복제권 침해 판단 기준으로서 ‘실질적 동일성’과 ‘실질적 유사성’의 재검토 KCI 등재

우리 학계와 판례는 미국법의 ‘실질적 유사성(substantial similarity)’ 이론과 일본 판례의 ‘표현상의 본질적 특징의 동일성 유지 및 직접 감지’ 기준을 병행하여 사용해 왔다. 이 과정에서 복제권 침해에는 ‘동일성’ 또는 ‘실질적 동일성’이, 2차적저작물 작성권 침해에는 ‘실질적 유사성’이 필요하다는 식의 이분법적 설명이 등장하게 되었다. 그러나 이러한 설명은 ‘실질적 동일성’이 ‘실질적 유사성’보다 더 좁은 범위인 것같은 오해를 불러일으킨다. 이에 본 논문은 과거 우리 저작권법에 큰 영향을 미친 일본의 판례와 관련 이론의 변천 과정을 분석하였다. 일본의 경우 ‘원 레이니 나이트 인 도쿄’ 사건에서 ‘에사시 오이와케’ 사건을 거치며 복제와 번안(2 차적저작물 작성)의 침해 판단 기준을 ‘표현상의 본질적 특징의 직접감지’로 사실상 일원화하고 있음을 확인하였다. 이는 우리 법상의 ‘실질적 유사성’과 규범적으로 동일한 의미를 지니는 것으로 해석된다. 결론적으로, 복제권과 2차적저작물 작성권 침해는 모두 ‘실질적 유사성’을 공통된 기준으로 하되, 후자는 여기에 ‘새로운 창작성의 부가’라는 요건이 더해지는 구조로 이해하는 것이 타당하다. 따라서 불필요한혼동을 유발하고 규범적 의미가 모호한 ‘실질적 동일성’이라는 용어의사용은 지양해야 하며, 이미 법리가 정립된 ‘실질적 유사성’으로 용어를 통일하여 사용함으로써 저작권 침해 판단의 정밀성과 명확성을 제고해야 함을 강조하였다.
Korean academia and precedents have conventionally utilized both the American doctrine of ‘substantial similarity’ and the Japanese standard of ‘maintaining the identity of essential features in expression and direct perceivability.’ In this process, a dichotomous explanation emerged, suggesting that ‘identity’ or ‘substantial identity’ is required for the infringement of reproduction rights, while ‘substantial similarity’ is necessary for the infringement of the right to produce derivative works. However, such explanations lead to the misconception that ‘substantial identity’ covers a narrower scope than ‘substantial similarity.’ Accordingly, this paper provides an in-depth analysis of the Japanese precedents and theoretical transitions that have significantly influenced Korean copyright law. In Japan, through cases ranging from the One Rainy Night in Tokyo case to the Esashi Oiwake case, the criteria for determining infringement of reproduction and adaptation (derivative works) have effectively been unified into the ‘direct perception of essential features in expression.’ This is interpreted as having the same normative meaning as ‘substantial similarity’ under Korean law. In conclusion, it is appropriate to understand that both reproduction rights and the right to produce derivative works share ‘substantial similarity’ as a common criterion, with the latter requiring the additional element of ‘the addition of new creativity.’ Therefore, this study emphasizes that the use of the term ‘substantial identity,’ which causes unnecessary confusion and remains normatively ambiguous, should be avoided. Instead, terms should be unified under ‘substantial similarity,’ for which legal principles are already well-established, thereby enhancing the precision and clarity of copyright infringement determinations.
