In March 2026, the National Assembly passed a wholesale revision of the National Referendum Act—the first full-scale amendment in 37 years since 1989. This comprehensive revision resolved, at least for the time being, the unconstitutional situation in which the President’s exercise of constitutional authority—including the power to submit matters to a national referendum—had been delayed due to a legislative gap following the Constitutional Court’s decision. It is also worth commending that the revision abolished and reorganized several “toxic clauses” that had unduly restricted freedom of expression in areas such as campaign methods for referendum voting—provisions dating back to their enactment during an authoritarian regime. However, the amended National Referendum Act still presents the following problems, which call for further discussion of additional amendments. Although national referendums and public elections share considerable similarities, they are nonetheless distinct institutions, and a more rigorous legal analysis of their differences should have preceded the amendment. The revised Act, however, fails to adequately reflect this distinction. Above all, under the constitutional quorum requirement, the passage of a referendum proposal requires that a majority of the electorate eligible to vote in National Assembly elections actually cast a vote—that is, the “voting quorum” must be met. Given this, the “right to refuse to vote” constitutes a core component of the right to a national referendum. Nevertheless, the amended Act fails, throughout its provisions, to adequately safeguard voters’ right to refuse to vote. For example, the revised Act significantly narrows the scope of electors eligible to vote in National Assembly elections, which serves as the denominator for determining whether the voting quorum has been met in confirming referendum results. In addition, the newly introduced provision imposing a duty to participate in voting, as well as the special provision allowing elections and referendums to be held simultaneously, raise concerns that they may infringe upon the right to refuse to vote. In sum, the amended National Referendum Act overlooks, in no small measure, the institutional differences between elections and referendums, and in particular is negligent in safeguarding the right to refuse to vote, which forms part of the right to a national referendum. Furthermore, while the newly introduced provision on holding elections and referendums simultaneously is justified on grounds of administrative efficiency and increased voter turnout, this raises the concern that it could lead to chaos in the administration of elections and voting—considering that more than 40 years have passed since a national referendum was last held, that there is no precedent in Korean constitutional history for elections and referendums being conducted simultaneously, and that recent concerns have been raised regarding the National Election Commission’s capacity to administer elections. To be sure, it is difficult to regard it as desirable that the public’s opposition to a referendum proposal is expressed through the dual mechanism of abstention and a “no” vote, since this fails to accurately capture the electorate’s true intentions for or against the proposal. Accordingly, it is submitted that, going forward, the voting quorum requirement should be removed through constitutional amendment, retaining only the approval quorum. This, however, is a matter that can only be resolved through constitutional amendment; it goes without saying that the problems posed by the constitutional voting quorum requirement cannot be circumvented through statutory amendment alone.
