‘회복적 사법(Restorative Justice)’은 1974년 캐나다에서 시작되어 오늘날 서구는 물론 아시아와 아프리카에 이르기 까지 널리 시행되고 있다. 우리나라는 2000년대 들어 각 형사사법 단계마다 시범적 수준에서 시행되기 시작했으며 그 중 검찰 단계 형사조정제도는 형사사법의 일환으로 점차 자리를 잡아가기에 이르렀다. 외국의 경우 교정단계에서 적용되고 있는 회복적사법의 유형으로는 피해 공감·배상·대화·갈등조정·지역사회 프로그램 등 다양하게 적용되고 있다. 우리나라에서는 2006년 법무부 업무방침으로‘회복적 교정’추진을 공식화 하고 수형자 작업장려금 범죄피해자 보호단체 기부 등 배상프로그램을 시행하고 있으며 몇몇 공감프로그램을 시범 시도하고 있다. 특히, 교화 라디오방송을 통해 수용자의 사과편지를 회복적 사법 조정인의 상담 형식으로 방송한 것은 우리나라만의 특이한 시도였다. 본 연구는 회복적 교정 사례에 대하여 외국의 경우 문헌자료를 고찰하였으며, 국내의 경우 교정시설 적용 시행 사례를 소개하였다. 국내 진행상황을 고려하여 앞으로 회복적 교정 전문 조정인 양성, 피해자 치유프로그램을 통한 공감프로그램 자원봉사자 확보가 필요하며, 가석방 확대와 석방 후 중간처우의 집을 통한 회복적 교정 프로그램 운영, 아동성폭력사범 출소자의 재범예방을 위한 한국형 후원과 책임의 모임 출범을 지원할 필요가 있음을 피력하였다. 또한 법무부에 교정과 보호 단계를 아우르는‘회복적 교정·보호 운영위원회’구성을 제안하였다.

After being introduced to Korea in the early 1990s, Restorative Justice stirred up various discussion and controversy in the 2000s. While it was test-operated on the criminal stages, the criminal mediation system has stably been settled as a part of criminal justice in the sphere of prosecution. Korean Ministry of Justice officially included the implementation of Restorative Justice on the correctional policy for the year 2006. As part of the broad meanings of Restorative Correctional Programmes, such as Recovering Voluntary Service for the Community, Donating Prisoners' Wage to the Organization for the Protection of Criminal Victims, and 'Sycamore Tree Project' are running in correctional facilities nationwide. Especially Korea Correctional Service is operating a broadcasting station for the rehabilitation of offenders, which is unprecedented abroad. There is a radio show named 'Confession' which after receiving apology letters from offenders a couple of experts are talking about it.
