A Study on the Territorial Scope of Online Communication to the Public and the Legal Effects of Geo-blocking - Focusing on the CJEU Judgment in Anne Frank Fonds (C-788/24) -
The online use of copyrighted works transcends national borders, whereas copyright protection remains territorial. Where the same work has entered the public domain in some countries but remains protected in others, the territorial scope of online communication to the public becomes a central issue. The judgment of the Court of Justice of the European Union (CJEU) in Anne Frank Fonds (C-788/24) addresses this question by examining the effects of geo-blocking and VPN circumvention. The CJEU distinguished the mere accessibility of a work online from a communication directed at the public of a particular Member State. It held that where effective geo-blocking measures consistent with the “state of the art” are applied to users in a Member State in which copyright protection remains in force, a communication to the public in that Member State may not be established. The Court further clarified that the mere possibility of circumventing such measures through a VPN does not necessarily render them ineffective. These findings demonstrate that the territorial scope of online communication to the public should be assessed by considering the targeted public, the effectiveness of geo-blocking measures, and the attribution of circumvention by users. The judgment also provides important implications for Korean copyright law. In determining whether an online act originating abroad constitutes an infringement of the right of interactive transmission in Korea, mere accessibility from Korea should not be decisive. Rather, relevant factors should include whether Korean users were actually targeted, whether effective measures were taken to restrict access from Korea, and how the service was designed and operated. Furthermore, a user’s independent circumvention of geo-blocking through a VPN should not automatically be attributed to the content provider. Geo-blocking should therefore be understood not as an independent ground for exemption from liability, but as an objective factor in determining the territorial attribution of an act of transmission, copyright liability, and the appropriate scope of remedies.
