The Role and Dual Nature of the Lord Chancellor as a Guardian of Judicial Independence in the United Kingdom
Judicial independence is an institutional foundation for the realization of the rule of law, but rather than taking a universally identical form, it appears in various forms according to the judicial culture of each country. The United Kingdom, which does not have a codified constitution, has a distinctive history in that it has long guaranteed judicial independence by relying on political culture and constitutional conventions. At the center of this stands the Lord Chancellor, a constitutional office unique to the United Kingdom. The Lord Chancellor is one of the oldest offices in the history of the British Parliament and is a complex office that has performed political, administrative, and judicial functions together on the basis of its close relationship with the monarch. It has also functioned as an actor protecting judicial independence. The Constitutional Reform Act 2005, which brought a significant turning point in British constitutional history, reduced the judicial functions of the Lord Chancellor while codifying the Lord Chancellor’s role as a guardian of judicial independence. Therefore, in order to understand judicial independence in the United Kingdom, it is necessary to examine the role of the Lord Chancellor. Accordingly, this article examines what changes occurred in the positions of the British judiciary and the Lord Chancellor, focusing on the enactment of the Constitutional Reform Act 2005, and examines the nature and limitations of the Lord Chancellor’s duty to protect judicial independence revealed in that process. As a result of the examination, the Constitutional Reform Act 2005 strengthened the institutional independence of the judiciary by reducing the judicial functions of the Lord Chancellor and establishing the Supreme Court and the Judicial Appointments Commission, while at the same time maintaining the Lord Chancellor’s special responsibility to protect judicial independence. This has the advantage that the Lord Chancellor can represent the interests of the judiciary within the government and connect the political branches and the judiciary, while at the same time having the limitation that the effectiveness of such protection may depend on the constitutional understanding and political relationships of the officeholder. In actual cases as well, these characteristics appeared respectively in the function of protecting judges from external attacks and the function of protecting the interests of the judiciary within the government. Ultimately, the institution of the Lord Chancellor has a dual structure in which its political position serves as a means of protecting judicial independence while at the same time having the possibility of making that protection unstable, and this shows that judicial independence in the United Kingdom requires the complementary operation of political culture and constitutional conventions even after institutionalization by law.
