In the context of the globalization of the data economy, the cross-border flow of commercial data has become increasingly frequent. As the forefront window of opening up to the outside world, the Shanghai Free Trade Zone should take effective regulatory measures and establish a sound regulatory system to ensure the security, compliance, and efficiency of cross-border data flow. Based on the current situation of cross-border regulation of commercial data in the Shanghai Free Trade Zone, it can be seen that the zone actively carries out “institutional innovation” and “model innovation” in cross-border regulation of commercial data, but still faces many challenges. The national level laws and regulations have not yet formed a complete system, and data export control measures lack flexibility and are difficult to adapt to diverse needs. At the same time, the incompatibility between domestic regulatory rules and international rules further increases the complexity of cross-border data regulation. In addition, frequent data breaches have further highlighted the weak links in the regulatory system. To effectively solve the current difficulties and problems, the Shanghai Free Trade Zone should start from multiple aspects and optimize the cross-border regulatory system for commercial data. Firstly, it is necessary to further improve the cross-border regulatory framework for commercial data, providing clear and explicit legal frameworks and compliance guidelines for enterprises. Secondly, a “top-down” cross-border regulatory framework for commercial data should be established to clarify regulatory responsibilities and enhance regulatory efficiency, thereby laying a solid foundation for the cross-border flow of commercial data. In addition, the Shanghai Free Trade Zone needs to actively promote international cooperation in cross-border regulation of commercial data, establish mutual trust and recognition mechanisms, reduce compliance costs for cross-border flow of commercial data, and promote the free flow of commercial data.

데이터 경제 발전의 세계화 배경 속에서 상업 데이터의 국경 간 이동이 더욱 빈번 해지고 있다. 상하이 자유무역지대는 대외 개방의 최전선 창구로서 효과적인 규제 조 치를 취하고, 데이터의 국경 간 이동의 안전성, 준법성 및 효율성을 보장하기 위해 건전한 규제 체계를 구축해야 한다. 상하이 자유무역구의 상업 데이터 국경 간 감독 현황을 종합해보면, 상하이 자유무역구는 상업 데이터 국경 간 감독 분야에서 적극적 으로 ‘제도 혁신’과 ‘모델 혁신’을 추진하고 있지만 여전히 많은 도전에 직면해 있다. 국가 차원의 법률과 규정이 아직 완전한 체계를 형성하지 못했으며, 데이터 출국 통 제 조치가 유연성이 부족하여 다양한 요구에 적응하기 어렵다. 동시에, 국내 규제 규 칙과 국제 규칙 간의 비호환성은 데이터 국경 간 규제의 복잡성을 더욱 가중시켰다. 또한, 데이터 유출 사건이 빈번하게 발생하여 규제 체계의 취약점을 더욱 부각시켰 다. 현재 직면한 어려움과 문제를 효과적으로 해결하기 위해 상하이 자유무역지대는 여러 측면에서 접근하여 상업 데이터의 국경 간 감독 체계를 최적화해야 한다. 우선, 상업 데이터의 국경 간 규제 규칙 체계를 더욱 완비하여 기업에 명확한 법적 틀과 준수 지침을 제공해야 한다. 둘째, ‘상향식’ 상업 데이터의 국경 간 규제 구조를 구축 하고, 규제책임을 명확히 하며, 규제 효율성을 높여 상업 데이터의 국경 간 이동을 위한 견고한 보장 기반을 마련해야 한다. 또한, 상하이 자유무역지대는 상업 데이터 의 국경 간 규제 국제 협력을 적극적으로 추진해야 하며, 상호 신뢰와 상호 인정 메 커니즘을 구축하여 상업 데이터의 국경 간 이동에 대한 준수 비용을 낮추고 상업 데이터의 자유로운 이동을 촉진해야 한다.
