The study explored how sentence factors of Article 51 of the Criminal Law affect on determination of sentencing in incest in Korea. Multiple regression analysis was conducted in current study. The results of this study were partially supported by previous studies. It can be seen that the study proved that depending on criminal types, judges put different emphasis on sentence factors. Firstly, the study revealed that offending period is an effective factor of sentencing. Unlikely in other types of incest, offending period is an important factor to sentence in acquaintance incest. Secondly, whether to use a weapon did not discussed in previous studies, but it was considered as significant impact to sentence in acquaintance incest in current study. Using a weapon is also related to the prearranged plan of offending. Thirdly, likely previous studies, criminal history of offender (number of criminal recordin jail sentence or number of criminal record of sexual assault) were not effective factor to sentence. Although the other factors were not significant in the present study, it is necessary to understand of sentencing phase of the trial by using in–depth research. The research needs to focus on the way of offending, number of offending, number of victim, age of victim and so on. Lastly, the number of cases was not enough and the information of cases was coded according to only offenders’ statements in the current research, these limitations should be noted in future studies.

본 연구는 한국사회에서 발생하는 친족성폭행범들의 양형에 각 인자들이 얼마나 영향을 미치는지 중다회귀분석기법 등을 통하여 분석하였다. 그 결과를 보면, 선행연구결과와 일부 일치 또는 일부 불일치하는 결과들을 보여주고 있다. 첫째, 범죄의 심각도(범행의 결과)에 해당하는 친족 성폭행 가해기간은 양형에 영향을 주는 중요한 변인으로 밝혀졌다. 성폭행 가해기간은 일반성폭행과는 달리 친족성폭행에서는 특별한 양형사항이 된다.둘째, 선행연구에서는 다루어지지 않았던 범행전 흉기사용여부가 친족성폭행범의 양형에 영향을 미치는 유의미한 변인이라는 것을 알 수 있다. 그런데, 흉기사용여부는 범행의 사전 계획성과도 관련이 된다.셋째, 친족성폭행범의 경우에는 전과력(실형전과횟수, 성폭력전과횟수)이 양형과의 상관이 크지 않았다. 이는 선행연구와도 일부 일치하는 결과이다.그 밖에 변인들은 본 연구에서 통계적으로 유의하지 않았지만, 범인의 성행, 성폭행 가해횟수, 성폭행 피해자수, 피해자의 연령 등에 대하여는 좀 더 정밀한 분석이 필요하다고 본다. 마지막으로 본 연구의 한계로는 사례수가 적고, 분석자료가 가해자의 기록으로 한정되었다는 점이 있다.
