The way to have enterprises' trade secrets legally protected not only will be possible after the damage is investigated, but it has an aspect to be differentiated from the Industrial Property Right in the Intellectual Property Right. Of course, copyright in the Intellectual Property Right can be possible as the method after the fact, and acts themselves have many methods after the fact. The Intellectual Property Right includes copyrights and Industrial Property Right, and though a trade secret is intellectual property of an enterprise, it can be protected not by legal principles of the Intellectual Property Right but by that of unfair competition. But, because the Intellectual
Property Right is the legal principle to protect intellectual properties of enterprises or individuals, it is necessary to regard the trade secrets as the intellectual properties of enterprises and to think about the term of industrial technology. Broadly speaking, the industrial technology can be included in enterprises' intellectual property and can be regarded as a part of trade secret.
The internal protection in a enterprise will be the most effective method as the preliminary protection of trade secrets and industrial technologies. Even though there have recently been a lot of discussions about it, it is difficult to protect them not only because various methods to breach trade secrets have appeared, but because the law cannot support the protection, which brings about the gap between the law and reality. The appearance of economic spies who can use more various methods than previous ones who breached trade secrets put the enterprises in the tricky situations.

영업비밀을 포함한 지적재산에 대한 가치가 증가하고 이를 압축 및 이동하는 기술이 발달하면서 최근 산업스파이가 사회적 문제가 되고 있다. 국내기업에서 국내기업으로 산업기술을 유출시키는 산업스파이보다 국내기업의 기술을 외국으로 유출시키는 산업스파이가 특히 문제가 되고 있다. 각국의 기업이 소유한 기술이 국가의 경쟁력과 안전보장에 직결된 문제라는 인식이 확산되면서 이러한 산업스파이를 어떻게 규범적으로 통제할 것인가에 대하여 각국의 고민은 깊어지고 있다. 이러한 문제를 해결하기 위하여 선진국들은 새로운 법률을 제정하거나 기존 법률을 개정하여 능동적인 대응방안을 모색하고 있으며, 냉전시대의 정보기관을 활용하여 산업스파이의 탐지 및 상대방 국가의 산업기술탐지에 활용하는 한편 국제적인 협력도 함께 모색하고 있다.
산업스파이는 사법기관도 쉽게 접근하기 힘든 부분으로 간주하고 있다. 그 이유는 적발과 처벌이 어렵고 관련법규가 미비하기 때문이기도 하지만 스파이활동의 공통적인 특성상 산업스파이도 피해가 밝혀지기 전까지 활동사실조차 파악하기가 곤란하기 때문이다. 효과적인 해결책을 마련하기 위해서는 다양한 검토가 필요하다. 우리나라는 독일의 부정경쟁방지법(UWG)을 참고하여 부정경쟁방지법에 영업비밀보호와 관련된 법률을 규정하였다. 최근에 제정된 산업기술의 유출방지 및 보호에 관한 법률은 미국의 경제스파이법(EEA)을 참고하여 제정되었다. 이러한 법률의 제정으로 산업스파이에 대한 규범적 대응방안이 많이 완비된 것은 사실이지만 아직 법제도의 운영과 입법상의 일부 미비점으로 인해 문제점이 지적되고 있다. 독일이나 미국에서는 재판과정에서 영업비밀이 유출되는 것을 방지하기 위한 입법이 마련되어 있지만 우리나라는 관련 법률에 구체적인 입법이 마련되어 있지 않은 점 등의 입법적 미비점을 해결할 필요성이 있다.
