Reconstructing Core Competencies and Reforming the Training System for Investigative Police under Korea's 2026 Amended Criminal Procedure Act: An Analysis of Legal and Policy Materials, Field Opinion Data, and Current Police Training Programs
This study examines how Korea's amended Criminal Procedure Act (Act No. 21857), which takes effect on October 2, 2026, reshapes the job responsibilities and training needs of investigative police, and it derives common core competencies together with feasible measures for reforming the training system. In addition to statutes and policy documents current as of September 21, 2026, and prior research, the study cross-examined an aggregated analysis of 95 opinions submitted to an internal police open bulletin board immediately after promulgation (August 6–9, 2026), exploratory notes from face-to-face and telephone consultations with six serving police officers, and the 2026 Police Human Resource Development Plan together with investigation-related operational materials from new-recruit training at the Central Police Academy. The data were coded into six categories: (1) law and procedure, (2) investigative practice and evidence, (3) case management and investigation completeness, (4) ethics, oversight, and accountability, (5) digital technology and AI, and (6) organizational and training conditions. Applying six criteria—direct relevance to job duties, cross-verification across multiple data sources, commonality across investigative functions, trainability, behavioral observability, and distinguishability between individual competencies and organizational conditions—the first five categories were reconstructed as common core competencies. Thematic classification of the 95 internal opinions showed that 74 (77.9%) concerned section and team leadership, investigative staffing, and budget. This suggests that responding to the amended Act requires not only legal knowledge but also organizational support conditions, including leadership capacity, sufficient staffing and training time, and case management systems. Building on existing investigative training, the study proposes a training model that integrates performance-based assessment, protected learning time, adjusted case assignment, and linkage to qualification and posting systems. As an exploratory policy model, however, it should be continuously refined through qualitative in-depth research— such as in-depth interviews, focus group interviews (FGIs), and case studies involving serving investigators and training personnel—and through field-based validity review.
