Transformation of the Early Modern European-Moroccan Treaty Order and Morocco’s Diplomatic Autonomy : Focusing on the Legal Structure of Major Treaties, 1479-1767
This study examines the transformation of the early modern European–Moroccan treaty order and Morocco’s diplomatic autonomy by focusing on the legal structure of major international treaties concluded from the late fifteenth to the late eighteenth century. It analyzes the Treaty of Alcáçovas (1479), the Treaty of Tordesillas (1494), the Braganza Marriage Treaty (1661), the Anglo-Moroccan Treaty of 1721, and the Spanish-Moroccan Treaty of Peace and Commerce (1767). The earlier treaties functioned primarily as instruments through which European maritime powers regulated overseas territories, navigation rights, and spheres of influence, while the interests and rights of non-European political communities were insufficiently reflected. From the seventeenth century onward, however, Morocco expanded its diplomatic and commercial relations with European powers and emerged as an independent treaty party and diplomatic actor. The Alawi dynasty sought to preserve political independence and diplomatic autonomy through a strategy of balancing competing European powers and diversifying commercial relations. These treaties illustrate the formation of early modern international legal institutions relating to peace, commerce, diplomacy, and consular relations, while also revealing their Eurocentric and imperial limitations. European-Moroccan treaty relations therefore demonstrate both the transformation of the early modern treaty order and Morocco’s efforts to maintain diplomatic autonomy. More broadly, the Moroccan experience suggests that the formation of modern international law should not be understood solely as the unilateral diffusion of European norms, but also as a process in which non-European states participated in shaping international legal relations through treaty-making and negotiation. It also offers implications for understanding the legal agency of non-Western states in contemporary international law.
