독일 연금보험법상 부분연금제도에 관한 연구 KCI 등재

본 연구는 고령 근로자의 점진적 은퇴와 고용 유지를 지원하는 독일 연금보험법상 부분연금제도의 법적 구조와 변천 과정을 분석한다. 1992년 도입된 부분연금제도는 초기에는 소득 한도 초과 규모에 따라 전부연금의 2/3, 1/2, 1/3의 형태로 연금을 삭감하는 제재적 성격이 강했으나, 2017년 유연연금법을 거쳐 2023년 조기 노령연금 수급권자의 추가소득 한도가 전면 폐지됨에 따라 수급권자의 자발적 선택에 기반한 제도로 근본적인 전환이 이루어졌다. 특히, 최근 실무에서 주목받는 99.99% 부분연금 모델은 연금 수급권자가 전액 연금의 극히 일부(0.01%)만을 의도적으로 포기함으로써 근로자 및 가족 돌봄 간병인으로서의 법적 지위를 유지하고, 질병수당, 실업급여, 가족 간병 크레딧 등 사회보험의 혜택을 유지하는 전략적 수단으로 활용되고 있다. 다만, 이러한 부분연금의 활용은 기업연금 수급 요건과의 충돌 등 노동법적 쟁점을 수반하므로 실무상 주의가 요구된다. 본 연구는 독일의 고용친화적 연금제도의 유연화 사례를 통해 획일적인 감액 구조를 유지하고 있는 한국의 재직자 노령연금 제도를 개선하고 나아가 고령자의 유연한 소득 활동을 보장하기 위한 근본적 대안으로서 독일과 같은 새로운 고용연계 연금제도 도입 필요성을 정책적 시사점으로 제시한다.

This study analyzes the legal structure and historical evolution of the partial pension (Teilrente) system under the German Pension Insurance Act, which supports the gradual retirement and employment retention of older workers. Introduced in 1992, the partial pension system initially had a strong punitive character, reducing the full pension to 2/3, 1/2, or 1/3 tiers depending on the extent to which the income limit was exceeded. However, following the Flexi-Pension Act (Flexirentengesetz) of 2017 and the complete abolition of the additional income limit (Hinzuverdienstgrenze) for early old-age pension recipients in 2023, the system has undergone a fundamental transition into one based on the voluntary choice of the beneficiary. In particular, the ‘99.99% partial pension model’, which has recently gained significant attention in practice, is utilized as a strategic tool. By intentionally forfeiting a mere fraction (0.01%) of the full pension, recipients maintain their legal status as employees or caregivers, thereby fully retaining social security benefits such as sickness benefits, unemployment benefits, and caregiving credits. Nevertheless, the utilization of such partial pensions entails labor law issues, including potential conflicts with occupational pension eligibility requirements, necessitating practical caution. Through the case of Germany’s flexibilization of its employment-friendly pension system, this study proposes policy implications for improving South Korea’s incumbent old-age pension system, which still maintains a uniform reduction structure. Furthermore, it suggests the introduction of a new employment-linked pension system, akin to the German model, as a fundamental alternative to ensure flexible income activities for the elderly.
