The organization of teaching contents for a single subject is desired to be integral and complete with a compact sequential arrangement of diverse conceptual components necessary for understanding a unitary and total subject matter. But the subject of 'Law and Society' is organized somewhat loose and erroneous after the prescription of the South Korean National Curriculum. So, in this paper, I propose, with an hope of contributing towards redressing of such a defect or error, a sequential arrangement of some particular concepts and questions about the necessity and the objectives of law, as follows:
"Law is a purposeful and necessary evil. ⇒ Being evil, why and how can it be necessary? ⇒ ((A methodological assumption of a lawless state: disputes rampant → chaotic disorder → Intolerable!)) ⇒ Law is necessary for the achievement and preservation of peace and order by means of the prevention and settlement of disputes. ⇒ What measures should be taken for the prevention and settlement of disputes? ⇒ ((The causes of disputes should be found out and corresponding countermeasures against them should be taken. → What are the causes of disputes? → They are the problems of the distribution of social values, positive or negative.)) ⇒ Social values should be properly distributed. ⇒ How can they be properly distributed? ⇒ With Justice, Zweckmäßigkeit(means Purposiveness literally, but in usage by G. Radbruch like this,
Purpose itself substantially), Sureness or Stability, and according to the Nature of Things(Purpose should be decided or selected relatively, and the rest should be obeyed absolutely). ⇒ What is the most important Purposive Objectives of our present legal system pointed out by our Constitution? ⇒ It is Human Rights and Public Welfare. ⇒ (What are the main principles, and how is the main structure or framework shaped, in general of the law which is the means of achievement of those Objectives?)"

하나의 독립 과목의 교육 내용 체계는 단일한 대상을 이해하는 데 필요한 여러 요소들을 포함하되 그것들을 서로 긴밀한 관계 속에 계열적으로 배열함으로써 통합적이고 자체완결적으로 구성하는 것이 바람직하다. 그런데, 현행 교육과정이나 얼마 전 개정된 교육과정에 서술된 ‘법과 사회’ 과목의 내용 체계에서는 그 요소들 사이의 계열적 관계가 엉성하거나 잘못설정되어 있다. 그런 점을 개선하는 데 도움을 주기 위해서, 그 과목 내용 체계의 첫머리를 이루는 ‘법의 개념과 기능’ 및 ‘법의 이념’, 그리고 ‘법의 필요성, 법제도의 구조’와 관련해서, 그것을 구성하는 세부적인 내용 요소들과 그것들 사이의 계열적 관계를 다음과 같이 제시한다.
“법은 목적적 존재로서 필요악이다. ⇒ 악인데 왜 필요한가? ⇒ ((무법천지 가정: 분쟁 →혼란‧무질서 → 견딜 수 없음)) ⇒ “분쟁 예방‧해결 → 평화‧질서 달성‧유지”를 위해서 필요하다. ⇒ 분쟁 예방‧해결을 위해서는 어떻게 해야 하는가? ⇒ ((원인을 밝혀서 그에 맞추어 대처해야 한다. → 분쟁의 원인은 무엇인가? → 사회적 가치․반가치의 분배 문제이다.)) ⇒ 사회적 가치‧반가치를 잘 분배해야 한다. ⇒ 어떻게 하면 잘 분배할 수 있는가? ⇒ 정의롭고, 합목적적이고, 안정적이면서 사물의 본성을 어기지 않으면 된다(합목적성은 상대주의적으로 결정되어야 하고, 나머지는 그냥 따르면 된다). ⇒ 우리나라 현행 법체계가 추구해야 공공복리이다. ⇒ (이러한 목적과 가치를 달성할 수단인 법의 모습은 어떻게 생겼는가?)“
