The Use of Pseudonymous Statement Records and the Protection of the Right to Cross-Examination : An Analysis of Admissibility and Probative Value
The protection of the identities of crime victims and informants has long been emphasized in criminal proceedings. To this end, investigative authorities have operated a system of “pseudonymous statements,” in which pseudonyms are used in place of the declarant’s actual identifying information. While this system protects declarants from potential retaliation, it may restrict the defendant’s ability to examine the declarant’s identity, interests, and motives, thereby affecting the right to cross-examination as an essential component of a fair trial. This study examines the legal basis and operation of pseudonymous statements and analyzes their impact on the right to cross-examination, focusing on admissibility and probative value. The study argues that the hearsay rule should be understood as a mechanism for controlling the lack of credibility associated with hearsay evidence, while the right to cross-examination functions as a practical means of such control. Based on an analysis of Supreme Court and Constitutional Court decisions, it further argues that restrictions on cross-examination should be assessed according to whether the opportunity was substantively and effectively guaranteed, whether the restriction is attributable to the defendant, and whether there are legitimate grounds for the restriction. With respect to admissibility, the mere use of a pseudonym does not in itself preclude admissibility. However, expanding the scope of pseudonymous statements through administrative regulations without a statutory basis raises concerns under the principle of statutory reservation. Where the opportunity for cross-examination is entirely lost and Article 314 of the Criminal Procedure Act applies, stricter scrutiny of the circumstances guaranteeing trustworthiness is warranted. With respect to probative value, the limitations arising from the non-disclosure of identifying information should be mitigated through judicial verification of relevant relationships and interests and the consideration of corroborating evidence. Ultimately, the proper use of pseudonymous statements requires a balanced approach that protects declarants’ identities while ensuring the defendant’s right to cross-examination through separate and sequential review of admissibility and probative value.
