As the number of closed schools continues to rise due to the decline in the school-age population, the Special Act on the Promotion of the Utilization of Abolished School Property(hereinafter “Abolished School Utilization Act”) was enacted in 1999 and remains in effect today. Despite the considerable time that has elapsed since its implementation, the utilization rate of closed school property remains low. While the reasons may vary, one prominent factor identified in practice is the difficulty in interpreting and applying the relevant statutory provisions between the Public Property and Commodity Management Act (hereinafter “Public Property Act”) and Abolished School Utilization Act. Fundamentally, abolished school property constitutes public property of local governments. Accordingly, it is generally governed by the Public Property Act, and Abolished School Utilization Act applies in precedence over the Public Property Act only when specifically prescribed. The relationship between the Public Property Act and Abolished School Utilization Act is that of a general law and a special law. This paper examines the formal and substantive relationships and limitations between these two statutes from a legal perspective, and proposes legislative improvements to effectively achieve the legislative intent of Abolished School Utilization Act. First, Abolished School Utilization Act designates the superintendent of a city or provincial office of education as the competent administrative authority under its special provisions. However, unless Abolished school property is used for educational, scientific, or artistic purposes, placing such authority under the competence of the metropolitan mayor or provincial governor aligns better with the legislative frameworks of the Local Autonomy Act, the Local Educational Autonomy Act, the Public Property Act, and Abolished School Utilization Act itself. This approach is also justified in facilitating diverse uses of closed school properties. Second, for Abolished School Utilization Act to apply as an exception, its provisions must be clear and unambiguous. If it is unclear whether Abolished School Utilization Act or the Public Property Act applies, addressees of the norm face difficulty discerning legal rules, raising concerns that enforcement authorities may exercise their power arbitrarily. Third, many of the special provisions stipulated under Abolished School Utilization Act overlap with preexisting, similar clauses in the Public Property Act. This duplication also raises questions regarding equity and coherence between the related provisions of both acts. Finally, one may acknowledge the necessity of allowing the construction of permanent structures on closed school property under the condition of subsequent donation, accompanied by long-term, rent-free leasing, as attracting private-sector investment is essential. However, Abolished School Utilization Act fails to define the permissible purposes of such permanent structures. It is therefore questionable whether permitting this arrangement simply on the ground that it utilizes Abolished school property is legally sound. In conclusion, to establish systematic legislative harmony, it is more effective to operate predominantly around basic or general acts wherever feasible. Even after a special act is enacted, it must be periodically reviewed to ensure that the coherence and simplicity of the statutory system are maintained. In doing so, the legal system will be able to fulfill its function as an instrument for executing public policy efficiently and uniformly. Continuous legislative realignment of the relationship between Abolished School Utilization Act and the Public Property Act is required, including measures such as integrating the former into the latter.
