A Study on the Current Status and Improvement Measures of the Classification and Designation System for Controlled Substances in South Korea
This study examines the structural limitations of South Korea's system for classifying and scheduling controlled substances, with particular attention to the gap between the rapid emergence and circulation of new psychoactive substances (NPS) and the pace of regulatory response. It reviews the domestic legal framework and the operation of the temporary scheduling system, and draws policy implications from a comparison with scheduling approaches in the United States and Japan and regulatory frameworks at the United Nations and European Union levels. The analysis finds that the current system, organized primarily around the legal categories of narcotic drugs, psychotropic substances, and cannabis, has limited capacity to reflect differences among individual substances in abuse potential, dependence liability, public health risks, and therapeutic value when determining the appropriate level of control. Substance-by-substance scheduling also makes it difficult to respond promptly to NPS produced through modifications of chemical structure. Although temporary scheduling helps narrow regulatory gaps, it raises a further question: how can scientific scrutiny and procedural legitimacy be maintained when designation procedures are accelerated? To address these limitations, this study proposes, first, multidimensional, risk-based assessment criteria supported by a standing scientific review mechanism. Second, it calls for periodic review of temporarily scheduled substances and clearer criteria and procedures for permanent scheduling, renewal of temporary controls, or removal from control. Third, it recommends examining generic scheduling, which defines groups of chemical structures in advance, separately from analogue-based regulation, which assesses similarity to existing controlled substances. Both approaches require clearly delineated regulatory boundaries and decision criteria to ensure legal predictability. Fourth, it proposes linking precursor control with an NPS early warning system to strengthen the capacity to identify emerging substances and respond across the manufacturing and distribution stages. The study concludes that reform cannot be achieved merely by shortening scheduling procedures. A more effective framework must combine timely responses to emerging harms with scientifically grounded and proportionate controls, legal clarity, procedural legitimacy, and access for legitimate medical and research purposes.
