이 논문은 이주노동자의 주거권 보장실현을 위한 방안을 담고자한다. 우리나라에서는 외국에서 유입된 이주노동자들이 증가하고 있다. 이주노동자도 국제인권규약이 적용되며, 이주노동자들의 인권도 충실히 보장되어야 한다. 국제이주노동자권리협약에 따르면 이주노동자는 「국적국이 아닌 나라에서 유급활동에 종사할 예정이거나 이에 종사하고 있거나 또는 종사하여 온 사람」이다. 이 협약에서는 계절노동자, 선원, 해상시설노동자, 순회노동자, 특정사업노동자, 특별취업노동자 그리고 자영노동자도 이주노동자로 포함하고 있다. 우리나라의 외국인 고용법에 따르면 사용자는 국적을 이유로 이주노동자를 부당하게 차별하여 처우해서는 안된다. 이주노동자는 인간의 존엄과 가치를 지니지만, 현실에서는 우리나라에 거주하는 이주노동자들의 주거환경은 상당히 열악하다. 상당수 이주노동자들이 컨테이너나 공장과 같은 비주거용 건물에서 거주하고 있다. 또한 많은 이주노동자들이 최저주거기준 이하의 주거환경 속에서 살아가고 있다. 이 논문에서는 국가가 이주노동자의 주거권을 실현해야하는 의무가 있는지, 이주노동자의 주거권 실현을 위한 법제도적인 개선방안을 모색하고자한다.

The purpose of this study is to examine the housing conditions of foreign workers who are working here in Korea and to present policy suggestions. It is natural that the International Covenant on Human Rights(ICHR) guarantees human rights and fundamental rights of the migrant worker at the same level of the national workers. The term “migrant worker”, which is applied in this Convention, refers to a person who is to be engaged, is engaged or has been engaged in a remunerated activity in a State of which he or she is not a national. And this Convention contains some types of workers, as if frontier worker, seasonal worker, seafarer, worker on an offshore installation, itinerant worker, project-tied worker, specified-employment worker and self-employed worker. No employer shall discriminate or unfairly treat any person on the grounds that he/she is a foreign worker. But their housing condition were filthy and mostly substandard such as container, tents, illegal temporary accommodations. The government has to set up a policy guideline on housing for the foreign workers and the housing minimum standard should be applied to the foreign workers housing in light of humanitarian considerations. It is also necessary to review and research on housing policies of foreign workers in advanced countries.

우리나라의 급속한 경제발전은 사람들의 삶의 모습과 사회의 모습을 바꾸어 놓았다. 단일민족이라는 의식을 가지고 살아온 우리사회에 2010년 현재 외국인체류자가 120만에 이르고 우리사회 어디서나 외국인근로자(alien worker)와 결혼이주자(married immigrant)들을 만날 수 있게 되었다. 우리사회의 경제적 성장이 지속되어도 대부분의 외국인근로자와 다문화가정(multicultural family)들은 그 혜택을 누리지 못하고 가난하게 살고 있으며, 사회적으로 소외받고 차별을 받으며 살아가고 있다. 이들이 바로 21세기 초엽의 한국사회의 새로운 형태의 가난한 사람(the poor)들이다. 이들을 그리스도교적 관점에서 어떻게 이해하고 어떻게 받아들여야 하는가? 이 질문에 대한 해답을 찾고자 우선 성서에 나타나는 가난(poverty), 가난한 이들(the poor)의 모습, 가난한 이들을 위한 하느님의 배려와 사랑, 지도층과 부유한 자들에 가난한 이들을 어떻게 대해야 하는지? 그리고 가난한 사람들에 대한 예수 그리스도의 활동과 가르침을 고찰하였다. 이어서 우리나라의 외국인근로자와 다문화가정(multicultural family)의 현실과 그들의 삶을 고찰하였다. 이러한 고찰을 통해서 외국인근로자와 다문화가정의 삶의 모습은 바로 성서에 나타나는 가난한 이들의 모습과 동일함을 알 수 있었다. 즉 성서에서 가난한 사람들은 당시 사회의 소수자로써 자신들의 삶을 제대로 꾸려 갈 수 없었고, 쉽게 왕과 지배층의 억압과 착취로 고통 받고 있었다. 오늘날 외국인근로자는 우리사회의 3D업종에 종사하면서 사회의 구성원으로 활동을 하고 있지만 저임금과 차별과 착취에서 벗어나지 못하고 있다. 또 다문화가정을 이루어 생활하고 있는 결혼이주여성의 경우 한 가정에서 아내요 어머니로서 삶을 살고 있지만 대다수의 결혼이주여성이 문화적 차이와 사회적 편견으로 차별과 무시 속에서 궁핍한 삶을 살고 있을 뿐 아니라 그 가족들마저 그러한 삶을 살고 있다. 하느님은 당신 예언자들을 통하여 가난한 이들의 권리를 보호할 것을 요구하였고, ‘계약의 책’(book of the convent)을 통하여 가난한 이들의 권리를 확정하였다. 이에 따라 이스라엘은 가난한 이들을 돌볼 책임이 있으며, 이들을 돌보는 것이 곧 하느님에 대한 신앙을 증거하는 것이며, 하느님의 축복을 받는 길이다. 성서의 바로 이러한 가르침에서 우리는 그리스도인이 이 시대의 가난한 사람들인 외국인근로자와 다문화가정들에 대해 어떠한 태도를 지녀야 할 것인지에 대한 해답을 찾을 수 있다. 그 해답은 곧 그리스도의 신비체인 교회와 교회의 구성원인 그리스도인은 이주민들의 삶을 바로 알고 이들의 권리를 인정해야 하며, 이들이 인간적인 삶을 살아갈 수 있도록 선의의 사람들과 함께 노력해야 한다는 것이다. 이것이 바로 이 시대에 신앙을 증거하고 선포하는 길이다.

The rapid economic growth changed the life's appearance and the social figure in Korea. In 2010 there are almost 120 thousand foreigners in Korea which is full of the consciousness of a racially homogeneous nation, so anywhere in our country they meet alien workers and married immigrants. Even though the economic growth has continued recently, the majority of alien workers and the multicultural families are poor without receiving the favor from economic growth and live in social alienation and discrimination. In the 21st century they are a new class of the poor in Korea. How do we understand this situation and how do we receive them in the Christian vision? To answer the above question, first of all in the Bible we researched the concept of poverty, the appearance of the poor, God's consideration and affection to the poor and how does the class of social leaders and riches treat them. And we looked into Jesus Christ's teachings and activities to the poor. We investigated the reality of life of the alien workers and the multicultural families. We can identify the figure of the alien workers and the multicultural families with the appearance of life of the poor in the Bible through this research. Indeed, the poor in the Bible didn't make a bare living as the minority in the society. And they suffered the oppression and the exploitation of the political leaders and the rich. Now the alien workers don't get out of difficulty of low wages, social discrimination and exploitation, nevertheless they labor in the industry of 3D and discharge the member of our society. The married immigrant woman becomes a member of the multicultural family through international marriage, so she is the wife of a man, a mother of her children and a housewife of a home. But the married immigrant woman and her family are in strained circumstance and suffer difficulties because of cultural differences and social prejudices. Through the prophets God asked to the people who protect the rights of the poor provide protection for the poor and established the rights of the poor through the book of the convent. Therefore, Israelites has the responsibility to give assistance to the poor. It is a testimony of the faith in God and the way of the blessing of God. In this teaching of the Bible we can find the answers to the question which we have to determine a certain attitude to the poor in this age who are the alien worker and the multicultural families. The answer is that the Church, the mystic body of Christ, and the Christian, the member of the Church, have to know the real life of the immigrants, recognize their rights and endeavor to lead a life worthy of man with the men of good will. It is the testimony and the proclamation of the Christian faith in this age.
