삼한 및 삼국시대 패총과 무덤, 주거지에서 확인된 어로 도구는 어망추, 뼈로 만 든 작살, 찌르개, 낚시 바늘, 철제작살로서 함께 출토된 바다어종과 해서포유류와 밀 접한 연관이 있다. 어망추는 모양과 크기, 무게를 고려할 때 투망과 정치망으로 크게 분류되며, 잡을 수 있는 어종은 정어리, 전갱이, 고등어 등의 바다어종과 일부 담수어 종일 것이다. 뼈와 철로 만든 낚시 바늘을 통해서는 조어법이 가능하며, 관련 부속도 구들이 확인되지 않았지만 맥낚시와 찌낚시 방법을 구사하였을 것이다. 대상어종은 참 돔, 감성돔, 숭어, 방어, 다랑어, 삼치 등이며, 바늘의 크기와 형태에 따라 대상이 서 로 달랐을 것이다. 작살과 찌르개로는 해서포유류를 자루에 묶은 고정식과 분리방법으 로 강치, 고래, 돌고래 등을 잡을 것이고, 이 방법은 고도로 숙련된 기술과 대상물에 대한 사전지식을 갖추어야만 성공이 가능하므로 취락에서 전문집단의 존재를 추정할 수 있다. 유적에서 바다어종과 해서포유류를 잡는 장소는 대부분 유적 근처에 있는 내만성 바 다이며, 강치, 참돔, 삼치 및 방어, 다랑어, 청새치, 고래, 돌고래 등은 연해까지 진 출하여야 할 것이다. 이러한 동물은 회유와 회귀습성에 따라 내만으로 들어올 때 잡을 수도 있지만 어로도구와 배모양토기(船形土器), 외래계 유물이 확인되는 것을 보면 연 해까지 진출하여 적극적으로 대상어종과 해서포유류를 확보하였을 것이다. 어로계절 은 노래미, 쏨뱅이와 같은 바닥에 서식하는 어종은 연중가능하며, 나머지 어종들은 여 름~가을에 대부분 잡았을 것이며, 감성돔이나 참돔 등은 초겨울과 초봄에 크기가 매 우 큰 개체들을 잡았을 것이다. 해서포유류는 주로 단백질확보, 가죽과 기름, 생활필 수품, 의식 및 장신구제작 원료를 확보하기 위해 전문 집단이 주축이 되어 잡았을 것이 며, 전문집단의 존재는 바다와 도서가 유적 주변에 산재하고, 실제유물, 강치의 전체 골격출토, 장신구제작 등으로 추정할 수 있다. 그리고 강치의 일부부위만 확인되는 바 다 근처의 일부 유적과 바다에서 멀리 떨어져 있는 경산, 경주와 같은 내륙지역에서도 강치의 일부부위가 확인되는 점은 이 집단이 직접 강치를 잡은 것이 아니라 전문 집단 으로 물물교환방식 등의 교류방법으로 확보한 결과로 보아야 할 것이다.

The fishing implements found in the shell middens, burials and houses of the Samhan and Three Kingdoms period consist of fishing net sinkers, fish harpoons made of bone, spears, fishing needles, iron fish harpoons, and iron fishing needles, all of which are closely associated with the types of sea fish and marine mammals that have been identified in association with those implements. Fishing net sinkers can be classified, according to shape, size and weight, into those that were attached to fixed nets and those attached to thrown nets. The types of fish that could have been caught using such nets include some types of freshwater fish, and marine fish such as sardines, horse mackerel, and mackerel. Fishing needles made of bones and iron were possibly used in pole-and-line fishing and early fishing, but this cannot be known for certain as related accessory instruments have not yet been confirmed. The types of fish targeted include red sea-bream, black porgy, gray mullet, yellowtail, tuna, and spanish mackerel, etc.; the size and shape the needles used would have differed according to the type of fish targeted. Fish harpoons and spears consisted of the fixed type and detachable type and were used to catch marine mammals such as sea lions, whales, and dolphins. They could have only been successfully used when accompanied by highly drilled skill and preliminary knowledge about the targets, and therefore indicte the presence of professionals within the community. In relation to the archaeological sites, the optimum places to catch marine fish and mammals were mostly inland sea locations; sea lions, red sea-bream, spanish mackerel, yellowtails, tuna, spearfish, whales, and dolphins were caught in the coastal waters. The former could be caught in the inland sea due to their circular, returning habits, but the nature of the fishing implements, as well as the presence of boat-shaped ceramic vessels and foreign artifacts, indicates that target fish and mammals were also caught in the coastal waters. Fish that resided on the seafloor, such as rock trout and scorpion fish, would have been caught all year round, and the rest would have been caught mostly from summer to fall. Black porgy and red sea-bream of considerable size could have been caught in the early winter and early spring. Marine mammals would have been caught, by professional groups, mostly to obtain protein, skin and oil, daily necessities, and raw materials for rituals and accessories. The existence of professional groups can be assumed based on the maritime location of the sites, artifacts, the remains of an entire sea lion, and the production of accessories. Moreover, the fact that parts of sea lions were found at inland sites (such as Gyeongsan and Gyeongju), as well as near the sea, suggests the possibility that the sea lions were obtained through exchange – for example, through a bartering system, with professional catching communities.

블루카본 거래를 위한 어촌 마을단위 탄소권 설정의 행정법적 고찰

블루카본(blue carbon) 거래제도는 블루카본을 보존하는 경우, 양식장, 염전 등 다른 경제활동을 하지 못함으로써 받게 되는 손해, 즉 기후변화를 억제하는 기회비용을 국제사회가 지불하는 시스템이다. 기후변화협약 당사국 회의 등 다양한 국제협상에서 다방면의 논의를 거듭하며 블루카본 거래 제도를 체계화하고 있으며, 선진국들은 이미 블루 카본 시장을 선점하기 위해 활발한 투자를 하고 있다. 본 연구의 목적은 어촌마을단위 블루카본 거래를 위해 갯벌 주변 현지 주민에 대한 탄소권 설정과정에서 발생할 수 있는 입증책임 관련 법적 쟁점들을 사전에 점검하고 분석하는 데 있다. 블루카본 서식지를 기반으로 하는 블루카본 상쇄 사업이 해당 지역 주민들과 협의없이 진행되는 것은 현실적으로 불가능하다. 블루카본 서식지를 점유하고 있는 지역 주민들과 유대관계를 형성하고 협업구조를 마련하는데 장기간이 소요된다. 따라서 탄소거래 수익의 분배 등 행정절차법에서 제기되는 쟁점의 절차적 정당성을 확보하기 위해 어촌 마을에 전국단위로 존재하는 어촌계에 탄소권을 부여하여 어촌 마을 단위별로 블루카본 거래를 사업을 실시하는 방안이 실현 가능한 대안일 것으로 판단된다. 본 연구는 우리나라에서 블루카본 거래제도를 도입하는 과정에서 서식지를 점유하고 있는 당사자들에게 부여해야 하는 탄소권에 대해 이상과 현실의 괴리가 존재하지만 예측가능성과 집행가능성에 대한 근거자료를 제공한 점에서 의의가 있다.

Blue Carbon Trading is a system where the international community pays the opportunity cost for damage incurred by obstacles in conducting economic activities such as fish farms and salt evaporation pond to tackle climate change. Blue carbon trading system establishes its position as an official reduction mechanism on carbon dioxide by repeated discussions in various international negotiations such as the United Nations Framework Convention on Climate Change. Developed countries are already making active investments to preoccupy the blue carbon market. The purpose of this study is to analyze legal issues that may arise in the process of establishing carbon rights for local residents around the tidal flat for blue carbon transactions at a fishing village level. It is practically impossible to operate a blue carbon offset project, based on the blue carbon biomass habitat, without due consultation process with the local residents. It takes a long time to form a solid cooperative relationship to enter into a trading contract with local residents occupying the blue carbon habitat. Granting carbon rights to nationwide resident associations that traditionally exist in fishing villages could be a realistic alternative to conduct blue carbon transactions at individual fishing village units. This approach can secure procedural legitimacy raised in the administrative procedure, such as the distribution of profits earned from carbon transactions. The result of this study can be a valuable reference to handle legal issues raised in the process of introducing the blue carbon trading system in Korea, although there is a gap between ideals and reality about the carbon rights granted to those who occupy the habitat.
