Factors Influencing Sentencing in Cases of Violations of the Serious Accidents Punishment Act and the Allocation of Liability in Subcontracting Structures
This study analyzed the factors distinguishing between actual prison sentences and suspended sentences for individual defendants in cases involving violations of the Act on the Punishment of Serious Accidents, as well as the allocation of liability between prime contractors and subcontractors within the subcontracting structure. We structured 109 first-instance judgments handed down from 2023 through the first half of 2026 by case and defendant to identify accident characteristics, the status of prime contractors and subcontractors, and the aggravating and mitigating sentencing factors cited in the judgments. We examined the distribution of sentence types among 306 individual defendants, analyzed the factors determining sentence types for the 251 who received prison or detention sentences, and compared the maximum sentences imposed on the principal contractor’s management-level executives and the subcontractor’s representatives within the same case within the subcontracting structure. The analysis revealed that 8.8% of sentences were actual imprisonment, while 73.2% were suspended sentences. Ignoring prior warnings was associated with actual imprisonment, while reaching a settlement with the bereaved families, a request for non-prosecution, and measures to prevent recurrence were associated with suspended sentences; the number of fatalities influenced the severity of the sentence. Within the subcontracting structure, there were 23 cases where the principal contractor received a harsher sentence and 2 cases where the opposite occurred; independent violations by subcontractors were primarily reflected as mitigating factors in sentencing. These results suggest the need to distinguish between factors influencing the type and severity of sentences in cases involving violations of the Act on the Punishment of Serious Accidents, and to specifically reflect pre-accident risk management, post-accident victim compensation, and the actual responsibility for risk control within the subcontracting structure in sentencing guidelines and preventive policies.
