Article 17 (2) of the Immigration Act prohibits political activities by foreigners staying in Korea except as provided by law. Violation of this provision does not result in criminal sanctions, but may result in administrative sanctions such as a suspension order, recommendation for departure, departure order, or deportation. This provision of the Immigration Act was first enacted in 1977 in the form of a ban on all political activities by foreigners. It appears that the introduction of this provision was motivated by the activities of foreign religious figures who had stayed in Korea during the 1970s. At the time of legislation, the ambiguity regarding the scope of the concept of political activities prohibited by the Act was an important subject of discussion. Except for the fact that an amendment in 2005 allowed exceptions where prescribed by law, however, this provision has been maintained without significant changes. This means that the problems inherent in this legal provision at the time of its initial introduction are also being maintained. Prohibiting political activities by foreigners in general appears to have a high potential to violate constitutional principles such as the principle of clarity and the principle of proportionality, and therefore requires legislative improvement. Furthermore, it should also be taken into account that since the 2000s, there have been changes at the local level. Some suffrage rights have been recognized for some of the foreign residents granted the status of permanent residency. In order for these political rights to function effectively and for democracy to further develop, it is necessary to seek legislative measures that ensure the freedom of political expression of foreigners is harmoniously guaranteed within the limits of the principle of popular sovereignty.
