After the Nagoya Protocol entered into force since 2014, the users have had lots of difficulties to follow the bilateral access and benefit sharing mechanism. In order to reduce their burdens and help their compliance of the protocol, its analysis and studies on the protocol is needed. Precedent studies were focusing on the its ABS system, compliance, and comparative studies on ABS law and regulations between the Parties. This article is mainly suggesting what the users need to prepare to comply the providing countries’ ABS law and oblialtions of he Nagoya Protocol step by step. The countermeasures include all stages of utilization of the genetic resources, and thus, this article contains stages of preparation of the access, access to the genetic resources and application of the PIC, negotiation of the MAT with providers, unilization of the genetic resources and their benefit-sharing. It also adds the application of the patent stage. This article introduces specific Nagoya Protocol’s articles and related ABS laws of the Parties to enhance countermeasures’ justification when it is needed. It should be noted that strengthening reciprocal relationship between users, providers and governments is very urgent and significant, and it should be also accompanied by the government’s active supports for users in order to implement the Nagoya Protocol at the national level.

나고야의정서가 발효됨에 따라 해외의 유전자원등을 이용하는 자들은 기존에 없었던 양자 접근 및 이익 공유의 적용을 받아 많은 부담을 가지게 되었다. 이용자들의 편의를 돕고 성공적인 나고야의정서의 국내 이행을 위해서 본고에서는 이용자들의 단계별 대응방안 및 시의적절한 정부 정책 마련을 위한 제언을 하였다. 이를 위하여 우선, 국내외 유전자원 이용현황을 간략히 소개하고 나고야의정서 및 국내외 동향을 개관하였다. 이를 바탕으로 유전자원에 접근하기 이전부터 이익 공유를 실현하는 모든 단계, 즉 유전자원 제공국의 물색을 위한 접근 이전 단계에서부터 접근 하는 시점, 이익 공유를 위한 상호합의조건 계약 체결 시, 유전자원을 이용하는 단계, 그리고 특허 출원 문제와 이익 공유를 이행하는 단계를 각각 나누어 해당 단계에서의 이용자들이 주의해야할 점과 대응방안을 제시하였다. 필요한 경우에는 나고야의정서 관련 조문이나 국내외 관련법들을 소개하며 단계별 유의점 마련의 근거를 제시하고자 하였다. 마지막으로 이용자들의 적절한 대응방안 마련에는 이용자뿐만 아니라, 이용자와 제공자, 이용자와 제공국 및 이용국, 그리고 이용자와 관련 협회 등의 유기적인 연대가 무엇보다 필요하며, 정부의 적극적인 이용자 지원 정책이 수반되어져야 함을 강조하였다.
