The purposes of this study are as follows. First, this study researches the necessity and validity on the policies of government with regard to private school which is the important education institute under the public education system, not about management structure of school corporation, the latest controversial issue in the view of policy and law on private school. Second, it suggests improvement plans through analyzing currents statutes and history related laws, systems, and policies with regard to private school. The study shows that discussion and concern on private schools and their students leave much to be desired in that the support to private school education is the essential duty of the government in the aspect of contracture of public education and equal educational opportunities. Hence, this study proposes that the government defrays a part of public education budget for the students in private schools such as introduction of grant-in-aid system in private school finance. It suggests that enactment of a exception which turns the property of low investment returns to property of high investment returns with regard to expansion of school corporation's capitalization, And it points out tax system reform as a kind of indirect support, establishment and active management of private school education fund and review on development plan are needed.

본 연구는 사학정책, 사립학교법과 관련하여 최근 논란의 중심에 있는 학교법인의 운영구조에 대한 논의에서 벗어나, 공교육제도 하의 중요한 교육기관으로서 자리 잡고 있는 사학(私學)에 대하여 국가 및 지방자치단체가 조성 정책을 전개하여야 할 필요성?정당성을 살펴본 후 관련된 법령의 현행 태도 및 변천사, 그리고 관련 정책의 실태 등을 분석하고, 향후의 개선 방안을 제시하고자 하였다. 본 연구 결과, 사학 및 이에 재학하는 학생들에 대한 조성과 지원은 국가의 교육조건정비 의무 및 교육의 기회균등 측면에서 볼 때 국가 등의 중요 의무임에도 불구하고, 이에 대한 논의와 배려는 지극히 미흡한 상황임을 확인할 수 있었다. 이에 본 연구에서는 중등사학에 대한 사학재정부담금제도의 도입과 같이 국가의 사학 재학생에 대한 일정 공교육비 부담 체제로의 전환을 제언하였다. 또한, 학교법인 전입금 확대 여건 조성과 관련하여 저수익성 내지 비수익성 재산을 고수익성 재산으로 전환할 수 있도록 하는 특례 조치의 마련, 간접적 지원의 일환으로서 학교법인을 대상으로 하는 세제부분에 대한 개선 그리고, 사학진흥기금의 조성 및 운영의 활성화를 통한 사학 지원과 조성 방안에 대한 재검토가 필요함을 지적하였다.
