Modern labor law is expanding beyond traditional economic protections, such as wages and working hours, to encompass the protection of labor rights that guarantee workers' fundamental human rights and a healthy work environment. Since the International Labour Organization (ILO) adopted Convention No. 190 on Violence and Harassment in 2019, nations have been seeking regulatory models tailored to their domestic legal systems. This study aims to analyze the regulatory framework governing workplace harassment and sexual harassment in Chile—the one of Latin American nations to ratify ILO Convention No. 190—and to derive meaningful implications for the Korean legal system. Chilean labor law exhibits a unique structural characteristic. Unlike standard labor codes, Chile proactively placed the definitions and prohibitions of sexual harassment (2005) and workplace harassment (2012) in Article 2, which forms the general principles of the Labor Code (Código del Trabajo). This legislative decision reflects an effort to overcome historical and socio-economic inequalities—such as racial, class, and gender discrimination deeply rooted in its colonial legacy and dictatorship—and to elevate protection against workplace harassment to a fundamental human right grounded in human dignity, rather than a mere contractual duty. Following its ratification of ILO Convention No. 190 in 2023, Chile enacted major labor legislative reforms through Law No. 21,643 (Ley 21.643) in 2024. The revised labor code broadened the scope of workplace harassment by recognizing single severe incidents alongside repeated actions, explicitly addressing third-party violence, and mandating a gender perspective (perspectiva de género) and prevention protocols. Furthermore, by simultaneously amending the Administrative Statute, and the Municipal Statute, Chile established a unified and comprehensive prevention, investigation, and sanction mechanism across both private and public sectors. Chile's legislative trajectory offers critical insights for Korea, where workplace harassment regulations under the Labor Standards Act remain fragmented and inconsistent between the public and private sectors. By examining Chile's historical context, its structural placement within the Labor Code, and its comprehensive legislative process to implement ILO standards, this paper provides valuable legal and practical perspectives for reforming Korea's workplace harassment legal framework.
