U.S. workers' compensation law arose from the recognition that fault-based liability at common law failed to protect victims of industrial accidents. Employers could readily escape liability by invoking the so-called “Unholy Trinity” of contributory negligence, assumption of risk, and the fellow-servant rule, while injured workers bore the burden of proving both employer negligence and causation. Employers' liability statutes later curtailed these defenses in part, but left the fault-based structure itself intact. In the early twentieth century, states began treating industrial injury as a cost inherent in enterprise activity and enacted workers' compensation statutes that provided standardized benefits regardless of fault. The constitutional groundwork for this new system was laid in 1917, when the Supreme Court successively upheld compulsory, elective, and state-fund schemes. At the core of American workers' compensation law lies the “Grand Bargain”: workers receive prompt, standardized benefits without proving employer fault, in exchange for a general limitation on their ability to bring ordinary tort actions against employers for covered injuries. Employer immunity, however, is not absolute. Depending on the state, civil suits may proceed where the employer acted with intentional wrongdoing or breached a duty arising from a legal capacity distinct from the employment relationship. Suits against independent third parties who bear separate responsibility for the injury, meanwhile, are not exceptions to employer immunity but claims that fall outside its scope altogether. Considerable variation also persists across states in the recognized scope of compensable injury, the coverage of occupational disease, mental injury, and long-latency conditions, benefit levels, methods of disability assessment, and insurance administration. American workers' compensation law is thus better understood not as a single, unified model, but as a set of divergent institutional choices for allocating the risks of industrial injury. This Article does not offer American law as a model for direct adoption by Korean law. Its purpose, rather, is to reaffirm the distinctive structure of the Korean system—in which workers' compensation benefits and civil damages claims coexist—and to argue for a more refined design of how the two are meant to function and interact. In determining work-relatedness in particular, courts should systematically consider whether the work created or increased a given risk and whether the worker was actually exposed to it. For occupational disease and mental injury, the structure of proof should be reconsidered in light of scientific uncertainty and informational asymmetry, and disability benefits should account not only for medical impairment but also for loss of earning capacity and the prospect of returning to the labor market. The task for comparative law, in the end, is not to transplant the American exclusive-remedy principle, but to redesign, within the framework of Korean law itself, the proper relationship between statutory compensation and supplementary relief.
