사형집행이 이루어지지 않는 현실은 사형확정자 수의 증가를 수반하고 있다. 사 형관련 쟁점들에 대한 적지 않은 연구가 있지만, 사형확정자 처우에 관하여 교도관 의 시각에서 연구된 것은 거의 없다고 할 수 있다. 따라서, 본 연구에서는 늘어나는 사형확정자 처우를 어떻게 해야 하는가라는 아직 이론적으로 답변되지 않는 질문을 다시 탐색하기로 한다. 이를 위해 미국의 사형수 개혁경험을 참고하고, 교정시설 내 사형확정자 처우현황과 성문법 규정 그리고 통합전략을 살펴보기로 한다. 통합전략 은 복잡한 사형확정자 관리에 있어 유일하고 완전한 해결책은 될 수 없지만, 전략 의 유지와 평가를 거치면 효율적인 대안이 될 수 있다고 본다.

The number of death-sentenced inmates in prisons has continued to increase steadily in recent years because of a trend of reluctance to perform executions. Although a substantial body of literature has emerged on a variety of capital punishment issues, little has been written about the challenges faced by correction officers in managing death-sentenced inmates in the prison environment. This paper explores the issues and realities of managing "death row" populations. It then sketches US experiences in integrating death-sentenced inmates into the mainstream inmate general pupulation. In this paper, we revisit the as yet unanswered question ; namely, how corrections administrators might manage a growing number of inmates sentenced to death. We briefly discuss current practices, statutes and integration strategy for managing death-sentenced inmates in prisons. Integration will not be the complete answer to all of the complex problems inherent in managing capital punishment inmates. Effective adjustments will be made as the program has matured and its viability continues to be assessed.
