The 2025 amendment to the Medical Service Act, promulgated on December 23, 2025, established an independent statutory framework for non-face-to-face medical treatment and thereby provided a legal basis for a system that had previously relied on administrative guidelines and pilot programs. However, statutory recognition alone does not complete the regulatory framework. Who may receive such treatment, in what manner, and under what operational and safety conditions will depend on the detailed standards to be set out in subordinate regulations. Written before those draft regulations are released, this article examines four areas that will determine the practical scope of the system and the level of patient safety it secures. First, for patient eligibility and exceptions permitting initial remote consultations, the standards should specify the factors underlying numerical rules on periods and regions, including the nature of the illness, the need for continuous management, transport accessibility and the patient's living area, and the possibility of linkage to in-person care, together with exceptions and periodic review procedures. Second, prescription restrictions, delivery of medicines, and transition to in-person care are not separate procedures but successive stages in a connected safety-control process for remote treatment, and the standards governing each stage should be linked accordingly. Third, with respect to intermediary platforms, clear identification of advertising and sponsorship, disclosure of economic relationships, and explanation of the principal ranking and recommendation criteria should be incorporated into the certification criteria and periodic investigations so that the statutory framework for certification and post-certification oversight can operate effectively. Fourth, because video and telephone consultations afford medical practitioners different levels of clinical information, the applicable standards should be differentiated according to the risk profile of the illness and the patient's digital accessibility. The article distinguishes matters that may be specified in subordinate regulations or administrative notices under the existing statutory delegations from matters involving new rights or obligations that require separate statutory authority, and proposes an implementation framework that reconciles access to healthcare with patient safety.
