The Foundational Discipline of Law as a Sociable Science : Identity and Prospects in Light of the Ideal of General Jurisprudence
The foundational discipline of law, which forms a principal pillar of legal scholarship alongside legal dogmatics, has once again found itself in a longstanding crisis since the introduction of law schools. Along with an overall review of legal education and the professional training system, there is a pressing need to newly establish the unique academic identity and prospects of the foundational discipline itself. This article seeks to locate the path forward for the foundational discipline in the ideal of a comprehensive discipline known as “general jurisprudence,” and presents how such a vision can be concretely realized in the dual dimensions of research and education. What is the foundational discipline of law? It can be defined as an academic field that investigates the “foundations of law” by pursuing a comprehensive understanding of law through a wide range of methods of legal inquiry. Ways of understanding the foundational discipline depend on one’s view regarding its identity, unity, and distinctness. Among the intellectual resources offering perspectives on the foundational discipline is the tradition of general jurisprudence developed within Anglo-American law. General jurisprudence is a comprehensive and integrative academic project that inquires into law in general, encompassing philosophical, historical, and social-scientific approaches to law. Although controversies persist over its methods and scope, law is an institution and practice existing at the intersection of universality and particularity; thus, the task of elucidating its nature must strive to discover what is common across legal phenomena in a broad sense, while simultaneously encompassing the social and historical contexts of law—namely, the dimensions of time and place, as well as the cognitive and psychological dimensions of participants. In light of this classical ideal, the foundational discipline as general jurisprudence must broaden the horizons of legal knowledge and expand what it means to “know law” by becoming a genuinely “sociable” science in both its methodology and its subject matter. Under this vision, the primary subfields of the foundational discipline—philosophy of law, history of law, and sociology of law—enter into a partnership, remaining mutually open to novel and diverse methodological attempts, including naturalized jurisprudence such as cognitive legal studies and experimental jurisprudence. Furthermore, these individual subfields of the foundational discipline serve as conduits through which legal scholarship connects with adjacent humanities and social sciences. Regarding the realization of such a sociable foundational discipline of law, an example in research is the collaboration among analytical, historical, moral-philosophical, and cognitive-scientific approaches in the inquiry into legal concepts. The foundational discipline thus operates as an arena for interdisciplinary research. Meanwhile, in the realm of education, considering institutional realities, one can envision, for instance, an introductory course in the foundational discipline as well as an integrated curriculum that shares a unified vision while clarifying the distinctness and specialization of each subfield. This presents a future prospect toward which the collective efforts of those who share an identity as “scholars of the foundational discipline of law” can strive in an era where the crisis of the foundational discipline is under discussion.
