본 연구는 대한민국 항공산업이 외형적 성장과 국제적 위상을 달성한 상황에서도, 항공안전 감독체계가 정책 부처 내에 위치하는 현행 구조가 갖는 제도적 한계를 검토하고, 보다 독립적인 항공안전 거버넌스 구축 가능성을 탐색하는 데 목적이 있다. 최근 발생한 항공사고와 그 대응 과정은 안전 감독체계의 작동 방식에 대한 문제의식을 제기하는 계기가 되었으나, 본 연구는 개별 사건을 일반화하기보다는 이러한 사례가 드러내는 제도적 조건과 구조적 특성을 분석하는 데 초점을 둔다. 이를 위해 ‘규제 포획(regulatory capture)’ 가능성이라는 이론적 틀을 바탕으로, FAA와 EASA 등 주요국 사례를 비교법적으로 검토하고, 우주항공청의 조직 모델을 참고하여 제도 설계의 시사점을 도출하였다. 다만 이러한 비교는 각국의 헌정 구조와 행정 환경의 차이를 전제로 한 것이며, 특정 모델의 단순한 이식을 지향하지 않는다. 연구 결과, 항공 정책 기능은 국토교통부가 담당하고, 안전 감독 및 집행 기능은 (가칭) 항공안전청이 수행하는 기능적 분리 방안을 하나의 정책 대안으로 제시하였다. 아울러 지방항공청의 전문 기능 강화, 항행 분야에서의 규제와 서비스 기능 구분, 공항 운영 구조 개편 등 단계적 거버넌스 개선 방향을 함께 검토하였다. 다만 본 연구는 제도 설계의 방향성을 제시하는 탐색적·정책지향적 연구로서, 항공안전 거버넌스와 안전성과 간의 인과관계를 정량적으로 검증하는 데에는 한계를 가진다. 따라서 향후 연구에서는 조직 구조, 규제 강도, 사고율 간의 관계에 대한 실증적 분석이 보완될 필요가 있다. 이러한 한계에도 불구하고 본 연구는 항공안전 행정의 독립성과 책임성 간의 균형을 재검토하고, 안전 중심의 거버넌스 전환 가능성을 모색하는 데 의의를 둔다.

This study examines the institutional limitations of the current aviation safety oversight system in the Republic of Korea, which remains structurally embedded within a policy-oriented ministry despite the country’s substantial growth and elevated global standing in the aviation industry. While recent aviation accidents and their subsequent responses have raised concerns regarding the functioning of the safety oversight system, this study does not seek to generalize from individual incidents. Instead, it focuses on analyzing the structural and institutional conditions revealed through such cases. Based on the theoretical framework of regulatory capture, this study conducts a comparative legal analysis of major international models, including the Federal Aviation Administration and the European Union Aviation Safety Agency, while also drawing implications from the organizational model of the Korea AeroSpace Administration. These comparisons are made with due consideration of differences in constitutional structures and administrative traditions, and do not advocate a simple institutional transplant. As a policy alternative, the study proposes a functional separation in which aviation policy responsibilities remain with the Ministry of Land, Infrastructure and Transport, while safety oversight and enforcement functions are assigned to a newly established independent aviation safety authority (tentatively named the Aviation Safety Agency). In addition, the study explores a phased governance reform roadmap, including the professionalization of regional aviation offices, the separation of regulatory and service functions in air navigation, and potential restructuring of airport management systems. This research is exploratory and policy-oriented in nature, aiming to suggest directions for institutional design rather than to establish causal relationships through quantitative analysis. Accordingly, it acknowledges limitations in empirically verifying the relationship between governance structures and safety outcomes. Future research is needed to incorporate quantitative analyses examining correlations among organizational structures, regulatory intensity, and accident rates. Despite these limitations, this study contributes to the ongoing discourse by reassessing the balance between independence and accountability in aviation safety governance and by exploring the possibility of a transition toward a safety-centered administrative paradigm.
