Redesigning the Accountability Framework for Investigations by Judicial Police Officers Following the Separation of Investigation and Prosecution and the Establishment of the Serious Criminal Investigation Agency : Focusing on On-Site Responsiveness and Enhanced Human Rights Protection
This study examines the legal and practical implications of the organizational separation of investigation and prosecution and the establishment of the Serious Criminal Investigation Agency (SCIA) for the accountability of judicial police investigations, and proposes a redesigned accountability framework suited to a pluralized investigative system. With the SCIA and the Prosecution Service scheduled to commence operations in October 2026, general police investigations will coexist with specialized SCIA investigations of serious crimes. This structure may give rise to overlapping jurisdiction and fragmented responsibility throughout the process from the initial detection of a serious crime to notification, jurisdictional determination, case transfer, and subsequent investigation. This study evaluates the new system according to four criteria: the promptness of the initial on-site response, clarity in the allocation of investigative jurisdiction between the SCIA and the police, correspondence between authority and responsibility at each stage of investigation, and the protection of human rights through due process. The analysis finds that the statutory notification and transfer framework alone does not sufficiently determine the priority investigative agency in cases of overlapping jurisdiction, the permissible scope of police investigation before a transfer decision is made, or the point at which responsibility shifts between investigative agencies. To address this gap, this study conceptualizes the period between notification to the SCIA and the determination of whether a case will be transferred as a “jurisdictional transition stage.” During this stage, police investigative activity should be limited principally to urgent and indispensable measures. The study further proposes that the principal responsibility for subsequent investigation should shift when a standardized case handover has been completed and the SCIA has formally acknowledged receipt of the case. A pluralized investigative system may also increase the risks of duplicative questioning, repeated coercive measures, prolonged investigations, and infringements of fundamental rights resulting from the expanded sharing of investigative information. Accordingly, this study proposes several institutional reforms. First, the criteria for priority investigation and case transfer should be further specified by reference to the principal nature of the offense, the scale and professional complexity of the case, and the extent to which the investigation has already progressed. Decisions on transfer should be accompanied by stated reasons. A standing consultation mechanism should also be established between the SCIA and the National Office of Investigation, while serious jurisdictional disputes that remain unresolved after consultation should be subject to a supplementary jurisdictional adjustment procedure conducted by an independent adjudicatory body. Second, even before jurisdiction is finally determined, the agency that first detects the case should be permitted to conduct urgent and indispensable initial measures, such as evidence preservation and victim protection, within the limits of urgency, necessity, and minimum intrusion and only within the authority granted by applicable law. Third, responsibility should be attributed to the agency that actually exercises investigative authority at each stage, including initial investigation, case transfer, subsequent investigation, and supplementary investigation. Standardized case handover procedures and continuous electronic records should be used to ensure traceability of responsibility. Fourth, if subsequent legislation grants the Prosecution Service authority to request supplementary investigation, the prosecutorial authority should identify the purpose and subject matter requiring supplementation, while the investigative agency should retain responsibility for determining the specific investigative methods. This functional distinction is necessary to prevent supplementary investigation requests from operating as de facto investigative direction. In addition, a multilayered framework for human rights protection should combine restrictions on duplicative investigation, purpose limitation and access control over investigative information, investigative review, and judicial remedies. Ultimately, the accountability framework following the establishment of the SCIA should shift from an institution-centered allocation of powers to a procedure-centered allocation of authority and responsibility. In particular, identifying a jurisdictional transition stage and establishing a concrete responsibility-transfer point through standardized case handover and formal acknowledgment of receipt can reduce investigative gaps and prevent the diffusion or shifting of responsibility among multiple investigative agencies. Such a redesign can provide an institutional basis for preserving the professional capacity of serious-crime investigations and the on-site responsiveness and continuity of judicial police investigations while ensuring effective protection of fundamental rights.
