A Study on the System for Protecting the Administration of Justice under Korean Criminal Law through a Comparison between the German Offense of Perversion of Justice and the U.S. Offense of Obstruction of Justice
Korean criminal law has traditionally protected the proper administration of justice through a number of separate offenses, including perjury, destruction of evidence, false accusation, harboring an offender, and abuse of official authority. This fragmented regulatory structure, however, has significant limitations in addressing both the intentional distortion of judicial authority by criminal justice officials and organized interference with criminal proceedings by participants or third parties. In particular, following the recent introduction of the offense of perversion of justice under Article 123-2 of the Korean Criminal Act, it has become necessary to reconsider not only the systematic position of this new offense and its relationship with existing offenses, but also whether a separate offense of obstruction of justice remains necessary. This study examines the proper framework for protecting the administration of justice under Korean criminal law by comparing Section 339 of the German Criminal Code, which criminalizes Rechtsbeugung, with the federal offenses of obstruction of justice in the United States. The German model primarily regulates the intentional misuse of legal decision-making authority by judges, prosecutors, and other officials responsible for handling or deciding legal matters. Its principal concern is therefore the internal distortion of the administration of justice. By contrast, the U.S. model encompasses a broad range of external acts interfering with judicial proceedings, including witness intimidation or improper persuasion, destruction or alteration of evidence and records, submission of false materials, and obstruction of official proceedings. Although both models seek to protect the fairness, integrity, and truth-finding function of the justice system, they differ in their potential offenders, prohibited conduct, and principles limiting criminal liability. Under the German model, mere judicial error must be strictly distinguished from intentional and serious departures from the law in order to preserve judicial independence and legitimate legal interpretation. Under the U.S. model, broadly worded obstruction provisions must be restricted by the principles of legality, definiteness, and proportionality so that they do not unduly interfere with the rights of defense, legitimate advocacy, or lawful litigation strategies. The comparative analysis demonstrates that the offense of perversion of justice and the offense of obstruction of justice should not be regarded as mutually exclusive or conflicting mechanisms. Rather, they should be understood as complementary offenses addressing different forms of interference with the administration of justice. The Korean offense of perversion of justice should be positioned as a special offense regulating the intentional distortion of legal interpretation, evidentiary handling, and fact-finding by judges, prosecutors, and investigative officials. A separate offense of obstruction of justice, on the other hand, should be considered only with respect to external interference that cannot be adequately addressed by the newly enacted provision or existing offenses, such as improper interference with witnesses, victims, or informants, submission of fabricated materials, manipulation of electronic evidence and records, and organized obstruction of proceedings. Accordingly, the Korean system should be reconstructed as a dual framework consisting of the regulation of “internal distortion” through the offense of perversion of justice and the regulation of “external obstruction” through narrowly defined and conduct-specific obstruction offenses. Rather than adopting a broad American-style general clause, Korean legislation should specify concrete forms of prohibited conduct, including witness interference, submission of false evidence, and destruction or manipulation of electronic records. Such a framework would strengthen the fairness and reliability of criminal justice while preserving judicial independence, the rights of suspects and defendants, the legitimate role of defense counsel, and the principle of legality.
