우리법상 간접강제 이외에 임시의 지위를 정하는 가처분의 실효성을 확보 할 수 있는 현실적인 방법이 거의 없고, 간접강제조차 법원의 소극적인 태도와 그 내재적인 한계에 의하여 채무자의 이행을 강제하는 데에는 많은 한계가 있는 것이 현실이다. 그러나 미국법에서는 법원의 명령을 위반하는 행위에 대하여 법원이 특별 한 수권 없이도 법원에 내재된 제재 권한에 의하여 채무자에게 강력하고 다양 한 제재를 가할 수 있도록 보장하고 있다. 이러한 제재는 크게 보아 법원의 명령을 위반한 채무자에게 법원 명령의 권위를 지키기 위해 형사적 재판 절차 에 의하여 사후적으로 형사처벌을 가하는 형사적 제재와 채권자의 권리를 사 전적으로 보호하기 위하여 민사적 재판 절차에 의하여 구금, 벌금 등의 수단으 로 채무자의 이행을 강제하거나 침해된 채권자의 권리를 사후적, 금전적으로 보상해주는 민사적 제재로 나눌 수 있다. 이러한 민사적 제재와 형사적 제재는 그 목적, 요건, 절차, 효과 등에서 적 지 않은 차이가 있기는 하나 모두 법원 명령의 권위를 제고하고 채권자의 권 리를 보호하는 강력한 수단이 된다는 점에서 우리법에서도 그 도입을 진지하 게 검토할 필요가 있을 것으로 생각한다.

In Korean law there is no practical means to secure the effective enforcement of preliminary injunctive orders aimed at preserving the status quo until the finality of the trial. Even though there are methods of indirect enforcement, they are limited by judicial restraint and the court's inherent power limitations. Presently, there is a limited way to secure enforcement of a preliminary judgment in order to protect the rights of the plaintiff. In the United States, a court can use contempt of court as a way to ensure enforcement of a preliminary injunction. And the court has this power inherently, without reference to any specific statute providing the court with such power. Contempt of court sanctions in the United States may consist of criminal sanctions or civil sanctions which may include detention, money penalties, and money damages as a means of securing the status quo even in the early stages of a trial. Though there is some difference between the two systems of procedure and enforcement, the sanctions found in the American court procedure are a strong and effective means for protecting the rights of the creditor and enhancing the authority of the court. From this perspective, the American sanctions regime could be adapted by the Korean courts and would be an effective measure in achieving the same goals in Korea.
