The Advance Medical Directive mentioned in this article is one of Advance Directives which is a means for a personnel to continue medical treatments and nursing in accordance to oneself’swill and intention. This subscription contains the will of the patient who already lost the ability to show their wills of deciding whether to continue on or to stop treatment at the stage of judgment. Therefore this subscription contains the pre-denial of treatment or pre-consent the continuation of treatment. However what is in the center of this argument is mostly about the denial of treatment rather than the continuation of it. The reason why is because people might understood this subscription as a guarantee to deny hard treatments at the last stage of life and by refusing aggressive treatments of doctors they think that they can keep their dignity in their deaths. At this point, the core value that this subscription pursues is a humane death with human dignity, and for this the matter of autonomy as a ground for making right decisions becomes the core point at the advance medical directive matter. This article will deal with ethical problems to preserve core values that the advance medical directive sought and also what should be avoided and what should be emphasized at the ethical side. Therefore to approach to the ethical justness, we first have to know how is the understanding of dignified death, and when we say we ‘respect’ one’s expression of intentions for dignified death what are the basis and limits of it through the examinations of the concept of autonomy. Then, to ensure the ethical justness, the range of medical treatment that the patient can deny will be examined and to do so traditionally divided ordinary and extra-ordinary means will be examined as well as the denial of therapeutic tenacity.

이 논문을 통해 다루는 ｢사전의료지시서｣(Advance Medical Direc)는 ‘사전유언지침들’(Advance Directives) 중의 하나로 한 개인이 의료진에게 의료처치와 간호를 자신의 원의와 의도에 부합하여 진행시킬 것을 보증하려는 하나의 수단이다. 이 지시서는 한 개인이 치료를 계속할 것인지 아니면 중단할 것인지를 결정해야 할 시기에, 그 자신의 의사를 명확히 표명하는 것이 불가능하게 되어버린 어느 특정한 상황에 처한 상태에서 계속해서 치료받기를 원한다거나 혹은 치료를 중단하기를 원한다는 등의 의사 표명이 담겨있는 문서이다. 따라서 이 지시서는 사전치료거부지시의 내용을 담고 있거나 혹은 사전치료계속지시의 내용을 담고 있다. 그러나 이 논의의 중심에는 치료의 계속보다는 치료의 거부가 더 핵심적인 내용으로 담겨져 있다고 보아야 한다. 왜냐하면 사람들은 삶의 마지막 단계에서 이 지시서를 통해 인간적으로 수용하기 힘든 치료를 받지 않는다는 것을 보장받을 수 있다고 생각할 것이며, 의사들의 공격적인 치료를 피함으로서 인간으로서 품위를 지닌 채 임종을 맞을 수 있다고 생각하기 때문이다. 이러한 관점에서 이 지시서가 지향하는 핵심적 가치는 인간으로서의 품위를 갖춘 인간적 죽음이라고 할 수 있으며, 이를 위해 올바른 판단을 내릴 수 있는 근거로서의 자율성의 문제는 또한 ｢사전의료지시서｣ 논의에서의 핵심 내용이 된다. 이 논문은 ｢사전의료지시서｣가 지향하는 핵심적 가치를 지지하고 보존할 수 있기 위하여 담아야 할 윤리적 요구의 문제를 다루면서 이러한 바탕 아래 윤리적인 측면에서 피해야 할 점이 무엇이고, 강조되어야 할 점이 어떤 것인지도 함께 다루게 될 것이다. 따라서 윤리적 정당성의 문제에 접근하기 위해서는 우선적으로 ‘품위 있는 죽음’에 대한 이해가 어떠해야 하는지를 살펴보아야 할 것이며, 품위 있는 죽음을 위해 한 개인의 의사 표명을 존중한다고 할 때 그 근거는 무엇이며, 그 한계는 어디까지인지를 자율성의 개념이해를 통해 고찰할 것이다. 그런 다음 ｢사전의료지시서｣가 윤리적 정당성을 확보하기 위해서는 치료를 거부할 수 있는 치료 수단의 범위를 살펴볼 것이다. 이를 위해 전통적으로 치료 수단을 구분하고 있는 통상적 및 예외적 치료 수단에 대한 고찰과 한 걸음 더 나아가 의료집착 행위의 거부 문제 등도 함께 다루게 될 것이다.
