, modernize, and clarify the current rules and principles of international marine transportation. This paper provides the liability of marine carrier in Rotterdam rules compared with Hague-Visby rules, Hamburg rules, and Korean Maritime Law about scope of application of the rules, period of responsibility of the carrier, and Basis of liability and limits of liability of the carrier. First of all, Rotterdam rules cover the entire period of actual custody by the contractual carrier, and the liability provisions of Rotterdam rules extend all legs and modes of transportation used to perform the contract of door-to-door carriage. Secondly, the obligations of the carrier are to deliver the goods at destination, to properly care for the cargo, and to use continuously due diligence to provide a seaworthy vessel. As to the breach of the obligations, the carrier must be liable for the damages based on fault. Rotterdam rules also provide specific exceptions such as Hague rules. The exception of “error in navigation”, however, was deleted, and the fire exception was limited to the maritime leg and only in case where the fire was on the ship. Finally, under Rotterdam rules, the limitation amount is 835 SDR per package and 2.5 SDR per kilogram. These figures are higher than that of Korean provisions so that it might be burden on korean marine carriers.

The provisions in the CISG on the conformity of goods to the sales contract are included in Article 35. Unlike the CISG, the UNIDROIT Principles and the PECL cover not only sales contracts, but also other types of contracts. In Article 7.1.1. of the UNIDROIT Principles, non-performance is defined as a failure by a party to perform any of its obligations under the contract, including defective performance or late performance. The same approach is taken in PECL, see Article 8:101. Although the UNIDROIT Principles and the PECL do not have any rules which directly resemble CISG Article 35, several articles may be used to interpret or supplement the said article. In the following paragraphs, it will be analyzed in which manner articles in the UNIDROIT Principles and the PECL may be used to interpret or supplement the different parts of CISG Article 35. According to Article 35(1) of CISG, the seller must deliver goods which are of the quantity, quality and description required by the contract and which are contained or packaged in the manner required by the contract. As mentioned above, the primary role of the contract is also emphasized in the UNIDROIT Principles Article 7.1.1 and the PECL Article 8:101. Article 5.1.6 of the UNIDROIT Principles provides that is where the quality of performance is neither fixed by, nor determinable from, the contract a party is bound to render a performance of a quality that is reasonable and not less than average in the circumstances. The relevance of this article in the interpretation of CISG article 35(2)(a) is supported by the illustration used in the comment to performance of average quality, which involves the sale of goods. Performance of a quality that is reasonable, the purpose of a reasonableness test is, that a party should not be able to perform what would be an average quality in the buyers market, if this quality is most unsatisfactory in the market of the seller.

The Rotterdam Rules provide that port terminal operator may avoid or limit their liability for cargo loss, damage or delay in delivery or breach of any other obligation under the Rules by invoking the provisions that may provide a defence for, or limit the liability of, the carrier. Consequently the port terminal operator who are involved in the provision of maritime services may avoid or limit their liability for cargo loss, damage or delay in delivery or breach of any other obligation under the Rules. The port terminal operator to be applied for the Himalaya clause under the Rules must show that it has the requisite link with a Contracting State. In addition, the port terminal operator performs service to the period of time between the arrival of the goods at the port of loading and their departure from the port of discharge. The port terminal operator's liability for breaches of its obligation is limited to 875 SDR per package or other shipping units, or 3 SDR per kilogram of the gross weight of the goods. In addition, compensation for delay shall be limited to an amount equivalent to two and one-half times the fright payable on the goods delayed.

The Rotterdam Rules designed the documentary shipper system. The Rotterdam Rules define the shipper as the contractual counterpart of the carrier and acknowledges that sometimes the bill of lading must be issued to another person. The conditions for such issue to another person are that the contractual shipper must so consent and the other person must be named as a shipper in the document and must accept to be so named. This article studies the documentary shipper system in the main aspects: the documentary shipper is subject to the obligations and liabilities imposed on the (contractual) shipper and is entitled to the (contractual) shipper’s rights and defences. Through the study on these questions and with reference to the maritime laws of Korean Commercial Code and so on, it is believed that this documentary shipper system is flawed. As on one hand, it can not go smoothly along with sales laws and thus can not well protect the sellers under FOB contract especially; on the other hand, its negligence on some transportation practices makes it less practicable. This article makes some remedies over the documentary shipper system, and believes the documentary shipper should have the right to ask for transport document on delivery of the cargo without having to have anyone else’s instructions, he should be the first to own the right of control over the cargo and he should have the right to sue. The amended documentary shipper system not only fits into the sales law, and make the seller’s right of stoppage in transitu practicable, and it goes along well with seaway transport practices. As the Rotterdam Rules won’t be in force in the short term, this article hopes that it may help a little when our maritime law is amended.

Before the conclusion of Hague Rule, carrier's liability was the liability regime of the Common Law. But Carriers inserted whatever exemption clauses by virtue of the principle of freedom of contract. To remove the excess exemption clauses relieving the liability with respect to cargo owner of carrier, the rules of Carrier's liability in the carriage of goods by sea was provided. These are Harter Act(1893), Hague rule(1924), Hague-Visby rule(1968) and Hamburg rule(1978). These rules prohibited that the B/L was inserted in clauses relieving and lessening carrier's liability in the carriage of goods by sea. But clauses in B/L included in the various void clause relieving and lessening carrier's liability according to the rules of carrier's liability in the carriage of goods by sea. Therefore, carriers make reference to cases, must check up closely and stipulate for exemption clauses.
