Modern medical practice inherently involves uncertainty and constitutes an obligation of means rather than results. Even when physicians exercise due care, inevitable adverse outcomes—i.e., “medical risks”—are principally attributed to patients. The doctrine of informed consent serves as the key legal mechanism justifying this risk allocation. However, the current informed consent framework imposes comprehensive disclosure obligations on physicians without providing clear safe harbor criteria, thereby incentivizing defensive medicine. Meanwhile, patients often sign consent forms perfunctorily without substantial understanding, bearing resultant harms without genuine risk assumption. This study proposes the adoption of a Shared Decision-Making (SDM) model as an alternative framework to overcome these limitations and achieve rational allocation of medical risk. SDM is a collaborative process integrating medical evidence with patients’ personal values to reach optimal treatment decisions. It ensures patients' substantive autonomy while providing physicians who adhere to procedurally legitimate processes with a rational basis for legal protection. To support this proposal, the study conducts a comparative legal analysis of advanced jurisdictions. Washington State's legislation (RCW §7.70.060) grants physicians who utilize certified patient decision aids “prima facie evidence” of valid informed consent, effectively shifting the burden of proof and establishing a procedural safe harbor. The UK’s Montgomery v Lanarkshire Health Board judgment abandoned the physician-centered Bolam test in favor of a patientcentered materiality standard, judicially mandating substantive dialogue through SDM. Germany's Patient Rights Act (BGB §630e) codifies procedural requirements for informed consent, including oral communication, comprehensibility, alternative treatment disclosure, and adequate deliberation time. For Korea, this study recommends: (1) amending Article 24-2 of the Medical Service Act to move beyond enumerative disclosure requirements and establish SDM as a legal duty, with statutory presumption of compliance for physicians who document SDM processes; (2) developing and certifying Korean patient decision aids (K-Decision Aids) under public oversight; (3) reforming the fee-for-service system to compensate SDM consultation time adequately; and (4) judicial reorientation toward evaluating substantive communication processes documented in medical records rather than mere existence of consent forms. The SDM model proposed herein provides patients with substantive selfdetermination and physicians with procedural legitimacy-based legal protection, thereby achieving rational risk distribution and transforming adversarial doctorpatient relationships into therapeutic alliances.
