본 연구는 18~19세기 조선 노비-주인 관계의 생활사 자료를 분석하여 현대 AI 윤리에 새로운 해석 틀을 제시하고자 한다. 핵심 자료는 평산 신씨 신현(申絢, 1764~1827)이 남긴 600여 통의 간찰과 일록이며, 『경국대전』, 『조선왕조실록』, 『추쇄도감의궤』 등을 대조 자료로 삼는다. 조선의 노비는 매매⋅상속되는 재산이면서 자의식을 지닌 인간이라는 이중적 존재였으며, 본고는 이 회색지대적 위상이 소프트웨어이면서 지능체로 기능하는 AI의 존재론적 위상과 구조적으로 공명함에 주목한다. 다만 양자의 본질적 차이를 전제하여 유비를 존재론⋅기능관리⋅규범의 3층위로 한정하고, 가서의 예속 인물을 노비⋅겸인⋅장인 등으로 구별하여 분석 대상을 노비에 엄밀히 제한한다. 본고는 신뢰 관계를 작동과 균열의 양면으로 파악하여, 기능적 의존⋅정보 비대칭⋅정서적 유대가 도망⋅태업⋅오류와 같은 균열로 전환되는 양상을 AI의 정렬, 환각, 주인-대리인 문제와 접목한다. 또한 진짜 병과 꾀병, 악의와 과실을 가려 제재를 차등화한 신현의 안목을 불완전한 대리자 관리의 실무 지혜로 해석하고, ‘심복(心腹)’ 개념을 서구 확장된 마음 이론을 보완하는 ‘확장된 심복’으로 재구성한다. 나아가 추쇄도감과 비총법의 경험은 강한 일률 규제의 한계를 보여주며, 신현의 전략적 방임과 유교적 수기치인은 AI 시대의 위험 기반 거버넌스와 사용자 윤리를 사유하는 역사적 자원이 된다. 본 연구는 노비제를 정당화하지 않으며, ‘불완전한 타자에 대한 의존과 관리’라는 구조적 유사성에 한정하여 비교사적 유비를 시도한다.

This study analyzes micro-historical materials on nobi-master relationships in late Joseon Korea to propose a new interpretive framework for contemporary AI ethics. Its primary sources are approximately 600 letters and related diary materials left by Sin Hyeon 申絢, 17641827, of the Pyeongsan Sin clan, supplemented by legal and institutional sources such as the Gyeongguk Daejeon, the Joseon Wangjo Sillok, and the Chuswaedogam Uigwe. Joseon-era nobi occupied a “gray zone” they were legally transferable property, yet also self-aware human beings embedded in household, emotional, and practical relations. This dual status structurally resonates with the ontological ambiguity of AI, which is technically software yet functions as an intelligent agent. The comparison, however, is strictly limited. This paper distinguishes three levels of analogyontology, functional management, and normativityand carefully separates nobi from other dependent or hired figures in Sin Hyeon's household, such as gyeomin retainers, artisans, hired laborers, and local clerks. Within this framework, the paper reads trust in nobi-master relations as a double structure of operation and fracture. Functional dependence, information asymmetry, and emotional bonding could sustain household management, but they could also turn into escape, idleness, error, and distrust. These dynamics are placed in dialogue with AI ethics concepts such as alignment, hallucination, and the principal-agent problem. The paper further interprets Sin Hyeon's differentiated judgmentsdistinguishing real illness from feigned illness, and malice from erroras practical wisdom for managing imperfect agents. The concept of simbok 心腹 is reconstructed as “extended simbok”, a relational and embodied supplement to the Western theory of the extended mind. Finally, the institutional transition from the Chuswaedogam to the bichong system is read as a historical lesson on the limits of uniform strong regulation, while Confucian sugi-chiin 修己治人 offers a resource for rethinking user ethics in the age of AI. This study does not justify the historical institution of slavery; rather, it confines its comparison to the structural problem of human dependence on imperfect others that cannot be fully controlled.

The purpose of this study is to contribute to enhancing the sustainability of international development cooperation projects. Notably, this study suggests ways to strengthen the sustainability of agricultural cooperation projects by adjusting a principal-agent relationship, which has been restricted to the project cycle. To do so, it describes the agricultural technology dissemination projects in Africa and evaluates them through in-depth interviews with the final beneficiaries in Malawi and Zimbabwe. As a result, the target group was observed to ameliorate the principal-agent problem. The participants had begun to act directly as principals of the development project using a resident-driven or government-led method. This research proposes that the activities and effectiveness of international cooperation projects could continue by changing the role of participants into principals of the project at the end of the project.

저작권 신탁관리단체는 집단적 권리관리와 포괄적 라이선싱을 통해 저작권 시장의 거래비용을 절감하고 이용 활성화를 도모하는 핵심적 제도이다. 그러나 위탁형조직 구조와 사실상 독점적 지위로 인해 내부적으로 전형적인 주인-대리인 문제(principal-agent problem)가 발생하기 용이한 구조적 특성을 지닌다. 우리나라의경우 특히 포괄적 관리를 신탁관리단체만 수행할 수 있도록 법적으로 규정하고, 과거 한 분야에 하나의 신탁관리단체만을 허용함으로써, 원래 자연적 독점이 형성되기 쉬운 시장 환경에서 실질적으로 법적 독점 구조가 형성될 수 있는 제도적 조건이마련되었다. 그 결과 주요 신탁관리단체는 저작권 관리의 양면시장에서 장기간 독점적 지위를 유지하여 왔다. 이와 같은 구조 하에서 권리의 주체인 저작권자들은 그들의대리인인 경영진이 비효율적이거나 방만한 경영 또는 자기거래나 이해관계 충돌이있는 행위나 의사결정을 하더라도 현실적인 대체 관리수단이 부재하다는 점에서이를 효과적으로 견제하기 어려웠고, 결과적으로 대리인 문제가 구조적으로 심화될가능성이 높아졌다. 나아가 대리인 문제의 내부 통제 장치로 기능하여야 할 총회 역시 그 권한과 기능이 축소되고, 참여권과 의결권이 제한적으로 부여되는 구조를 보이고 있다. 그럼에도 불구하고 제도 설계와 실무에서는 회원총회라는 형식적 최고 의사결정 기구의 절차를 거쳤다는 점만으로 신탁관리단체의 행위와 의사결정이 민주적 정당성과 자율성을 확보한 것으로 간주하는 경향이 지속되어 왔다. 본 논문은 이러한 현상을 ‘총회워싱’으로 개념화한다. ‘그린워싱’(greenwashing) 개념과 유사하게, 총회워싱이란, 구성원들의 의사를 직접적으로 반영하기 위한 집단 적 의사결정 장치로서의 총회가 정관상 대다수 회원이 참여할 수 없는 구조로 설계되 어 민주적 정당성이 결여되고 내부감시 기능이 실질적으로 작동하지 않음에도 불구 하고, 총회 승인을 얻었다는 이유로 해당 행위나 의사결정에 표면적으로 정당성이 부여되는 현상을 의미한다. 본 논문은 저작권 신탁관리단체의 제도적 특성, 정보 비대칭, 정관상 회원의 참여 제한, 이사회의 전유화, 회원의 합리적 무관심과 안건 형성의 집중화가 결합될 경우 총회가 회원의 실질적인 의사결정 및 내부 감독을 통해 대리인 문제를 통제하는 장치로 기능하기보다, 오히려 집행부의 방만한 경영이 나 도덕적 해이를 사후적으로 승인하는 절차로 변질될 수 있음을 분석한다. 아울러 총회 의결이 사법적⋅행정적 심사 과정에서 관리단체 의사결정의 정당성을 뒷받침 하는 근거로 작동하는 구조에 주목하여, 총회워싱이 내부 거버넌스의 왜곡에 그치지 않고 외부 통제의 실효성에도 영향을 미칠 수 있음을 지적한다. 본 논문은 우리보다 앞서 유사한 문제를 경험한 유럽연합의 집중관리지침과 프랑 스 지식재산권법, 그리고 프랑스의 대표적 저작권 집중관리단체인 SACEM의 정관을 중심으로 비교법적 고찰을 수행하고 이들 법제가 총회의 존재 자체를 민주적 정당성 의 자동적 근거로 전제하기보다, 총회가 실질적인 내부 통제 장치로 기능하기 위한 제도적 조건을 사전에 설정하고 있음을 밝힌다. 나아가 이러한 비교법적 분석을 토대로 총회 구성의 대표성 확보, 회원 참여의 실질화, 의결권과 위임권의 공정성, 총회 권한의 명확화, 그리고 정보 공개의 제도화를 포함하 ...

Copyright collective management organizations (CMOs) constitute a core institutional mechanism that reduces transaction costs in the copyright market and promotes the use of works through collective rights management and blanket licensing. However, due to their entrusted organizational structure and de facto monopolistic position, CMOs are structurally prone to the classic principal?agent problem. In Korea, in particular, the law mandates that comprehensive rights management be carried out only by trust-based CMOs, and historically allowed only one CMO per sector. This institutional design effectively fostered a legal monopoly in a market already susceptible to natural monopoly. As a result, major CMOs have long maintained a dominant position in the two-sided market for copyright management. Under such conditions, copyright holders, as principals, face significant difficulties in effectively disciplining managerial agents, even where inefficient management, self-dealing, or conflicts of interest arise, because realistic alternative management options are lacking. Consequently, the principal? agent problem is likely to be structurally intensified. Moreover, the general assembly, which should function as an internal control mechanism for mitigating agency problems, has often exhibited reduced authority and limited participation and voting rights. Nevertheless, in both institutional design and practice, there has been a persistent tendency to regard the mere observance of formal procedures of the general assembly as sufficient to confer democratic legitimacy and autonomy on the organization’s decisions and actions. This article conceptualizes this phenomenon as “General-Assembly washing.” Analogous to the notion of greenwashing, general assembly washing refers to a situation in which the general assembly, a collective decision-making body intended to directly reflect the will of members, is structurally designed-through bylaws-to exclude the majority of members from meaningful participation, thereby lacking democratic legitimacy and effective internal oversight, yet the approval of the general assembly is invoked to confer superficial legitimacy on problematic decisions or actions. The article argues that when the institutional characteristics of CMOs, information asymmetry, restrictions on member participation embedded in bylaws, board capture, members’ rational apathy, and the concentration of agenda-setting power are combined, the general assembly is liable to function not as a genuine mechanism of decision-making and internal supervision, but rather as a procedural device that ex post ratifies managerial opportunism or moral hazard. Furthermore, by examining the role of general assembly resolutions in judicial and administrative review, the study highlights that general assembly washing not only distorts internal governance but may also undermine the effectiveness of external oversight. Through a comparative legal analysis of the EU Collective Rights Management Directive, the French Intellectual Property Code, and the statutes of SACEM, a leading French CMO, this article demonstrates that these legal frameworks do not treat the mere existence of a general assembly as an automatic source of democratic legitimacy. Instead, they establish, in advance, institutional conditions under which the general assembly can operate as a substantive internal control mechanism. Building on these comparative insights, the article proposes key elements of model bylaws aimed at preventing general assembly washing, including ensuring the representativeness of the assembly, the substantive realization of member participation, fair and proportionate regulation of voting and proxy rights, clarification of the assembly’s authority, and institutionalization of information disclosure.
